My Danish Background, Waldemar Westergaard Jan 2001

My Danish Background, Waldemar Westergaard

The Bridge

Editor's Note: This essay brought back fond memories for me, because I had the opportunity, some forty years ago, to meet Professor Waldemar Westergaard (1882-1963) in his pension in Store Kongensgade, near Kongens Nytoro in Copenhagen. It was the summer of 1962. My graduate school advisor, Professor Lawrence D. Steefel, was an old friend of his and recommended me to him. Professor Westergaard was eighty years of age but full of energy, charm, and good stories. He gave me the names of all kinds of people to contact in Copenhagen. The cordiality and intellectual acumen that characterize the following memoir …

Humanitarian Assistance In Non-International Armed Conflict: The Fourth Wave Of Rights, Duties And Remedies, Mary Ellen O'Connell Jan 2001

Humanitarian Assistance In Non-International Armed Conflict: The Fourth Wave Of Rights, Duties And Remedies, Mary Ellen O'Connell

Journal Articles

The international community is in the midst of a fourth wave of legal development with regard to the rights, duties and remedies associated with humanitarian assistance to victims of non-international armed conflict. This wave is part of a larger development affecting most aspects of international law at the beginning of the 21st century. International actors, in particular, non-governmental organizations (NGOs), have challenged the accepted categories of international law in almost all fields, including international humanitarian law. In international humanitarian law, NGOs are primarily challenging the traditional requirements of neutrality and consent in the distribution of emergency aid to victims of …

The History Of The Judicial Review Of Administrative Power And The Future Of Regulatory Governance, John J. Coughlin Jan 2001

The History Of The Judicial Review Of Administrative Power And The Future Of Regulatory Governance, John J. Coughlin

Journal Articles

Traditionally, judicial review has afforded an important check on the exercise of administrative power. First, judicial review functions to protect the legislative intent behind the statutory authorization of the exercise of administrative power. Pursuant to the conventional model, an administrative agency exercises restricted legislative and judicial functions under judicial scrutiny to insure compliance with congressional intent. Judicial review insures that "a congressional delegation of power . . . must be accompanied by discernible standards, so that the delegatee's action can be measured for its fidelity to the legislative will." Additionally, the opportunity for judicial review of administrative action corrects and …

Divorce And The Catholic Lawyer, John J. Coughlin Jan 2001

Divorce And The Catholic Lawyer, John J. Coughlin

Journal Articles

On January 28, 2002, Pope John Paul II focused his annual address to the officials of the Roman Rota on the topic of the indissolubility of marriage. At the conclusion of this theological and canonical analysis, the Holy Father made a few short statements cautioning civil lawyers about divorces cases. The following day, a story in The New York Times carried the headline "John Paul Says Catholic Bar Must Refuse Divorce Cases." The article construed the pope's reference as a blanket prohibition against Catholic lawyers handling divorce cases. It further questioned whether the prohibition contradicted the Pontiff's prior emphasis on …

The Use And Misuse Of Antiabuse Rules: Lessons From The Partnership Antiabuse Regulations, Alan Gunn Jan 2001

The Use And Misuse Of Antiabuse Rules: Lessons From The Partnership Antiabuse Regulations, Alan Gunn

Journal Articles

Subchapter K of the U.S. Internal Revenue Code was designed to achieve simplicity and flexibility in taxing partners. To limit this flexibility the regulations under subchapter K contain "antiabuse rules", aimed at insuring that subchapter K rules are applied consistently, with the "intent" of those rules in mind and allowing the Commissioner to treat a partnership as an aggregate of its partners in applying any Internal Revenue Code provision. Though antiabuse rules have received harsh criticism for being badly written, they are valuable in many ways. Such rules define abuse as something distinct in principle from substance-over-form and business purpose …

Jews, Christians, Lawyers, And Money, Thomas L. Shaffer Jan 2001

Jews, Christians, Lawyers, And Money, Thomas L. Shaffer

Journal Articles

Years ago, when I was the resident guru in legal ethics at Washington and Lee University, in the little mountain town of Lexington, Virginia, a reporter from the daily newspaper in Roanoke asked me to identify the most serious ethical issue for American lawyers. My answer: "Money."

Part of that answer reflected the fact that American lawyers make about twice as much money as lawyers in other "developed" countries. And American lawyers make, on the average, fifty percent more than average Americans do. (Reference to averages and means here do not reflect how steep the incline is from the middle …

Trouble Preserving Paradise?, Nicole Stelle Garnett Jan 2001

Trouble Preserving Paradise?, Nicole Stelle Garnett

Journal Articles

Election day 2000 was not a good day for proponents of suburban growth controls. The overwhelming initial support for initiatives that proposed state-wide growth management plans in Colorado and Arizona withered in the face of vigorous opposition campaigns. And, pro-planning forces in Oregon woke up on Wednesday morning to learn that voters had approved a little-noticed initiative amending the state constitution to require compensation for partial takings - that is, for any reduction in the fair market value of property resulting from government regulation - thus throwing into question the future of the State's widely touted model controlled-growth scheme.

