"Closet Case": Boy Scouts Of America V. Dale And The Reinforcement Of Gay, Lesbian, Bisexual, And Transgender Invisibility, Darren L. Hutchinson

Faculty Articles

This Article argues that the Supreme Courts decision in Boy Scouts of America v. Dale misapplies and ignores controlling First Amendment precedent and incorrectly dermes "sexual identity" as a clinical or biological imposition that exists apart from expression or speech. This Article provides a doctrinal alternative to Dale that would protect vital interests in both equality and liberty and that would not condition, as does Dale, sexual "equality" upon the silencing of gay, lesbian, bisexual, and transgender individuals.

Teaching Restitution, Candace Kovacic-Fleischer Jan 2001

Teaching Restitution, Candace Kovacic-Fleischer

Scholarly Articles in Law Reviews & Journals

INTRODUCTION: When I began teaching in 1981, I was assigned two separate Remedies courses to teach during the fall: Equitable Remedies and Legal and Extraordinary Remedies. For the Equitable course, I chose the text Leavell, Love & Nelson, Equitable Remedies, Restitution and Damages (3d ed. 1980) and for the Legal and Extraordinary course, York and Bauman, Remedies (3d ed. 1979). I was not sure what "extraordinary remedies" were if they were not equitable remedies, so I assumed they must be this topic called restitution. Of course, most people refer to equitable remedies as the extraordinary ones, and my two Remedies …

The Promise Of Certainty In The Law Of Pre-Incorporation Contracts, Poonam Puri

In practice, most pre-incorporation contracts cause no difficulty for the parties who intend to benefit directly from them. In the normal course of events, once the corporation is incorporated, both the corporation and the third party perform on the contract: However, when the corporation does not come into existence, or comes into existence but refuses to adopt a contract, difficult legal issues arise in relation to the rights and liabilities of the parties? The Supreme Court Of Canada In The 21st Century, Patrick J. Monahan Jan 2001

The Supreme Court Of Canada In The 21st Century, Patrick J. Monahan

Articles & Book Chapters

This paper reviews the evolution in the role and fonctions of the Supreme Court of Canada over the past 25 years, and attempts to identify certain major challenges facing the institution in the decades ahead. In the past 25 years, the Supreme Court has moved from a traditional appellate tribunal to a body exercising a broader supervisory function in the interpretation and the application of Canadian law. Professor Monahan describes the nature of this evolution, and compares certain key aspects of the Court's current caseload and performance with that of the English House of Lords and the U.S. Supreme Court. …

Electrochemistry And Spectroelectrochemistry Of Iron Porphyrins In The Presence Of Nitrite, Zhongcheng Wei, Michael D. Ryan Jan 2001

Electrochemistry And Spectroelectrochemistry Of Iron Porphyrins In The Presence Of Nitrite, Zhongcheng Wei, Michael D. Ryan

Chemistry Faculty Research and Publications

The reaction of nitrite with ferric and ferrous porphyrins was examined using visible, infrared and NMR spectroscopy. Solutions of either ferric or ferrous porphyrin were stable in the presence of nitrite, with only complexation reactions being observed. Under voltammetric conditions, though, a rapid reaction between nitrite and iron porphyrins was observed to form the nitrosyl complex, Fe(p)(NO), where P = porphyrin. The products of the reduction of ferric porphyrins in the presence of nitrite were confirmed by visible spectroelectrochemistry to be Fe(P)(NO) and [Fe(P)]2O. Visible, NMR and infrared spectroscopy were used to rule out the formation of Fe(P)(NO) by the …

Aerobic Respiratory Costs Of Swimming In The Negatively Buoyant Brief Squid Lolliguncula Brevis, Ian K. Bartol, Roger Mann, Mark R. Patterson Jan 2001

Aerobic Respiratory Costs Of Swimming In The Negatively Buoyant Brief Squid Lolliguncula Brevis, Ian K. Bartol, Roger Mann, Mark R. Patterson

Biological Sciences Faculty Publications

Because of the inherent inefficiency of jet propulsion, squid are considered to be at a competitive disadvantage compared with fishes, which generally depend on forms of undulatory/oscillatory locomotion. Some squid, such as the brief squid Lolliguncula brevis, swim at low speeds in shallow-water complex environments, relying heavily on fin activity. Consequently, their swimming costs may be lower than those of the faster, more pelagic squid studied previously and competitive with those of ecologically relevant fishes. To examine aerobic respiratory swimming Costs, O2 consumption rates were measured for L. brevis of various sizes (2-9 cm. dorsal mantle length, DML) …

The Evolution Of Real Estate In The Economy, Dapeng Hu, Anthony Pennington-Cross

Finance Faculty Research and Publications

While the economy as a whole has been rapidly changing in response to technological innovation, real estate has evolved from a depository of wealth for households and assets for corporations into a major force in the debt and equity markets. In contrast, the role of real estate as a contributor to the nation's output and income has remained steady at approximately 11% of gross domestic product.

Jurisdiction, Jurisprudence And Legal Change: Sociological Jurisprudence And The Road To International Shoe, Logan E. Sawyer Iii

Scholarly Works

While scholars espousing ideological explanations have noted the correlation between the intellectual trends of the New Deal and International Shoe, they have not demonstrated the strength of this connection. Some merely assert that ideology caused International Shoe,12 while others point to only very general similarities between International Shoe and the ideology of the age.' 3 This Article attempts to strengthen the ideological explanation by examining closely the intellectual context of International Shoe. That examination reveals that the decision did not result simply from the expansion of interstate business or the inherent weakness of the Pennoyer system. Instead, International Shoe was …
