The Effectiveness Of European Community Law With Specific Regard To Directives: The Critical Step Not Taken By The European Court Of Justice, Carla A. Varner Jan 2001

The Effectiveness Of European Community Law With Specific Regard To Directives: The Critical Step Not Taken By The European Court Of Justice, Carla A. Varner

Michigan Journal of International Law

The purpose of this Note is to investigate the European Court of Justice's less expansive treatment of directives as compared to other forms of EC law through its failure to apply horizontal direct effect to directives. More specifically, this Note attempts to answer two questions which arise from the current status of ECJ jurisprudence: First, why has the Court been reluctant to implement horizontal direct effect for directives, especially in light of other actions it has taken to increase the potency of EC law? Second, given the alternative steps taken by the ECJ, is it still necessary to establish horizontal …

An Empirically Based Comparison Of American And European Regulatory Approaches To Police Investigation, Christopher Slobogin Jan 2001

An Empirically Based Comparison Of American And European Regulatory Approaches To Police Investigation, Christopher Slobogin

Michigan Journal of International Law

This article takes a comparative and empirical look at two of the most significant methods of police investigation: searches for and seizures of tangible evidence and interrogation of suspects. It first compares American doctrine regulating these investigative tools with the analogous rules predominant in Europe. It then discusses research on the American system that sheds light on the relative advantages and disadvantages of the two regulatory regimes.

Sexual Orientation And International Law: A Study In The Manufacture Of Cross-Cultural "Sensitivity", Eric Heinze Jan 2001

Sexual Orientation And International Law: A Study In The Manufacture Of Cross-Cultural "Sensitivity", Eric Heinze

Michigan Journal of International Law

Interest groups advocating rights of sexual minorities have been lobbying international organizations for years without success. A standard explanation for that failure is that human sexuality is something complex, even mysterious, which requires that international organizations proceed with special caution. In this essay, it will be argued that such an explanation amounts to a self-fulfilling prophecy. Sexual orientation is neither more nor less complex than many other issues, such as race, ethnicity, religion or gender, which have nevertheless found wide recognition within leading intergovernmental organizations. It is not because sexual orientation is uniquely complex or mysterious that it is barred …

Building A Strong Subnational Debt Market, Paul S. Maco

Richmond Journal of Global Law & Business

Decentralization of responsibility for finance and growing infrastructure needs are two trends that are expected to stimulate a growth in government borrowing at the sub-national level. Statistics for the first half of 2000 show a significant increase in sub-national debt volume, with global public finance, excluding Canada and the United States, more than doubling that of the first half of 1999.

Does Free Trade Cause Hunger? Hidden Implications Of The Ftaa, Jonathan B. Wight Jan 2001

Does Free Trade Cause Hunger? Hidden Implications Of The Ftaa, Jonathan B. Wight

Richmond Journal of Global Law & Business

This division of labour, from which so many advantages are derived, is not originally the effects of any human wisdom, which forsees and intends that general opulence to which it gives occasion. It is the necessary, though very slow and gradual consequence of a certain propensity in human nature which has in view no such extensive utility; the propensity to truck, barter, and exchange one thing for another.

An Oasis Or Just A Mirage: The Jericho Casino And The Future Of The Israeli-Palestinian Peace Process, Edward B. Miller Jan 2001

An Oasis Or Just A Mirage: The Jericho Casino And The Future Of The Israeli-Palestinian Peace Process, Edward B. Miller

Richmond Journal of Global Law & Business

More than seven years have passed since the signing of the historic peace agreement between Israel and the Palestine Liberation Organization (“P.L.O.”). While the final borders and powers of a Palestinian State are still being discussed by the parties to the agreement, the fact of Palestinian autonomy is an irreversible reality. As such, the Israeli military occupation of the West Bank and the Gaza Strip has slowly been giving way to a self-governing Palestinian body which now administers most of the territories and nearly all of the Palestinian who reside therein.

Identification Of Linkage Between Strategic Group And Performance Of Indian Commercial Banks: A Combined Approach Using Dea And Co-Plot, Prithwiraj Nath, Avinandan Mukherjee, Manabendra Nath

Marketing Faculty Research

This paper explores the linkage between strategic grouping and performance of the Indian banking sector. Strategic grouping and performance were identified using published financial information for all public sector banks. Grouping of Indian public sector banks following comparable financial strategy – with similar asset quality, operational efficiency and profitability was operationalized using the graphical display method of Co-plot.

