Clearly Canadian--Hill V. Colorado And Free Speech Balancing In The United States And Canada, Donald L. Beschle Jan 2001

Clearly Canadian--Hill V. Colorado And Free Speech Balancing In The United States And Canada, Donald L. Beschle

UC Law Constitutional Quarterly

Two doctrines have equally influenced and informed the debate regrading the scope of the First Amendment free speech guarantee: absolutism versus the balancing of competing interests. Despite the language of the United States Constitution that suggests the application of absolutes, the courts have often resorted to balancing in the resolution of cases. This Article examines the debate by comparing the different approaches taken by the courts in the United States and Canada. This examination reveals that perhaps the two doctrines do not need to negate each other in their application, and that a recent decision by the United States Supreme …

The Blackwell Summer Arts Program: An Experience In Community Revitalization, Marjorie Cohee Manifold Jan 2001

The Blackwell Summer Arts Program: An Experience In Community Revitalization, Marjorie Cohee Manifold

Journal of Social Theory in Art Education

Like many American cities, Richmond, Virginia is pockmarked by once middle-class neighborhoods that have fallen into decline and are now blighted by decayed and abandoned buildings. Among the more severely depressed areas of Richmond is the historic Blackwell district. Decades ago, in an effort to provide homes for the poorest of Richmond’s citizens, row after row of nondescript, multi-family, brick-faced, public housing units or “projects” were erected in Blackwell. By the end of the 20th century, their boarded windows, crumbling infrastructures, and graffiti covered facades were sad but eloquent monuments to inefficacious governmental policies and the unrelenting poverty and despair …

Taking Globalization Seriously: Towards General Jurisprudence (Book Review Of Globalization And Legal Theory By William Twining), Doron M. Kalir Jan 2001

Taking Globalization Seriously: Towards General Jurisprudence (Book Review Of Globalization And Legal Theory By William Twining), Doron M. Kalir

Law Faculty Articles and Essays

Part II provides an account of the jurisprudence of Globalization and Legal Theory. Due to the novelty of many of the issues discussed in the book, as well as their importance to the understanding of Twining's recommendations, I have provided a longer than usual account of several chapters. Part II touches upon one of the central jurisprudential dichotomies introduced by Twining—the distinction between general and particular jurisprudence. Twining compares different accounts of the distinction using pairs of canonical jurists. In particular, he compares H.L.A Hart's Postscript with Dworkin's Law's Empire. In this part, I juxtapose Twining's record of this …

Russia's Other "Mormons": Their Origins And Relationship To The Church Of Jesus Christ Of Latter-Day Saints, Eric A. Eliason, Gary Browning Jan 2001

Russia's Other "Mormons": Their Origins And Relationship To The Church Of Jesus Christ Of Latter-Day Saints, Eric A. Eliason, Gary Browning

BYU Studies

When Mormon missionaries entered Russia in 1990, they were astonished to hear about "Mormon" settlements already existing in the Samara region. Other evidence of Mormonism appeared: for example, locals used the term "Mormon crosses" to describe a unique style of crucifixes in cemeteries. In this article, the authors delve into the questions of whether or not sects with ties to mainstream Mormonism existed in pre-perestroika Russia or if unrelated groups earned the nickname "Mormon" for living in unusual family arrangements, similar to polygamy. Using data gathered from Latter-day Saint missionaries who served in Russia in the late 1990s as a …

Voice Lessons, Melissa Helquist Jan 2001

Voice Lessons, Melissa Helquist

BYU Studies

In this contest-winning personal essay, the author describes the challenge of undergoing treatment for thyroid cancer and coping with lasting scars, including an extra "smile" on her throat where an incision was made and a voice that functions only some of the time. She writes, "I smell the rainwater as it moves around the tires, the earthiness of smashed worms, and everything cold and soulful. The day says something to me, and I wish I could say something back." Using compelling imagery, she conveys what it's like to express herself through the calculated means of writing and playing the viola …
