This dissertation examines the sustainability of the use of oxen by the Maasai and Arusha (WaArusha) people, in Monduli District, Tanzania. Traditionally pastoralists, the Maasai are undergoing a social and agricultural transformation process of sedentarization in this region. The villages included in the case study were Arkatan, Engaruka, Esilalei, Lashaine, Lendikenya, Lolkisale, Losirwa, Mbuyuni, Mswakini, and Selela. Using semi-structured interviews the heads of 130 Maasai homesteads (bomas), as well as, other informants were interviewed. In the opening years of the 19th century, Native and European Americans struggled for lands throughout the area that we now refer to as the Midwest part of the United States. Among the leaders of the Indians who resisted European intrusion into their territories were the legendary Tecumseh and his brother Tenskwatawa, the Shawnee Prophet. Much has been written about these two significant figures in American history (Sugden 1985), but other leaders also emerged during this time that have not been well researched. Oxidative stress generated by aerobic metabolism or from environmental sources is a major cause of damage to organisms. Aluminum is a major toxin in acidic soils and one proposed source of oxidative stress. The enzyme glutaredoxin utilizes a disulfide oxidation-reduction mechanism to detoxify free radicals and is one way organisms have evolved to handle oxidative stress. We have recently isolated a novel glutaredoxin cDNA from soybean; sequence analysis indicates that it is highly similar to other plant glutaredoxin. We grew soybean seedlings in soils containing 0, 20, and 50 mM AlCl3 to examine the effect of high levels of Al …

Although aquaporin 5 (AQP5) is the major water channel expressed in alveolar type I cells in the lung, its actual role in the lung is a matter of considerable speculation. By using immunohistochemical staining, we show that AQP5 expression in mouse lung is not restricted to type I cells, but is also detected in alveolar type II cells, and in tracheal and bronchial epithelium. Aqp5 knockout (Aqp5−/−) mice were used to analyze AQP5 function in pulmonary physiology. Compared with Aqp5+/+ mice, Aqp5−/− mice show a significantly increased concentration-dependent bronchoconstriction to intravenously administered Ach, as shown by …

Historically, Texas plaintiffs enjoyed tremendous flexibility in gaining certification for class action lawsuits because of a liberal approach employed by Texas trial courts. Because certification assignment occurred early in the judicial proceedings, Texas case law encouraged trial courts to grant certification of a class. Putative classes chose to seek relief in state court because of the state’s lax view regarding class actions, particularly when compared to federal courts. Concerns arose throughout Texas about the growing liberal methodology courts used to evaluate putative classes during certification. “Good governance” has increasingly become political-economic common sense — often articulated in the call for transparency and accountability. But the question is: transparency and accountability to whom and toward what end? This essay examines the normalization of “good governance,” particularly as it is expressed as a financial discourse of corporate governance that gives primacy to the maximization of “shareholder value” and the promotion of “investor confidence” in the capital markets. I argue that this global discourse privileges institutional investors who are empowered to hold all stakeholders accountable to market expectations and valuations. Congress increasingly has enacted cooperative federalism programs to achieve complex regulatory policy objectives. Such programs combine the authority of federal regulators, state regulators, and federal courts in creative and often pathmarking ways, but the failure of these actors to appreciate fully their respective roles threatens to undermine cooperative federalism's effectiveness. In this Article, Professor Philip Weiser develops a coherent vision of how federal courts should enforce cooperative federalism regulatory programs. In particular, he relates the rise and purpose of cooperative federalism to the federal courts' increased reluctance to make federal common law under the Erie doctrine and their greater deference …

Volume 30 of the Hofstra Law Review is dedicated to members of the Hofstra community, including four graduates of the Law School, who were violently taken from us during the past year. Of the four Law School graduates, Joni Cesta '91, Neil D. Levin '81, and Glenn J. Winuk '87 were lost in the September 1 1th terrorist attacks on the World Trade Center. Thomas Crane Wales '79 was murdered in Seattle, Washington on October 11, 2001. The Hofstra Law Review presents the following biographical sketches to honor the memory of these four distinguished alumni.