From their position in the two dimensional conceptual map, banks with identical financial performance formed strategic groups with significant positive linkage between better groups and their superior financial performance, which showed their inherent homogeneity in business policy decisions. Relative performance of the …

Latent Narratives: Sideshadowing In "Fortunata Y Jacinta", Linda M. Willem Jan 2001

Latent Narratives: Sideshadowing In "Fortunata Y Jacinta", Linda M. Willem

Scholarship and Professional Work - LAS

In his book, Narrative and Freedom, Gary Saul Morson uses the term "sideshadowing" to identify a set of devices-operating in the works of Tolstoy and Dostoevsky-that are used to counter the closed view of time associated with another term, "foreshadowing." According to Morson, this temporal closure is the result of the backward causation of foreshadowing. That is, in foreshadowing something happens because something else is going to happen. Instead of being caused by a prior event, it is caused by a subsequent one. That means that the future is already set, at least to the extent that it can …

Beyond The Liberal Peace Project: Toward Peace With Justice, Harry Van Der Linden Jan 2001

Beyond The Liberal Peace Project: Toward Peace With Justice, Harry Van Der Linden

Scholarship and Professional Work - LAS

Many contemporary liberals adhere to the "liberal peace project" (LPP) -- that is, the idea that world peace can be realized through the spread of political liberalism, or capitalist democracy. The LPP is based on projecting toward the future the well-documented fact that secure modern democracies have never fought wars with one another. A spirit of optimism prevails among LPP proponents, bolstered by the recent uprise in democracies, and they argue that their cause can be advanced by a liberal foreign policy that promotes free trade and human rights. I argue that the LPP is flawed by not recognizing that …

The Political Katherine Mansfield, Lee Garver Jan 2001

The Political Katherine Mansfield, Lee Garver

Scholarship and Professional Work - LAS

Ideologies that have been superseded by more enduring political discourses and literary figures who have been succeeded by greater authors are frequently relegated to the footnotes of cultural scholarship. But sometimes these lesser-known subjects of literary history, properly attended to, provide unique opportunities for a richer understanding of aesthetic developments. The study of British modernism, in particular, can benefit from a willingness to examine forgotten political-cultural relationships. Indeed, the period's extreme ideological complexity and cross-fertilization has served to mask the important political roles played by less celebrated artists in the formulation of modernist aesthetic doctrine. This is particularly true of …

Lessons Taught By Miss Evers' Boys: The Inadequacy Of Benevolence And The Need For Legal Protection Of Human Subjects In Medical Research , Donald H.J. Hermann

Journal of Law and Health

The Tuskegee study is perhaps the most notorious example of abuse in medical research in the United States. It is significant that the project was not ended until twenty-five years after the adoption of the Nuremberg Code of 1948, the first article of which establishes its principle that human subjects should not be experimented on without their consent. Continuing concern about the ethics of medical and scientific research have been fueled by finding about other research abuse such as the radiation experiments in the 1940's and 1950's that involved subjects being injected with plutonium without their knowledge and feeding radioactive …

Genomic Medicine: The Human Genome Project From A Healthcare Provider's Perspective, Georgia Wiesner Jan 2001

Genomic Medicine: The Human Genome Project From A Healthcare Provider's Perspective, Georgia Wiesner

Journal of Law and Health

But the Human Genome Project from my point of view as a healthcare provider has really been on what advantages and what advances can we be able to provide from that. So we really learned a lot about how genes work, how they talk together and how we actually have both health and disease as a consequence of the Human Genome Project. So really understanding this complex interaction is one of the most exciting things as well. What this really has done for healthcare is allowed us to individualize our healthcare. To be able to say for one person against …

Legislation And Genetic Discrimination, Sharona Hoffman Jan 2001

Legislation And Genetic Discrimination, Sharona Hoffman

Journal of Law and Health

State legislation addresses genetic discrimination in both employment and health insurance. Thirty-one states have passed laws that address genetic discrimination in employment. Approximately thirteen states prohibit employers from requiring applicants to undergo genetic testing as a condition of employment. Some states have more limited restrictions. Florida prohibits only the screening of applicants for the sickle-cell trait. Wisconsin requires employers to obtain written and informed consent from applicants prior to administering genetic tests, but does not preclude their utilization altogether. Some states establish exceptions that permit genetic testing that is job-related or that is conducted, with the employee's written and informed …