These …

Chasing Bits Across Borders, Patricia L. Bellia Jan 2001

Chasing Bits Across Borders, Patricia L. Bellia

Journal Articles

As computer crime becomes more widespread, countries increasingly confront difficulties in securing evidence stored in electronic form outside of their borders. These difficulties have prompted two related responses. Some states have asserted a broad power to conduct remote cross-border searches - that is, to use computers within their territory to access and examine data physically stored outside of their territory. Other states have pressed for recognition of a remote cross-border search power in international fora, arguing that such a power is an essential weapon in efforts to combat computer crime. This Article explores these state responses and develops a framework …

The Effect Of Professional Growth Opportunities As Determined By California Public High School Instrumental Music Teachers, Charles Friedrichs Edd Jan 2001

The Effect Of Professional Growth Opportunities As Determined By California Public High School Instrumental Music Teachers, Charles Friedrichs Edd

Dissertations

Improving the quality of teaching and instruction is a continuing challenge for schools and teachers. To meet this challenge the State of California requires all teachers to participate in professional growth activities by showing evidence of 150 hours of professional growth every five years (Ed. Code §44277-2b). The purposes of this study were to examine the professional growth habits and needs of high school instrumental music teachers in the state of California, and the effectiveness of current professional growth opportunities as perceived by those teachers. In addition, this study examined the implications of professional growth opportunities for these music teachers …

The Effects Of Teachers' Flow Experiences On The Cognitive Engagement Of Students, Nian Q. Zhu Edd Jan 2001

The Effects Of Teachers' Flow Experiences On The Cognitive Engagement Of Students, Nian Q. Zhu Edd

Dissertations

The purpose of this quantitative study was to investigate the relationship between teachers' flow experiences and student cognitive engagement during class time. Study participants consisted of students and their teachers in grades 6 through 10 from a number of elementary and secondary schools in the Fraser Valley region of British Columbia, Canada. Data were collected through the use of the Experience-Sampling Method, originally developed by Csikszentmihalyi to investigate flow experiences, that allowed teachers and students to fill out sampling forms in response to randomly generated electronic signals transmitted to pagers or wrist watches that the teachers wore. Data were collected …

The Changing Nature Of Federal Regulation - Dedications, Joel Seligman Jan 2001

The Changing Nature Of Federal Regulation - Dedications, Joel Seligman

Scholarship@WashULaw

In 1911 the failure of state corporation statutes to prevent securities fraud gave rise to the first significant legislative response when Kansas enacted the first well known state securities law. The law was popularly known as a “blue sky” law, because its intention was to check stock swindlers so barefaced that they “would sell building lots in the blue sky.”

After the U.S. Supreme court held that the blue sky law was constitutional in 1917, the blue sky movement swept the country. By 1933 every state except Nevada had a state securities law in effect.

The Nontrial Adversarial Model: Complex Litigation At The Millennium, Joel Seligman Jan 2001

The Nontrial Adversarial Model: Complex Litigation At The Millennium, Joel Seligman

Scholarship@WashULaw

During the past two decades, a non-trial adversarial model has evolved for deciding private securities law claims. Underlying this evolution are three different types of dynamics: (1) a dramatic growth in the size of securities class actions, epitomized by the Washington Public Power Supply System litigation of the 1980s and the Court’s approval of the fraud-on-the-market presumption, rather than a requirement of individual proof of fraud, in Basic, Inc. v Levinson; (2) a significant growth in the cost and litigation leverage of discovery; and (3) a fundamental shift in the political orientation of Congress in securities litigation, illustrated by the …

Two Sides Of A River: Mormon Transmigration Through Quincy, Illinois, And Hannibal, Missouri, Fred E. Woods Jan 2001

Two Sides Of A River: Mormon Transmigration Through Quincy, Illinois, And Hannibal, Missouri, Fred E. Woods

Faculty Publications

The infamous extermination order issued 27 October 1838 by Missouri Governor Lilburn W. Boggs caused thousands of Latter-day Saints to flee the state and seek refuge in Illinois across the Mississippi River. Illinois, established in 1817, had high hopes for its future, but just two decades later it was smitten, like the rest of America, with the economic depression of 1837. In such a needy condition, the people Illinois welcomed the Mormon migrants for three central reasons. Financially motivated, the state viewed the Latter-day Saint influx as an opportunity to raise its population to boost the economy through the collection …

Encyclopedia Of Jihad, Alexei Malashenko, Stephen R. Bowers, Valeria Ciobanu Jan 2001

Encyclopedia Of Jihad, Alexei Malashenko, Stephen R. Bowers, Valeria Ciobanu

Faculty Publications and Presentations

The Western powers are the chief targets of a global Islamic jihad. Once believed to be a relic of history, the notion of Islamic jihad regained a political role in the 1980s. There are multiple meanings of the term jihad. While “great jihad” implies peaceful activity “small jihad” denotes the use of violence. There has never been a war in which Christians and Muslims have participated where the latter has not appealed to the slogan of holy war. The failure of Iran’s “white revolution” in 1979 set the stage for development of violent strategies against the West. The Chechen conflict …
