Cmc Technology In The Classroom: A Look From A Professors Point Of View, Michael J. Shannon

Masters Theses

Technology now influences every aspect of daily life. Education is no exception. This is particularly true for Eastern Illinois University. With the increase of CMC technology on campus, it is important to know how professors feel about it and identify why some professors are not using it.

The specific purpose of this research was to focus on why CMC is beneficial in the classroom. This study discusses the kinds of technology available on campus and discovers the reasons why professors are reluctant to use CMC technology on campus.

This study identified a significant level of technology and assistance available on …

Psychological Sense Of Community : Adolescents' Response To Exclusion, Sharon J. Van Der Graaf Jan 2001

Psychological Sense Of Community : Adolescents' Response To Exclusion, Sharon J. Van Der Graaf

Theses : Honours

Since modernisation in western society, a number of changes have had a strong influence on the life of Adolescents'. This review examines adolescent development, particularly social role and identity formation, in relation to a changing social environment A brief historical overview is outlined to highlight how economic, political, and social changes have impacted on the development of the life phase, adolescence. The gap between childhood and adulthood is then defined to conceptualise adolescence as a social construction resulting from social changes. Social role and identity formation, and adolescent well-being are then addressed in response to social change. Factors including puberty, …

Experiences Of Relapse In Smoking Cessation, Natalie Kay D'Abrew Jan 2001

Experiences Of Relapse In Smoking Cessation, Natalie Kay D'Abrew

Theses : Honours

Relapse is regarded as a common occurrence, and it is known that smokers make an average of three to four attempts to cease smoking before maintaining smoking cessation. Thus, relapse continues to be a problem for interventions for smoking cessation. This qualitative study explored the experiences of relapse in smoking cessation. Fourteen participants, seven maintainers and seven relapsers aged between 21-80 participated in the study, which was facilitated by a semi-structured interview format. Several themes and sub-themes were generated under the categories of strategies, reasons for relapse, and reasons for cessation. The themes highlighted that there were differences between the …

Falling Out Of Love With America: The Clinton Impeachment And The Madisonian Constitution, Frank O. Bowman Iii Jan 2001

Falling Out Of Love With America: The Clinton Impeachment And The Madisonian Constitution, Frank O. Bowman Iii

Faculty Publications

First, were the Nixon and Clinton affairs truly as different as my memory makes them? Were the villains of Watergate as villainous and the heroes as heroic as I remember them? Were nearly all the players on both sides of l'affaire Lewinsky as shallow and fatuous as they seemed? Or to put the question in broader historical context, was the impeachment of Bill Clinton truly distinct, not only from Watergate, but from all of the other (fortunately few) occasions on which a president was seriously threatened with removal from office? Second, if the Clinton impeachment really was as bizarre, unprecedented, …

The 2001 Federal Economic Crime Sentencing Reforms: An Analysis And Legislative History, Frank O. Bowman Iii Jan 2001

The 2001 Federal Economic Crime Sentencing Reforms: An Analysis And Legislative History, Frank O. Bowman Iii

Faculty Publications

This Article has four parts. First, it describes the general structure of the Federal Sentencing Guidelines and the approach to sentencing economic crimes in effect between 1987 and 2001. Second, it outlines the defects in the former economic crime guidelines that led to the call for reform. Third, it describes the process undertaken by the Sentencing Commission that led to the passage of the 2001 economic crime amendments and, in so doing, provides a roadmap to sources of legislative history. Fourth, it explains and analyzes the new guidelines in light of their legislative history, with primary emphasis on the consolidated …

Chinese Mortgage Law: An American Perspective, Dale A. Whitman Jan 2001

Chinese Mortgage Law: An American Perspective, Dale A. Whitman

Faculty Publications

My objective in this paper is to compare and to evaluate some of the features of the American and Chinese systems. I do so without any preconception that the American system provides better answers, but with the recognition that it is far more mature and provides more answers. Hence it provides a reference point from which the Chinese system can be considered. Perhaps each system has something to teach the other.

