Two doctrines have equally influenced and informed the debate regrading the scope of the First Amendment free speech guarantee: absolutism versus the balancing of competing interests. Despite the language of the United States Constitution that suggests the application of absolutes, the courts have often resorted to balancing in the resolution of cases. This Article examines the debate by comparing the different approaches taken by the courts in the United States and Canada. This examination reveals that perhaps the two doctrines do not need to negate each other in their application, and that a recent decision by the United States Supreme …

Où allons-nous? painted towards the closing of the 19th century when colonialist expansion and Imperialism were at their heights, seems to be an appropriate allusion as this year's 21st Social Caucus journal inaugurates the beginning of a new millennium. The irony of the title should be apparent, as should the fortuitousness of the volume's number. The epic proportions of the questions (and the painting) compressed into the bit size of an editorial seems laughable. Evaluating the in vivo accuracy of magnetic resonance phase velocity mapping (PVM) is not straightforward because of the absence of a validated clinical flow quantification technique. The aim of this study was to evaluate PVM by investigating its precision, both in vitro and in vivo, in a 1.5 Tesla scanner. In the former case, steady and pulsatile flow experiments were conducted using an aortic model under a variety of flow conditions (steady: 0.1–5.5 L/min; pulsatile: 10–75 mL/cycle). In the latter case, PVM measurements were taken in the ascending aorta of ten subjects, seven of which had aortic regurgitation. Each velocity …

Poet Edward L. Hart wrote the lyrics to one of Mormonism's favorite hymns, "Our Savior's Love." “Haven’T We Come To Kill The Spaniards?” The Tule Upheaval In Eastern Panama, 1727-1728, Ignacio Gallup-Diaz

Investigates a Tule Indian uprising that took place in eastern Panama in 1727. The Indians' motivations for this uprising were varied and complicated and not simply the result of the instigations of mestizo pirate Luis García (as was alleged by the governor of Darién and historians, who have read his account of the events). The violence that spread across the isthmus was caused by the instability inherent in the Spanish colonial policy of tribalization. This policy relied on the Spanish authorities' co-opting men who claimed to be tribal leaders. These leaders, however, were unable to contain the Indians once they …

This Article asserts that the privilege to deliver a last dying speech— uttered in the presence of, and made audible to, the assembled witnesses in the moments just before one's execution—is a First Amendment right, and that prison policies departing from its traditional exercise are unconstitutional. After canvassing the state prison policies that govern last words, this Article will recount the long historical tradition surrounding their utterance—a history that reveals the extraordinary degree to which Anglo-American governments have honored the privilege.Next, this Article will draw a parallel between the right to utter one's last words and the well-established right of …

This analysis highlights the importance of transactions between prior and subsequent innovators to permit valuable research to go forward across the boundaries of prior patent claims. In a recent article focusing on biomedical research,4 Michael Heller and I argue that too many patent rights on 'upstream' discoveries can stifle 'downstream' research and product development by increasing transaction costs and magnifying the risk of bargaining failures. The effects of the high-probability instructional sequence, with and without extinction, on increasing compliance to eat in three children with severe food refusal and selectivity were evaluated. Pediatric feeding disorders, in which children refuse most or all food and drink, are a rare and life threatening problem that requires intensive treatment. The majority of behavioral techniques used with feeding disordered children manipulate the consequence of food refusal. The use of antecedent procedures in the treatment of food refusal has been limited. This project takes place at Forks Middle School in Forks, Washington. Attention was placed on providing strategies for managing technology in the classroom. The purpose of this project was to determine whether repeated reading with an audio model would significantly supplement the literacy instruction of atrisk readers. Research related to reading practice, the relationship between fluency and reading development, and repeated reading was read, evaluated, and summarized. A positive relationship between repeated reading and reading growth (i.e., fluency and comprehension) was indicated from this review. The literature review provided a rational and guidelines for using repeated reading with at-risk readers. A manual containing a teacher's guide on repeated reading with an audio model and related literacy activities was created.

Hydrotaea aenescens (Wiedemann), the black dump fly, is a potential biological control agent originally from the western hemisphere, now found in many parts of the Palearctic region except for the United Kingdom, where it cannot be imported for any reason. A complication of classical biological control is the problem of strain identification, as one must be able to somehow mark or follow a particular strain that has been introduced into the field or is contemplated for release. Gas chromatographic analysis of the surface hydrocarbons of pooled and individual dump fly adults resulted in reproducible hydrocarbon patterns that differentiated widely distributed …

The presence of neural tissue and smooth muscle elements in the vicinity of the oviductal sperm storage tubules at the uterovaginal junction was assessed by several modes of light microscopy. Isolated neurones and small ganglia were identified in the uterovaginal junction of the turkey oviduct. The nerve cell bodies were observed in the tunica mucosa by bright field microscopy. Immunoreactivity against neurofilament antibody and recombinant fragment C of the tetanus toxin reacted with nerve fibres and the nuclei of neurones. Fluorescence microscopy and confocal laser scanning microscopy revealed that nerve fibres continued from the base of the tunica mucosa into …

The enzyme polyphenol oxidase (PPO) has been implicated in discoloration of Asian noodles. The recombinant inbred line (RIL) populations, M6/‘Opata 85’, NY18/CC, and ND2603/‘Butte 86’ were used to investigate the distribution, chromosome location, and number of loci involved in wheat (Triticum aestivum L.) PPO. PPO activity was measured by means of the substrates L-DOPA (L-3,4-dihydroxyphenyl-alanine) and L-tyrosine. The M6/Opata 85 RIL population had a normal distribution, while the ND2603/Butte 86 RIL population had a bimodal distribution for PPO activity (L-DOPA assay).
