Outside/In: Crossing Queer And Latino Boundaries, Luis Aponte Pares

In this essay, I posit that to fully grasp the degree to which Latinos have latinized New York City's landscapes, the role Latino queers play in this process merits examination. Latino queers have begun to challenge queer institutions. They also aim to be coproducers of a queer imaginary and appropriate places of queer culture, thus Latinizing queer culture. They also claim a role in the coproduction of a Latino imaginary. By adding sexual orientation to this identity, queers indeed "queer," mariconear, decenter heteronormative Latino culture, perhaps producing a new "conception of 'identity,' which lives with and through, not despite, difference," …

Neurodegenerative diseases, including Alzheimer’s disease, are characterized by a progressive and selective loss of neurons. Apoptosis under mitochondrial control has been implicated in this neuronal death process, involving the release of cytochrome c into the cytoplasm and initiation of the apoptosis cascade. However, a growing body of evidence suggests an active role for the endoplasmic reticulum in regulating apoptosis, either independent of mitochondrial, or in concert with mitochondrial-initiated pathways. Members of the Bcl-2 family of proteins have been shown to either inhibit apoptosis, as is the case with Bcl-2, or to promote it, in the case of Bax. Investigations in …

Balancing the autonomy of religious organizations against regulatory laws remains both a difficult and hotly contested issue. It is helpful to survey labor, property, tax, and education laws to illustrate the tensions between religion and government in American law.

Labor law cases show the autonomy of religious organizations concerning governmental regulations through the National Labor Relations Act and Title VII. In regard to church property, the government has an interest in regulating how religious organizations buy and sell land, run day care centers and food kitchens, raise and borrow money, commit torts, and enter into contracts. Walleye Stizostedion vitreum and saugeye (walleye x sauger S. canadense) fingerlings were concurrently stocked at equal densities into five small impoundments in 1997, 1988, and 1999 to evaluate relative survival, growth and their ability to restructure existing panfish communities. Prior to stocking, fish were differentially marked on the right or left side with freeze brands or with 700 ppm oxytetracycline hydrochloride (OTC) to allow accurate identification of each fish as a walleye (fry mark) or a saugeye (fingerling mark). When Copernicus and Galileo proposed that the earth circled the sun and not the 217 other way around, Christian believers faced the difficult prospect of surrendering a long-held belief that had seemingly undeniable support from the biblical text. After all, Joshua reported that the sun, not the earth, stood still; what could this mean if not that the sun orbited the earth? Today, centuries later, believers unanimously hold a heliocentric view of the solar system and are somewhat embarrassed by the ignorance of our pre-Enlightenment brothers and sisters. To date, no jurisdiction has adopted the useful life defense as part of its common law. Perhaps the time has come to reconsider this position and accept the logical consequences of such a defensive concept. At some point, natural deterioration, rather than a defect in design, manufacturing, or marketing, is the cause of a plaintiff’s injury. Combining the useful life defense with the reasonable expectation theory removes the burden of uniformly determining when a given product is legally dead. Distinguishing The Concept Of Strict Liability For Ultra-Hazardous Activities From Strict Products Liability Under Section 402a Of The Restatement (Second) Of Torts: Two Parallel Lines Of Reasoning That Should Never Meet, Charles E. Cantú

Strict liability for ultra-hazardous activities is entirely different from strict products liability. Since strict liability has been applied to so-called dangerous or ultra-hazardous activities, the application has been limited to instances where the defendant has, for his own purpose, created an abnormal risk of harm to those surrounding him, and therefore should pay for any resulting injury. Section 520 of the Restatement (Second) of Torts explains how one weighs the risk of harm emanating from ultra-hazardous activities against the appropriateness to its surroundings.
