Emergency Preparedness From A Health Perspective: Preparing For Bioterrorism At The Federal, State, And Local Levels, Robin J. Strongin

National Health Policy Forum

Despite the good intentions prior to and in the aftermath of the terrorist attacks of September 11, 2001, the existence of significant gaps in the country's preparedness became increasingly clear in the weeks that followed. This background paper provides an overview of the state of bioterrorism preparedness at all levels of government, identifying both the gaps and the steps being taken to close them. A series of reference materials, including a suggested reading list and Web site addresses, are listed at the end of the paper.

Olmstead V L.C.: Federal Implementation Guidelines, And Analysis Of Recent Cases Regarding Medicaid Coverage Of Long Term Care Services For Persons With Disabilities, Sara J. Rosenbaum

Health Policy and Management Issue Briefs

This analysis reviews the key elements of the United States Supreme Court's 1999 decision in Olmstead v L.C. as well as Federal implementation guidelines issued by the United States Department and Human Services. The Olmstead decision interprets the Americans with Disabilities Act ("ADA," PL 101-336), whose requirements apply to the use of all public funds. However, Medicaid represents the single largest source of public funding for both institutional and non-institutional services for persons with disabilities. As a result, when states expend Medicaid funds on care for persons with disabilities, two independent sets of legal requirements are triggered: those contained in …

Protecting Public Surface Transportation Against Terrorism And Serious Crime: Continuing Research On Best Security Practices, Mti Report 01-07, Brian M. Jenkins Oct 2001

Protecting Public Surface Transportation Against Terrorism And Serious Crime: Continuing Research On Best Security Practices, Mti Report 01-07, Brian M. Jenkins

Mineta Transportation Institute

Terrorist attacks on commercial aviation had declined significantly after reaching a high point in the 1970s. The devastating consequences of the four coordinated hijackings and deliberate crashes of three of the planes into the World Trade Center in New York and the Pentagon in Washington, D.C., on September 11, 2001—an event unprecedented in the annals of terrorism—have wiped out all sense of progress and focused national attention on aviation security. Meanwhile, terrorists have continued to attack public surface transportation worldwide with no indication of abatement in these attacks.1 With large-scale indiscriminate violence clearly the reality of contemporary terrorism and growing …

Factors Influencing Voting Results Of Local Transportation Funding Initiatives With A Substantial Transit Component: Case Studies Of Ballot Measures In Eleven Communities, Mti Report 01-17, Richard Werbel, Peter J. Haas

Mineta Transportation Institute

This publication is a follow-up study to MTI publication 00-01, Why Campaigns for Local Transportation Funding Initiatives Succeed or Fail: An Analysis of Four Communities and National Data. The earlier publication was case studies of four local ballot tax measures for transportation packages. The current study, Factors Influencing Voting Results of Local Transportation Funding Initiatives with a Substantial Rail Transit Component: Case Studies of Ballot Measures in Eleven communities, uses the same case study methodology as the prior study, and is expanded to 11 communities from the past four years. Some of the important conclusions identified by the study are …

The Fine Structure Of The Kasparov Groups I: Continuity Of The Kk-Pairing, Claude Schochet Oct 2001

The Fine Structure Of The Kasparov Groups I: Continuity Of The Kk-Pairing, Claude Schochet

Mathematics Faculty Research Publications

In this paper it is demonstrated that the Kasparov pairing is continuous with respect to the natural topology on the Kasparov groups, so that a KK-equivalence is an isomorphism of topological groups. In addition, we demonstrate that the groups have a natural pseudopolonais structure, and we prove that various KK-structural maps are continuous.

A Comment On Language And Norms In Complex Business Contracting, Claire A. Hill Oct 2001

A Comment On Language And Norms In Complex Business Contracting, Claire A. Hill

Chicago-Kent Law Review

Complex contracts, such as those governing loans and acquisitions, create a state of the world-parties entering into a contract thereby become bound. The contract expressly summons up legal consequences for every promise it contains. But the relationship between the promises and the law's force is attenuated. Very often contract provisions set the stage rather than provide the script: accommodation seems more the rule than the exception. Indeed, for most contracting parties, the law's specter is one of many reasons to do what they promised to do, and often, not the most important reason. Parties also feel constrained by reputational and …

Who Owns A Corporation And Who Cares?, Richard A. Booth Oct 2001

Who Owns A Corporation And Who Cares?, Richard A. Booth

Chicago-Kent Law Review

This Article focuses on the conventional theory that a corporation is owned by its stockholders and argues that the theory retains little if any explanatory or predictive force. After a brief consideration of the need for and function of legal theories in general and the evolution of the stockholder ownership theory, the Article proceeds to describe how the takeover wars of the 1980s brought into high relief the unavoidably conflicting interests of stockholders and managers, owing primarily to the fact that investor-stockholders are free to diversify whereas managers generally are not. Although the stockholder ownership theory is consistent with the …

Low Proof Load Prediction Of Ultimate Strengths Of Fiberglass/Epoxy I-Beams Using Acoustic Emission, Edward C. Fatzinger Jr. Oct 2001

Low Proof Load Prediction Of Ultimate Strengths Of Fiberglass/Epoxy I-Beams Using Acoustic Emission, Edward C. Fatzinger Jr.

Master's Theses - Daytona Beach

Acoustic emission (AE) nondestructive testing was used to monitor fiberglass/epoxy I-beams. The experiment consisted of loading the I-beams in cantilever fashion with a hydraulic ram. While testing, AE waveforms were collected from the onset of loading to failure. After acquisition, the AE data from each test were filtered to include only data collected up to 50% of the theoretical ultimate load for further analysis.

A Kohonen self-organizing map was utilized to separate each individual data point (hit) into failure mechanism clusters. Then a multiple linear regression analysis was performed using the percentage of hits associated with each failure mechanism along …

Of Theory And Practice, Tamar Frankel Oct 2001

Of Theory And Practice, Tamar Frankel

Chicago-Kent Law Review

Much has been written about theory and practice in the law, and the tension between practitioners and theorists. Judges do not cite theoretical articles often; they rarely "apply" theories to particular cases. These arguments are not revisited. Instead the Article explores the working and interaction of theory and practice, practitioners and theorists. This Article starts with a story about solving a legal issue using our intellectual tools—theory, practice, and their progenies: experience and "gut." Next the Article elaborates on the nature of theory, practice, experience and gut. The third part of the Article discusses theories that are helpful to practitioners …

Implications Of Shareholder Diversification On Corporate Law And Organization: The Case Of The Business Judgment Rule, Peter V. Letsou Oct 2001

Implications Of Shareholder Diversification On Corporate Law And Organization: The Case Of The Business Judgment Rule, Peter V. Letsou

Chicago-Kent Law Review

The business judgment rule has been a centerpiece of corporate law for almost two centuries. But over the last several decades, courts and commentators have struggled to find a rationale for the business judgment rule that, at once, reconciles the judicial deference granted to corporate managers with the more demanding standards applied to other professionals, such as doctors and lawyers. This Article attempts to end this struggle by offering a fuller account of the relationship between the preferences of diversified shareholders, on the one hand, and liability rules, on the other. Based on this account, this Article contends that the …
