Courts Should Not Enforce Government Contracts, Eric A. Posner Aug 2001

Courts Should Not Enforce Government Contracts, Eric A. Posner

Coase-Sandor Institute for Law & Economics Research Paper Series

Most scholars believe that courts should enforce government contracts, though they disagree about the extent to which liability or damages rules should trade off relevant considerations – the problem of governments holding up contractors, on the one hand, and the problem of governments using contracts in order to defer costs to future governments, on the other hand. These scholars, however, overestimate the ability of courts to affect policy outcomes. Courts cannot increase the welfare of current or future generations by enforcing government contracts. The reason is that enforcing contracts can benefit future generations only by increasing the credibility of their …

Sart, A Repressor Of Α-Hemolysin In Staphylococcus Aureus, Katherine A. Schmidt, Adhar C. Manna, Steven Gill, Ambrose L. Cheung Aug 2001

Sart, A Repressor Of Α-Hemolysin In Staphylococcus Aureus, Katherine A. Schmidt, Adhar C. Manna, Steven Gill, Ambrose L. Cheung

Dartmouth Scholarship

In searching the Staphylococcus aureus genome, we found several homologs to SarA. One of these genes, sarT, codes for a basic protein with 118 residues and a predicted molecular size of 16,096 Da. Northern blot analysis revealed that the expression of sarT was repressed by sarA and agr. An insertion sarT mutant generated in S. aureus RN6390 and 8325-4 backgrounds revealed minimal effect on the expression of sarR and sarA. The RNAIII level was notably increased in the sarT mutant, particularly in postexponential-phase cells, while the augmentative effect on RNAII was less. SarT repressed the expression of alpha-hemolysin, as determined …

Treatment Staff Burnout: Measuring The Effect Of Administrative Support In Adult Male Prisons, Brett Garland Aug 2001

Treatment Staff Burnout: Measuring The Effect Of Administrative Support In Adult Male Prisons, Brett Garland

All-Inclusive List of Electronic Theses and Dissertations

For the past few decades, criminologists have evaluated the success of treatment programs as the primary strategy to identify the best ways to lower offender recidivism. In doing so, they have repeatedly overlooked staff burnout as a potential barrier to rehabilitation. Because past research in human service agencies in general and prisons in particular has found organizational and administrative shortcomings to have the greatest impact on job strain and discomfort, this exploratory study examined the relationship between administrative support and the burnout of prison treatment staff. Burnout, the dependent variable, was measured by a modified version of an exhaustion index …

Green-Ampt Infiltration Model Parameter Determination Using Scs Curve Number (Cn) And Soil Texture Class, And Application To The Scs Runoff Model, Elena Viktorovna Brevnova Aug 2001

Green-Ampt Infiltration Model Parameter Determination Using Scs Curve Number (Cn) And Soil Texture Class, And Application To The Scs Runoff Model, Elena Viktorovna Brevnova

Graduate Theses, Dissertations, and Problem Reports (ETD)

The U.S. Department of Agriculture (USDA) Soil Conservation Service Curve Number (SCS CN) method is a simple and widely popular technique of estimation of direct runoff volume for design and natural rainfall events in small watersheds. The SCS CN procedure is incorporated into such computer programs as TR-20 and TR-55. Although the method reliably predicts 24-hr runoff volume, the predicted distribution of runoff during a storm event is not realistic. This shortcoming of the SCS CN method is due to weakness in the infiltration concept of the method. Use of a physically realistic and distributed Green-Ampt infiltration model can significantly …

This research focuses on evaluating the currently used FEC encoding-decoding schemes and improving the performance of error control systems by incorporating these schemes in a hybrid FEC-ARQ environment. Beginning with an overview of wireless communications and the various ARQ protocols, the thesis provides an in-depth explanation of convolutional encoding and Viterbi decoding, turbo (PCCC) and serial concatenated convolutional (SCCC) encoding with their respective MAP decoding strategies.;A type-II hybrid ARQ scheme with SCCCs is proposed for the first time and is a major contribution of this thesis. A vast improvement is seen in the BER performance of the successive individual FEC …

