Securities Fraud In Cyberspace: Reaching The Outer Limits Of The Federal Securities Laws, Constance Z. Wagner Jan 2001

Securities Fraud In Cyberspace: Reaching The Outer Limits Of The Federal Securities Laws, Constance Z. Wagner

Nebraska Law Review

Securities regulation is an area of the law in which existing rules are being rendered obsolete by technological developments. Recent Securities and Exchange Commission (SEC) enforcement actions involving Internet fraud can be categorized as “cyberhype” and may involve fraud if the promoter makes material misrepresentations, fails to disclose its intention to dispose of its stock at a profit into the rising trading market that develops after such promoter's recommendation, or fails to disclose that it promoted the stock for compensation. This article focuses on the SEC lawsuit against Yun Soo Oh Park, a/k/a “Tokyo Joe,” a case that was settled …

Particular attention is devoted to Wavelength Division Multiplexing (WDM) networks. Static and dynamic solutions of the routing and wavelength assignment (RWA) problem are considered. Issues of current research are summarized.

Avalanche And Bit Independence Properties For The Ensembles Of Randomly Chosen N \Times N S-Boxes, Işil Vergi̇li̇, Melek D. Yücel Jan 2001

Avalanche And Bit Independence Properties For The Ensembles Of Randomly Chosen N \Times N S-Boxes, Işil Vergi̇li̇, Melek D. Yücel

Turkish Journal of Electrical Engineering and Computer Sciences

Cryptographic test methods such as avalanche, strict avalanche and bit independence criteria, which measure the degree of security of the s-boxes of substitution-permutation networks, are applied to randomly generated ensembles of ( n \times n \) s-boxes. Statistical analysis of experimental data directs the work towards defining ``relative errors'' and examining the avalanche and strict avalanche criteria within ``relative error ranges''. Histograms of relative errors in each ensemble are evaluated, and combining the results of different ensembles corresponding to different values of the s-box size, variations of maximum relative errors versus the size of the s-box are depicted. Some predictions …

Performance Evaluation Of Safer K-64 And S-Boxes Of The Safer Family, Ekrem Aras, Melek D. Yücel Jan 2001

Performance Evaluation Of Safer K-64 And S-Boxes Of The Safer Family, Ekrem Aras, Melek D. Yücel

Turkish Journal of Electrical Engineering and Computer Sciences

If the characteristics of s-boxes of the SAFER family of ciphers are examined for the criteria of strict avalanche, bit independence, and XOR table distribution, experiments show that the ``exponentiating'' s-box has a weakness for an input difference of 128 (=10000000_{2}) and the ``logarithm-taking'' s-box has a weakness for an input difference of 253 (=11111101_{2}). However, since these experiments are performed by isolating the s-boxes from the general structure, they do not necessarily indicate a weakness in the overall algorithm. We propose a quick and rough test method, called the avalanche weight distribution criterion, to evaluate the overall performance of …

Networking Strategy Of Boards: Correlates, Performance Effects, And Implications For Small And Medium-Sized Enterprises, Gerard George, D. Robley Wood, Raihan Khan Jan 2001

Networking Strategy Of Boards: Correlates, Performance Effects, And Implications For Small And Medium-Sized Enterprises, Gerard George, D. Robley Wood, Raihan Khan

Research Collection Lee Kong Chian School Of Business

Development of linkages with the external environment, e.g. interlocks, is a mechanism to access scarce resources. Creating and maintaining these linkages may be an organizational capability that creates a competitive advantage for small and medium-sized enterprises (SMEs). A partial model of networking strategy is proposed, which includes measures of board composition, interlocks, entrepreneurial orientation and environmental hostility. Analysis of 70 community bank Chief Executive Officer (CEO) responses (58% response rate) lends support to the proposition that firms with a networking strategy performed better (higher return on assets (ROA) and higher return on expenditure (ROE)) than those firms that did not …

An Operator-Based Account Of Semantic Processing, Deryle W. Lonsdale, C. Anton Rytting Jan 2001

An Operator-Based Account Of Semantic Processing, Deryle W. Lonsdale, C. Anton Rytting

Faculty Publications

This paper explores issues of psychological plausibility in modeling natural language understanding within Soar, a symbolic cognitive model. It focuses on constructing syntactic and semantic representations in simulated real time, with particular emphasis on word sense disambiguation (WSD). We discuss (i) what level of WSD should be modeled and (ii) how to use resources such as WordNet to inform these models. A preliminary model of coarse-grained WSD is included to show how syntactic, semantic, and other knowledge sources interact in Soar. Finally, we explore issues of interleaving, learning, and integrating other WSD approaches with Soar's native model of learning.

