Common Cause: A Comparative Case Study Of Three Alabama Communities Organizing Against Landfills, Lani Merritt
Journal of Rural Social Sciences
This paper documents the organizational strategies of three Alabama community groups that have mobilized against the siting of municipal landfills. All three communities are predominately African-American, rural, and lower-income. The framework of environmental justice is applied to understand common elements of the three communities' experiences. The primary focus, however, is on differences between the cases that brought forward markedly different strategies. The purpose of this paper is to critically examine the different approaches taken by each community, and to identify factors and strategies that were crucial to success or failure from the perspective of landfill opponents. Apples For Oranges, J.B. Ruhl, James Salzman

Over the last decade, there has been a sea change in environmental law and policy, marked by growing interest in market-based instruments of environmental protection. In particular, approaches that explicitly commodify environmental impacts by creating markets for their sale are on the rise. These environmental trading markets (ETMs) now operate in a range of regulatory settings where parties exchange credits to emit air pollutants, extract natural resources, and develop habitat. In fact, every major environmental policy review in the last five years has called for even greater use of ETMs. Markets for environmental commodities represent the new wave of environmental …

Cultural Replication Theory And Law, Oliver Goodenough
The Gruter Institute Working Papers on Law, Economics, and Evolutionary Biology
Does law itself evolve? It has been widely suggested that culturally transmitted behavioral information exhibits a Darwinian evolutionary dynamic. The argument is straightforward. Darwinian evolution has three basic elements: (i) replicative descent with (ii) variation, subject to (iii) a form of selection. Bundles of cultural information as diverse as language, religious practices, and how to bake bread pass with imperfect fidelity from generation to generation. Some of the variants created by these imperfections are passed, non-randomly, to the next generation with greater frequency.

Pursuing Environmental Justice Through The Courts: An Overview Of The Process And Why It Has Failed, Julie Lynne Hershenberg
IPED Technical Reports
This project brought together two issues that dominate policy debates in the southwestern U.S. and especially along the United States – Mexico Border; namely, environmental justice, and legal liabilities associated with adverse environmental actions. Both are major implementation problems. In the southwest the issue becomes more problematic as the two-nations meet face-to-face, and the maquiladora industry continues to expand, creating new burdens on an already stressed environment as a result of industrial practices that have not always meet U.S. environmental standards.

Scientific Models Of Human Health Risk Analysis In Legal And Policy Decisions, Douglas Crawford-Brown
Law and Contemporary Problems
The quality of scientific predictions of risk in the courtroom and policy arena rests in large measure on how the two differences between normal practice and the legal/policy practice of science are reconciled. This article considers a variety of issues that arise in reconciling these differences, and the problems that remain with scientific estimates of risk when these are used in decisions.

The Hormesis Challenge For Environmental Health Regulators, Michael S. Baram

The hormesis hypothesis provides that human, animal or plant exposure to a low external dose of a hazardous chemical substance or physical agent may have beneficial health outcomes'. For example, human exposure to a precisely defined, low external dose of a carcinogenic pollutant in the workplace or ambient environment may lead to an internal dose or concentration, which stimulates a dormant defense mechanism that inhibits the growth of tumors.
