It’S All About What You Know: The Specific Intent Standard Should Govern "Knowing" Violations Of The Clean Water Act, Randall S. Abate, Dayna E. Mancuso

Part I of this Article examines the historical and conceptual foundations of the specific intent standard as applied both outside and within the environmental law context. Part II addresses the historical and conceptual foundations of the general intent standard, also outside and within the environmental law context. Part III reviews the history of the conflict between application of the specific intent and general intent standards in prosecutions for knowing violations of the Clean Water Act. Part IV presents arguments that support application of the specific intent standard to knowing violation cases under section 309(c)(2)(A) of the CWA. Part V analyzes …

A Little Adam Smith Is A Dangerous Thing, Jonathan B. Wight

Adam Smith was trying to counter medieval church theology, which held that any self-interested behavior was sinful and detrimental. Smith countered that self-interest could yield valuable outcomes for society as people pursued specialization and market trade. Much later these quotes would be used to justify the greedy and grasping personae of homo economicus, illustrating how a little Adam Smith can prove to be a dangerous thing. For example, Max Lerner in 1937 would say that Adam Smith "sanctified predatory impulses" and "gave a new dignity to greed." By the 1980s the movie Wall Street has the financial tycoon Gordon …

This article describes how library and Internet technology enhanced an action research assignment in a unique women’s studies program, Women Involved in Living and Learning (WILL), at the University of Richmond. The Women’s Studies Liaison Librarian and the Director of the WILL Program collaborated to provide a meaningful assignment that incorporated the use of online databases and the Internet. The main objective of the assignment was to provide a research opportunity whereby the students would learn to use electronic women’s studies resources and actually utilize the information into some type of social action, such as writing a letter, volunteering in …

The Effectiveness Of Experiential Education In Executive Development, Marlene Handley Rodenbaugh

Harold L. Hodgkinson Award for Outstanding Dissertation

This study explored the effectiveness of the Tavistock model, an experiential learning approach, in mobilizing change in the perception of authority relations of business executives as they interacted in a group relations event. A secondary goal was to test perceptions about this model as an effective executive development program. Results of prior studies on experiential learning outcomes are inconsistent, and few demonstrate that results match learning goals. This exploratory study used both quantitative and qualitative methods: Q-methodology and a questionnaire augmented by personal interviews, respectively. The results were triangulated in operationalizating the Kirkpatrick model, a widely accepted evaluation method for …