The Bullet Gic As An Example, David F. Babbel, Jeremy Gold, Craig B. Merrill Jan 2001

The Bullet Gic As An Example, David F. Babbel, Jeremy Gold, Craig B. Merrill

Faculty Publications

There has been considerable discussion of a variety of issues related to fair value in the actuarial literature, in conferences, and among individuals interested in this topic. Unfortunately, we seem to be failing to communicate due, in part, to inconsistent use of terminology. The goal of this discussion paper is to present a few concepts that we hope will be of use in the broader discussion of fair value of liabilities.

Good Day Sunshine: Stock Returns And The Weather, David Hirshleifer, Tyler Shumway Jan 2001

Good Day Sunshine: Stock Returns And The Weather, David Hirshleifer, Tyler Shumway

Faculty Publications

Psychological evidence and casual intuition predict that sunny weather is associated with upbeat mood. This paper examines the relationship between morning sunshine in the city of a country's leading stock exchange and daily market index returns across 26 countries from 1982 to 1997. Sunshine is strongly significantly correlated with stock returns. After controlling for sunshine, rain and snow are unrelated to returns. Substantial use of weatherbased strategies was optimal for a trader with very low transactions costs. However, because these strategies involve frequent trades, fairly modest costs eliminate the gains. These findings are difficult to reconcile with fully rational price …

Seven Principles Of Effective Teaching: A Practical Lens For Evaluating Online Courses, Charles R. Graham, Kursat Cagiltay, Byung-Ro Lim, Joni Craner, Thomas M. Duffy Jan 2001

Seven Principles Of Effective Teaching: A Practical Lens For Evaluating Online Courses, Charles R. Graham, Kursat Cagiltay, Byung-Ro Lim, Joni Craner, Thomas M. Duffy

Faculty Publications

The "Seven Principles for Good Practice in Undergraduate Education," originally published in the AAHE Bulletin (Chickering & Gamson, 1987), are a popular framework for evaluating teaching in traditional, face-to-face courses. The principles are based on 50 years of higher education research (Chickering & Reisser, 1993). A faculty inventory (Johnson Foundation, "Faculty," 1989) and an institutional inventory (Johnson Foundation, "Institutional," 1989) based on these principles have helped faculty members and higher-education institutions examine and improve their teaching practices.

We, a team of five evaluators from Indiana University's Center for Research on Learning and Technology (CRLT), recently used these principles to evaluate …

Information And Communication Technology And Poverty: An Asian Perspective, M. G. Quibria, Feichin, Ted Tschang Jan 2001

Information And Communication Technology And Poverty: An Asian Perspective, M. G. Quibria, Feichin, Ted Tschang

Research Collection Lee Kong Chian School Of Business

Many commentators have extolled the virtues of new information and communication technologies (ICTs) in reducing poverty and improving the quality of life. While such arguments have been used before in relation to many predecessor technologies, including other earlier communications technologies, the promise has often floundered. This paper attempts to provide a more balanced analysis of the question, by exploring the linkages between the new ICTs and poverty reduction. It examines the linkages in two ways: the potential for direct impacts of ICTs on various areas of poverty and development, and the indirect impacts of ICTs on economic growth, exports and …

A Study Of Attitudes And Beliefs Of Teachers And Site Council Members Toward Parental Involvement Within The Framework Of Four Models Of Home-School Relations, Beverly Ann Smith

Dissertations and Theses @ UNI

The purpose of this study was to examine the attitudes and beliefs of faculty and site council members toward the type of parental involvement model desired in their schools and to assess whether or not a consistent opinion of parental involvement existed between the two school role groups. This study investigated the prevalence of four models of home-school relationships developed by Swap (1993). The four models are the Curriculum Enrichment Model, the Partnership Model, the Protective Model and the School to Home Transmission Model. Participants of the study consisted of faculty and site council members from five selected schools in …

An Investigation To Measure The Performance Of Commercial Printing Firms For Conducting Business-To-Customer Activities On The Web, Devang Pranlal Mehta Jan 2001

