Neglected Stories And Civic Space, Peggy C. Davis
Neglected Stories And Civic Space, Peggy C. Davis
Faculty Articles
Professor Davis argues that millions of hours of struggle by people in the overlapping categories labeled African American, woman, and abolitionist warrant recognition as contributions to our Constitutional tradition. and explains why this recognition would enrich the United States’ civic and constitutional culture.
Employment And Labor Law Reform In New Zealand, Richard A. Epstein
Employment And Labor Law Reform In New Zealand, Richard A. Epstein
Faculty Articles
My task on this occasion is to talk about law reform in New Zealand, which invites you, the audience, to ask what a nice boy from Brooklyn knows about this subject. But in fact there is a close synergy between my previous work and the topic at hand. During the 1980s I wrote two controversial articles (and one rejoinder) on labor and employment law. Partly in consequence of my free-market message, in 1990, 1995, and 1999, I traveled to New Zealand at the behest of the New Zealand Business Round Table to speak about these subjects among others. I was …
Intellectual Property: Old Boundaries And New Frontiers, Richard A. Epstein
Intellectual Property: Old Boundaries And New Frontiers, Richard A. Epstein
Faculty Articles
It is a great honor for me to speak here this afternoon. The Harris Lecture Series is indeed one of the single most distinguished series of faculty lectures found in law schools throughout the country today, and I am proud to join the distinguished list of lecturers that have graced this podium in years past. The topic of this lecture is shrouded in ambiguity, for it travels under the name Intellectual Property: Old Boundaries and New Frontiers, which allows me more or less complete freedom to speak about the general field of intellectual property without violating the jurisdictional constraints imposed …
Super-Statutes, William N. Eskridge Jr., John A. Ferejohn
Super-Statutes, William N. Eskridge Jr., John A. Ferejohn
Faculty Articles
Not all statutes are created equal. Appropriations laws perform important public functions, but they are usually short-sighted and have little effect on the law beyond the years for which they apportion public monies. Most substantive statutes adopted by Congress and state legislatures reveal little more ambition: they cover narrow subject areas or represent legislative compromises that are short-term fixes to bigger problems and cannot easily be defended as the best policy result that can be achieved. Some statutes reveal ambition but do not penetrate deeply into American norms or institutional practice. Even fewer statutes successfully penetrate public normative and institutional …
A Woman Decides: Justice O'Connor And Due Process Rights Of Choice, Peggy C. Davis, Carol Gilligan
A Woman Decides: Justice O'Connor And Due Process Rights Of Choice, Peggy C. Davis, Carol Gilligan
Faculty Articles
A Woman Decides addresses the need for intellectual versatility among judges and lawyers. The underlying premise of the essay is that excellence in judicial practice requires integration of rule-based and contextual reasoning. Professor Gilligan's work is relied on both to explain the importance of intellectual versatility and to explain why cultures of professional practice fail to encourage it. Professor Davis's work is relied on to explain the importance of an intellectually versatile approach, and the dangers of an intellectually narrow approach, to decisionmaking that relates to three important aspects of substantive due process: the liberty interests in controlling the manner …
Curricular Responses To Globalization, John E. Sexton
Curricular Responses To Globalization, John E. Sexton
Faculty Articles
My mandate today is to speak about the globalization of the core law school curriculum, something that has been taking place at NYU Law School today and which I understand has also been starting to be adopted at other law schools around the country.

Yahoo And Democracy On The Internet, Joel R. Reidenberg
Yahoo And Democracy On The Internet, Joel R. Reidenberg
Faculty Scholarship
This article examines the French court order requiring Yahoo to prevent French Internet users from accessing images of Nazi memorabilia available for auction on the company's American web site. The article uses the French case to challenge the popular belief that an entirely borderless Internet favors democratic values. The article starts from the premise that while the Internet enables actors to reach a geographically dispersed audience, the Internet should not change the accountability of those actors for their conduct within national borders. The article shows that Yahoo's extensive business in France justifies the application of France's democratically chosen law and …
Crossing The Line: Case Studies Of Identity Development In First Generation College Women, Phyllis A. Wentworth, Bill E. Peterson
Crossing The Line: Case Studies Of Identity Development In First Generation College Women, Phyllis A. Wentworth, Bill E. Peterson
Psychology: Faculty Publications
In this paper we present four case studies of adult women from working class backgrounds who attended Hillside College (a pseudonym for one of the “seven-sister” colleges) during the early 1990s. Although research on women has led, over the past few decades, to a more complex picture of the contexts in which women develop their identities, one important context that has been underexplored is social class. Drawing on data from three lengthy interviews with each of our four participants, our purpose was to explore the identity concerns of adult women from working class backgrounds in their experience getting to and …

Fpc Residential Monitoring Project: New Technology Development Radiant Barrier Pilot Project, Florida Solar Energy Center, Danny Parker
Fpc Residential Monitoring Project: New Technology Development Radiant Barrier Pilot Project, Florida Solar Energy Center, Danny Parker
FSEC Energy Research Center®
The FPC Monitoring project has evaluated radiant barrier systems (RBS) as a new potential DSM program. The objective was to examine how the retrofit of attic radiant barriers can be expected to alter FPC residential space conditioning loads. An RBS consists of a layer of aluminum foil fastened to roof decking or roof trusses to block radiant heat transfer between the hot roof surface and the attic below. The radiant barrier can significantly lower summer heat transfer to the attic insulation and to the cooling duct system. Both of these mechanisms have strong potential impacts on cooling energy use as …

Children's Song-Makers As Messengers Of Hope: Participatory Research With Implications For Teacher Educators, Peter J. Baird
Children's Song-Makers As Messengers Of Hope: Participatory Research With Implications For Teacher Educators, Peter J. Baird
Doctoral Dissertations
Pete Seeger, Ella Jenkins, Suni Paz and six other leading children's musicians in the U.S contributed their experience to this study about the crucial role of music and singing for social justice in children's lives and its shrinking presence in U.S. pre-school and elementary schools. The study built its theoretical framework on arts and music education, transformative education, and folk and socially conscious children's music. Participatory research, based on the revolutionary education theories of Paulo Freire, guided the dialogues with the participants. These activist singer-songwriters were asked how they define social justice, how they involve children in singing, and what …
The Politics Of Judicial Reform In Japan: The Rule Of Law At Last?, Setsuo Miyazawa
The Politics Of Judicial Reform In Japan: The Rule Of Law At Last?, Setsuo Miyazawa
Faculty Scholarship
The purpose of this paper is to discuss the most recent changes in Japan's political environment that could radically alter its judicial system and legal profession in the near future. Reform of the judicial system and legal profession has now been placed on the national agenda, and the cast of players involved has spread from the traditional groups of legal professionals (judges, prosecutors, and attorneys) to the major actors of the larger political process, namely the Liberal Democratic Party (Jiya Minshu T6) ("LDP"), the ruling conservative party, and the Federation of Economic Organizations (Keidanren), one of the most influential organizations …