Development Of A Micro-Dilution Tunnel System For In-Use, On-Board Heavy-Duty Vehicle Particulate Matter Emissions Measurement, Emily Deanna Cirillo Aug 2001

Development Of A Micro-Dilution Tunnel System For In-Use, On-Board Heavy-Duty Vehicle Particulate Matter Emissions Measurement, Emily Deanna Cirillo

Graduate Theses, Dissertations, and Problem Reports (ETD)

A novel portable particulate matter measuring system was designed, developed and qualified. The heavy-duty engine Federal Test Procedure (FTP) requires the use of a full-flow tunnel to measure particulate emissions from diesel fueled engines. However, a full-flow tunnel based constant volume sampler (CVS) system is not only expensive to build and maintain, it also requires a large work space. The portable micro-dilution system that could be used for measuring on-board, in-use emissions from heavy-duty vehicles would cost significantly less. The micro-dilution tunnel operates on the same principle as a full-flow dilution tunnel. The added advantage of the proposed design is …

Numerical Modeling Of Chemical Recovery From Black Liquor Char, Dharmarajan Hariharan

Graduate Theses, Dissertations, and Problem Reports (ETD)

A complete CFD model for the char burning stage of chemical recovery from black liquor is presented. Chemical recovery from black liquor is characterized by the occurrence of multiple, simultaneous reactions occurring in dynamic flow conditions. Rate equations for the different chemical reactions are incorporated into a multiphase CFD code MFIX. Rate equations for sulfate reduction by carbon, gasification of carbon by CO2 and H2O, and, COS and H2S formation, are incorporated into MFIX, to simulate the chemical kinetics occurring in the char burning stage. Oxidation of carbon and Na 2S by O2 are also included.;Pyrolysis of black liquor char …

Video Partitioning By Temporal Slice Coherency, Chong-Wah Ngo, Ting-Chuen Pong, Roland T. Chin Aug 2001

Video Partitioning By Temporal Slice Coherency, Chong-Wah Ngo, Ting-Chuen Pong, Roland T. Chin

Research Collection School Of Computing and Information Systems

We present a novel approach for video partitioning by detecting three essential types of camera breaks, namely cuts, wipes, and dissolves. The approach is based on the analysis of temporal slices which are extracted from the video by slicing through the sequence of video frames and collecting temporal signatures. Each of these slices contains both spatial and temporal information from which coherent regions are indicative of uninterrupted video partitions separated by camera breaks. Properties could further be extracted from the slice for both the detection and classification of camera breaks. For example, cut and wipes are detected by color-texture properties, …

Effect Of Pretreatment On The Performance Of Metal Contaminated Commercial Fcc Catalyst, Oguz Bayraktar Aug 2001

Effect Of Pretreatment On The Performance Of Metal Contaminated Commercial Fcc Catalyst, Oguz Bayraktar

Graduate Theses, Dissertations, and Problem Reports (ETD)

The performance of fluid catalytic cracking (FCC) catalyst decreases due to the severe negative effects of metal contaminants (e.g., nickel, vanadium and iron) deposited on the catalyst from the hydrocarbon feed. The metal contaminants cause an increase in the production of gas and coke at the expense of gasoline.;In this work the effect of pretreatment with hydrogen and methane gases on the performance of commercial, metal-contaminated, FCC equilibrium catalysts was investigated. Cracking reactions of both sour imported heavy gas oil (SIHGO) and n-hexadecane were carried out in a microactivity test (MAT) unit using three commercial equilibrium catalysts with different metals …

Jihadi Groups, Nuclear Pakistan, And The New Great Game, M. Ehsan Ahrari Dr. Aug 2001

Jihadi Groups, Nuclear Pakistan, And The New Great Game, M. Ehsan Ahrari Dr.