An Investigation To Measure The Performance Of Commercial Printing Firms For Conducting Business-To-Customer Activities On The Web, Devang Pranlal Mehta

Dissertations and Theses @ UNI

This research was conducted to investigate the current status of commercial printing firms regarding the success of their performance using Web technology for conducting business-to-customer (B2C) activities. It was primarily based on Rogers' innovation theory and Auger's empirical study. The impact of the Web technology on the organizational performance was studied. The organizational performance was divided into three levels: financial performance (FP), non-financial performance (NFP), and overall performance (OP). The financial performance was measured by four financial indicators; whereas, the non-financial performance was measured by three non-financial indicators. The overall performance was then measured by adding the four financial performance …

An Analysis Of A Radio Frequency Sensor As A Means To Remotely Sense Selected Surface Topographies In An Agriculture Environment, Barry Michael Alexia

Dissertations and Theses @ UNI

Remote sensing is the science and art of obtaining information about an object, area or phenomenon through the analysis of data acquired by a device that is not in contact with the object, area, or phenomenon under investigation. The remotely sensed data can be of many forms, including variations in force distribution, acoustic wave distribution, or electromagnetic energy distribution.Information thus acquired can be used for observing, monitoring, and studying planetary surfaces and environments.

Because there are many ways to acquire data about targets of interest, there are many types of remote sensors that can be used, including visible, infrared, and active …

An Investigation Of Cooperative Consciousness-Raising As An Innovative Teaching Practice, And Of Reactions To Its Introduction Into A High School, Sahoby Solo Raharinirina

Dissertations and Theses @ UNI

The language pedagogy literature stresses the importance of the quality of second/foreign language teaching/learning in learners' acquisition, development of communicative competence, or both. The change literature equally emphasizes the importance of the quality of innovation in change audience’s resolution to reconceptualize current practices and espouse the new practice being advocated. Both literatures underline the need to use multiple research strategies in order to depict the product and process of learning and/or shifting experiences. To contribute to the educational literature in these areas, the present research incorporated two different but interrelated studies.

Study One utilized both between- and within-method approaches (Denzin, …

Is International Bankruptcy Possible?, Frederick Tung Jan 2001

Is International Bankruptcy Possible?, Frederick Tung

Faculty Scholarship

Although international business firms proliferate, there is no international bankruptcy system. Instead, bankruptcy law remains a matter for individual states. The failure of a multinational firm therefore raises difficult questions of conflict and cooperation among national bankruptcy laws. In the discourse over the appropriate design for an international bankruptcy system, universalism has long held sway as the dominant idea, embraced nearly universally by bankruptcy scholars. Universalism offers a simple and elegant blueprint for international bankruptcy. Under universalism, the bankruptcy regime of the debtor firm's home country would govern worldwide, enjoying global reach to treat all of the debtor's assets and …

The Delaware Business Trust Act Failure As The New Corporate Law, Tamar Frankel Jan 2001

The Delaware Business Trust Act Failure As The New Corporate Law, Tamar Frankel

Faculty Scholarship

The Internet transcends boundaries and time, reduces and shifts the cost of receiving and disseminating information. It poses unusual pressures of change on the common law. Internet jurisprudence demonstrates the vitality of the common law, yet highlighted its limitations. The Article describes how the common law addresses Internet issues and the relationship of judicial cases and congressional actions. The Article praises common law system of "muddling through," evolving piecemeal, addressing particular conflicts, not always uniformly nor predictably. This is lawmaking for the risk-averse, reducing the risk and cost of correcting big mistakes. The price: higher learning costs and fewer clear, …

Arbitration And The Fisc: Nafta's "Tax Veto", William W. Park Jan 2001

Arbitration And The Fisc: Nafta's "Tax Veto", William W. Park

Faculty Scholarship

Taxes, said Franklin Roosevelt, "are the dues that we pay for the privileges of membership in an organized society." Harsher tongues describe tax as a form of property seizure. Somewhere between these competing characterizations of revenue raising-club dues and forced takings-lies a clue to why the North American Free Trade Agreement ("NAFTA") reserves special treatment for investment disputes implicating fiscal matters. NAFTA gives foreign investors a right to settle investment disputes by arbitration, a process more politically and procedurally neutral than either host state courts or foreign gunboats. Without the option to arbitrate, the specter of unfair expropriation might chill …