Systems thinking is a way of thinking that focuses on the relationships between the parts forming a purposeful whole. System dynamics is concerned with building computer models of complex problem situations and then experimenting with and studying the behaviour of these models over time. This paper is a review of systems thinking that considers its unique history and influences, paradigms and methodologies, and presents a case for the system dynamics methodology as the best tool for the most diverse range of problem situations

B-Nodes: A New Scalable High Level Abstraction Model, Stanislaw P. Maj, Craig William Caulfield

This paper proposes a new modeling technique called B-Nodes. B-Nodes represent a new, high-level abstraction that allows technical detail to be controlled using top-down recursive decomposition. This abstraction. is independent of architectural detail and can therefore accommodate rapid changes in technology. The use of recursive decomposition allows B-Nodes to be used not only for entire e-commerce system but also sub-modules within this system. The use of fundamental units allows the performance of heterogeneous technologies to be compared and other units to be derived. Results to date indicate no comparable model exists. This paper discusses the major issues confronting the successful adoption and sustained use of online learning in higher education within the Australian context. The paper argues that four main issues which universities must deal with to achieve maximum potential from online learning technologies are: the establishment of cost-effective practices; the achievement and maintenance of quality in online learning delivery; ensuring access and equity in the delivery of programs; and establishing practices which can enable online learning to be sustained and to grow as a mainstream activity in university teaching and learning. The nature and scope of this thesis relates to obtaining an understanding of the way in which sheet metal forming processes affect the residual stresses (plastic deformation) and the fatigue perfomiance of wheel centre discs made of a dual phase steel. Automotive wheels are mainly manufactured from sheet metal plate by forming processes using tools and dies. This manufacturing process is directly concemed with deforming the plate under predominantly applied tensile forces where the component acquires a sfress state which is multi-axiial. Disruptive Behavior Disorders (DBDs) consist of four categories of syndromes known as Attention Deficit Hyperactivity Disorder (ADHD), Oppositional Defiant Disorder (ODD), Conduct Disorder (CD), and DBD Not Otherwise Specified (NOS). They are the most prevalent disorders in children and adolescents and the most common reason for referral to residential treatment centers (RTC). However, little research exists concerning RTCs efficacy in treating disruptive behavior. The following study attempted to take a comprehensive approach in that it evaluated the effectiveness of an RTC, including the specific treatments that contributed to a positive outcome. Environmental theology is a term used often by religious communities describing theological doctrines concerning the relationship of deity and ethical conduct to the environment. After an extensive literature search, an operational or declarative definition for environmental theology was not discovered. The objectives of this study were to establish an explicit and scholarly definition of environmental theology and introduce deoview as a descriptor associated with the term. People have and will continue to act according to their belief systems: this paper has value in understanding beliefs, ethics, and behavior of people and people groups.

A broad research literature base on the instructional effectiveness of intensive-format courses often finds the intensive courses equal or superior to semester-length versions, but many of the studies from which those conclusions are drawn were theoretically or methodologically flawed. This examination of student characteristics and instructional effectiveness in one matched pair of educational psychology classes found that students in the intensive version of the course performed significantly better than students in the semester-length course on posttests of content and questions tapping higher-order learning. Inhalation of residual oil fly ash (ROFA) has been shown to increase pulmonary morbidity in exposed workers. We examined the role of reactive oxygen species (ROS) in ROFA-Induced lung injury. ROFA (ROFA-Total) was suspended in saline, incubated, centrifuged, and separated into soluble (ROFA-Soluble) and insoluble (ROFA-Insoluble) fractions. The generation of ROS from ROFA samples was measured by electron spin resonance (ESR). Sprague-Dawley rats were intratracheally instilled with saline, ROFATotal, ROFA-Soluble, and ROFA-Insoluble (1 mg/ 100 g body wt). Lung tissue and bronchoalveolar lavage cells were harvested at 4, 24, and 72 hours after instillation. Chemiluminescence, lipid peroxidation, and biochemical parameters …

The linearized dispersion relation describing waves in a plasma having a uniform magnetic field, uniform density, and inhomogeous parallel (to the magnetic field) flow [G. Ganguli, M.J. Keskinen, H. Romero, R. Heelis, T. Moore, and C. Pollock, J. Geophys. Res., 99, 8873 (1994)] is generalized to include thermal anisotropy, a key feature existing in many space and laboratory plasmas. It is popularly assumed that the public is highly punitive toward criminal offenders and that its reasoning about criminal offences is emotionally and morally based. This assumption has been challenged by social scientists who cite influences of news media and methodological flaws in empirical studies as contributing causes. Public sentiment is a basis for law and the increasing responsiveness of legislator to what is perceived to be public opinion on crime means that accurate information on enduring principles in the public's intuitive reasoning about criminal justice is vital.