The Clean Air Act And The Constitution, Lisa Heinzerling Jan 2001

The Clean Air Act And The Constitution, Lisa Heinzerling

Saint Louis University Public Law Review

On February 27, 2001, the Supreme Court unanimously upheld the Clean Air Act against a constitutional challenge based on the nondelegation doctrine. The Court held that the Act provided the requisite “intelligible principle” for assignments of authority to the executive, and it also held that the D.C. Circuit had erred in allowing an administrative agency to decide the scope of its own authority under what that court had held was an impermissibly broad assignment of authority. This article was written before the Supreme Court issued its decision.

"Partial Birth" Abortion And The Health Exception: Protecting Maternal Health Or Risking Abortion On Demand?, Gail Glidewell Jan 2001

"Partial Birth" Abortion And The Health Exception: Protecting Maternal Health Or Risking Abortion On Demand?, Gail Glidewell

Fordham Urban Law Journal

This note, which analyzes the central role of women's health in the debate over the limits of abortion rights, explores the implications of the Supreme Court's decision in Stenberg v. Carhart to invalidate a Nebraska statute banning partial birth abortion. Specifically, this note questions whether the Court's decision in Stenberg effectively requires that all future statutes banning partial birth abortion contain an exception for instances in which abortions are medically necessary to protect the health of the woman, and how such a requirement might be structured. The author answers the question in the affirmative, and argues that while broader exceptions …

Interpreting Urugual Round Agreements Act Section 102(B)'S Safeguards For State Sovereignty: Reconciling Judicial Independence With The United States Trade Representative's Policy Expertise, Brandon Johnson Jan 2001

Interpreting Urugual Round Agreements Act Section 102(B)'S Safeguards For State Sovereignty: Reconciling Judicial Independence With The United States Trade Representative's Policy Expertise, Brandon Johnson

Michigan Journal of International Law

In this Note, I address the concerns of one aspect of this academic commentary-the claim that the WTO Agreement may cause a tectonic shift in domestic regulatory power, away from the states and toward the federal government and/or the WTO. I argue that while the concerns about the loss of national sovereignty are exaggerated, there is a very real threat to the sovereignty of the States. Congress was aware of this danger and included a variety of provisions designed specifically to protect state sovereignty from federal encroachment in the Uruguay Round Agreements Act (URAA), the federal legislation incorporating the WTO …

The Asbestos Case And Dispute Settlement In The World Trade Organization: The Uneasy Relationship Between Panels And The Appellate Body, Sydney M. Cone Iii Jan 2001

The Asbestos Case And Dispute Settlement In The World Trade Organization: The Uneasy Relationship Between Panels And The Appellate Body, Sydney M. Cone Iii

Michigan Journal of International Law

This article deals with the working-level dispute-settlement apparatus of the World Trade Organization ("WTO"). In particular, it discusses the work of the Appellate Body and, functioning below it, panels established by the WTO to conduct proceedings in individual cases. It focuses on the relationship between the Appellate Body and panels, and on the responsibilities of the Appellate Body in the context of that relationship.

What's In A Name? Law's Identity Under The Tort Of Appropriation, Jonathan Kahn Jan 2001

What's In A Name? Law's Identity Under The Tort Of Appropriation, Jonathan Kahn

Faculty Scholarship

This article is divided into three parts. In Part I, the article explores the notion that under the tort of appropriation, a person’s name is understood to implicate critical aspects of her identity. This notion is explored in relation to specific historical cases raising the issues of whether a woman who adopts her husband’s name has a property right in that name and whether a person who adopts a professional or stage name has separate rights in that name apart from his legal name. Second, Part II focuses on a person’s right to maintain the integrity of his physical image. …

Ohio’S Competitive Advantage: Manufacturing Productivity, Edward W. Hill Jan 2001

Ohio’S Competitive Advantage: Manufacturing Productivity, Edward W. Hill

All Maxine Goodman Levin School of Urban Affairs Publications

The underlying theme of Dr. Hill’s book is that manufacturing is the connective tissue of the state’s economy. This is true in two ways: The first is in terms of the distribution of employment, and the second connection is in locations of different parts of the manufacturing production process. The key to increasing incomes in all parts of Ohio is to ensure that the products made in manufacturing production platforms remain competitive, which means vigorously pursuing public policies that enhance productivity—investing in both labor and capital.
