Constitutional Formalism And The Meaning Of Apprendi V. New Jersey, Benjamin Priester
Constitutional Formalism And The Meaning Of Apprendi V. New Jersey, Benjamin Priester
Journal Publications
In June 2000, the United States Supreme Court decided Apprendi v. New Jersey,' a case that likely will have a significant impact on the administration of criminal justice in federal and state courts. The Court imposed a procedural limitation on prosecutors by restricting the types of facts that may be proven at sentencing rather than at trial. Specifically, the Court adopted a constitutional principle that "any fact that increases the penalty for a crime beyond the prescribed statutory maximum" is an element of the offense of conviction. Under wellestablished constitutional doctrine, the Constitution's full procedural protections, especially the necessity of …

"There's No Crying In Baseball": Sports And The Legal And Social Construction Of Gender, Rhonda Reaves
Journal Publications
This Article analyzes the view that to be taken seriously as an athlete, women must replicate the behaviors prevalent in male-dominated sports. The Article focuses on sports in the educational context as an important opportunity for legal intervention. Because the law involves the allocation of resources and the policing of behavior by the government, this discussion prompts us to ask how resources should be allocated and what kinds of behavior should be encouraged and discouraged in promoting gender equity. In particular, the analysis of sports within educational programs offers an opportunity for a critical examination of current models of athletic …
"Hair Drama" On The Cover Of "Vibe" Magazine, Bertram D. Ashe
"Hair Drama" On The Cover Of "Vibe" Magazine, Bertram D. Ashe
English Faculty Publications
This study consists of a cultural reading of the cover photograph of the June-July 1999 issue of Vibe magazine. It explores the relationship between Mase, an African-American male rap star, and the three anonymous African-American female models that surround him. The study interprets the cover through the long, straightened hair of the models, locating the models' hair in a historically-informed context of black hair theory and practice. The study argues that the models' presence on the cover, particularly their "bone straight and long" hair, "enhances" Mase in much the same way breast-augmented "trophy women" "enhance" their mates. Ultimately, the study …
A Little Adam Smith Is A Dangerous Thing, Jonathan B. Wight
A Little Adam Smith Is A Dangerous Thing, Jonathan B. Wight
Economics Faculty Publications
Adam Smith was trying to counter medieval church theology, which held that any self-interested behavior was sinful and detrimental. Smith countered that self-interest could yield valuable outcomes for society as people pursued specialization and market trade. Much later these quotes would be used to justify the greedy and grasping personae of homo economicus, illustrating how a little Adam Smith can prove to be a dangerous thing. For example, Max Lerner in 1937 would say that Adam Smith "sanctified predatory impulses" and "gave a new dignity to greed." By the 1980s the movie Wall Street has the financial tycoon Gordon …

A Midsummer Night's Dream For Middle School, Diana Nash
A Midsummer Night's Dream For Middle School, Diana Nash
Theses
William Shakespeare wrote plays for the masses -- the aristocrats as well as the common people. While his dramas, tragedies, and comedies were controversial, sometimes bawdy, and always physical, in the twentieth century, secondary school educators have come to think of Shakespeare's plays as literature for academic study. Middle schools rarely cover any Shakespearean plays in the classroom. Students traditionally start to study Shakespearean scripts in high school. In high school, freshman usually read Romeo and Juliet; sophomores read Julius Caesar, Macbeth, or Hamlet. Most secondary curriculums do not include a Shakespearean comedy.
While it is true that occasionally a …

A Chorological Study On The Taxa Naturalized In The Eastern Black Sea Region, Sali̇h Terzi̇oğlu, Rahi̇m Anşi̇n
Turkish Journal of Agriculture and Forestry
Diaspores of taxa with large ecological tolerance can be easily carried between continents and some of these taxa become an important factor, threatening the maintenance of plant species diversity, in addition to other factors, such as clear-cutting, over-grazing and dwellings. Chorological study is an important step for conserving plant species diversity, and it provides information about naturalized plant taxa that have migrated from one continent to others. Presenting the floristic relationships between the continents is important for plant geography and paleobotany. The chorological features of 32 taxa of flowering plants belonging to 14 families, naturalized in the Eastern Black Sea …

Six Different Models For Estimation Of Genetic Parameters And Breeding Values For Pre-Weaning And Post-Weaning Weights In Suckler Cattle, Zafer Ulutaş, Ioan Ap Dewi, Mustafa Saatci
Turkish Journal of Veterinary & Animal Sciences
Estimates of (co)variance components and breeding values for pre-weaning (100-day) and post-weaning (300-day) weights were obtained for a commercial herd of Welsh Black cattle recorded from 1976 to 1996. Estimates were obtained from six animal models ranging from a model with only an additive direct effect to a model that also included an additive maternal effect, a maternal permanent environmental effect and a covariance between additive direct and additive maternal effects. The most appropriate model for 100-day weight, based on a likelihood ratio test, was a model with additive direct and additive maternal effects with no covariance between them, yielding …