Books, Monographs & Collaborative Studies

For the United States and other nations concerned with security in South and Central Asia, one of the most ominous trends has been the growing influence of Jihadist groups in Pakistan which feel obligated to wage holy war against everything that they perceive as non-Islamic. Their objective would be a Pakistani government similar to the Taliban regime in Afghanistan. The danger this would pose to regional stability and U.S. interests is clear. The author assesses Jihadi groups from the framework of a new "Great Game" for influence in Central Asia involving an array of states. He argues that, if this …

Dynamic Hyperpolarizability And Two-Photon Detachment In The Presence Of A Strong Static Electric Field: Application To H-, M.V. Frolov, N.L. Manakov, Anthony F. Starace

Anthony F. Starace Publications

Our recent analysis [J. Phys. B 33, R141 (2000)] of the problem of H- in both laser and strong static electric fields, which treated effects that are linear in the laser intensity l (e.g., the dynamic polarizability and the single-photon detachment cross section), is extended here to treat effects of higher order (∼l2) in the laser intensity (e.g., the dynamic hyperpolarizability, the two-photon detachment cross section, the linear in l corrections to the single-photon detachment rate, etc). We introduce the concept of the dynamic hyperpolarizability of an atom in the presence of a strong electric field …

Allergic Bronchopulmonary Aspergillosis Mimicking Pulmonary Tuberculosis, Omer S. Al-Moudi Aug 2001

Allergic Bronchopulmonary Aspergillosis Mimicking Pulmonary Tuberculosis, Omer S. Al-Moudi

Saudi Medical Journal

Allergic bronchopulmonary aspergillosis is an uncommon disease in which cystic bronchiectasis is a common feature. The presence of central bronchiectasis with constitutional symptoms of cough, fever, weight loss, and pulmonary infiltration in patients with allergic bronchopulmonary aspergillosis has been misdiagnosed as cavitating pulmonary tuberculosis. Herein, we report 2 cases of allergic bronchopulmonary aspergillosis that were misdiagnosed as pulmonary tuberculosis and treated with antituberculous therapy. They all have negative sputum and bronchoalveolar lavage for acid-fast bacillus as well as their tuberculin tests. The diagnosis of pulmonary tuberculosis was based on the presence of symptoms and radiological changes. In both cases the …

Making Organizational Punishment Work: The Effects Of Social Accounts And Punishment Severity, Andrew L. Noon Aug 2001

Making Organizational Punishment Work: The Effects Of Social Accounts And Punishment Severity, Andrew L. Noon

Student Work

Punishment continues to be used by organizations as one method to eliminate unwanted employee behaviors. Bennett (1998) argued that managers must be aware of two aspects of the punishment situation: (a) the punishment intensity and (b) the negative consequences of the punishment. Previous research indicates that strong punishments are most effective at changing unwanted behaviors, but strong punishments are also more prone to producing negative attitudes in the punished individual. One way managers may be able to reduce the negative impact of punishment is by using explanations regarding the need for punishment. These explanations are called social accounts. Not all …

A Field Study Examining Leader-Member Exchange (Lmx): Challenging The Universally Positive Conceptualization Of Lmx, Thomas Michael Hepperlen Aug 2001

A Field Study Examining Leader-Member Exchange (Lmx): Challenging The Universally Positive Conceptualization Of Lmx, Thomas Michael Hepperlen

Student Work

The construct of Leader-Member Exchange (LMX) - which emphasizes the quality of the relationship within supervisor-subordinate dyads - has received much empirical support over the last 25 years. Although high LMX relationships have generally been construed as universally positive in the scientific literature, some recent evidence suggests that: (a) all employees may not have an equal opportunity to develop high LMX relationships with their superiors, and (b) some high LMX employees may actually perform below the level o f their low LMX counterparts. In order to address both the positive and negative aspects o f LMX, the present thesis proposed …

Third-Graders' Motivation, Metacognition, And Transaction As They Learn About Women In History, Joyce Pawlenty Aug 2001

Third-Graders' Motivation, Metacognition, And Transaction As They Learn About Women In History, Joyce Pawlenty

Student Work

The purposes of this study were to describe (1) the process(es) students use to choose women in history to research; (2) students’ motivation to read literature about women; (3) metacognitive strategies students used as they read, wrote, and learned about women; and (4) ways in which students transacted with ideas in the literature they read. Eighteen third-grade students participated in a class unit about women in history. Four of those students who had demonstrated lower reading achievement were the focus of more in-depth study. Students chose and read a biography about a woman. As the students read, they wrote their …
