CAN THE TORTOISE STILL BEAT THE HARE? Can the tortoise even enter the race with its fabled competitor? Unfortunately, the desert tortoise is threatened with extinction and, consequently, most United States populations of this biological wonder are listed under the federal Endangered Species Act (ESA or Act) as a result of rampant habitat loss and other human causes. As desert tortoise numbers have declined, the species has also suffered from disease and predation.

Lying, Misleading, And Falsely Denying: How Moral Concepts Inform The Law Of Perjury, Fraud, And False Statements, Stuart P. Green

UC Law Journal

This Article seeks to describe the relationship between the criminal law and various concepts of deception. Deception is defined as the communication of a message that is intended to cause a person to believe something untrue. Three different kinds of deception are identified: (1) lying (deception that involves an assertion and is literally false); (2) non-lying deception, or mere "misleading" (deception that requires neither an assertion nor literal falsity); and (3) falsely denying (deception that occurs in the context of a person's denying some accusation of alleged wrongdoing). The Regulation Of Manganese Superoxide Dismutase And Inducible Nitric Oxide Synthase By Nuclear Factor-Kappa B And Activator Protein 1 In Rat Aortic Endothelial Cells, Scott L. Cobbs

Inducible nitric oxide synthase (iNOS) and manganese superoxide dismutase (MnSOD) are two enzymes that influence reactive oxygen species within the cell. The promoter regions for the genes encoding these enzymes have two specific transcription factor elements in common, activator protein 1 (AP-1) and nuclear factor kappa b (NF-KB). This study was initiated to determine if either NF-KB or AP-1 regulates the transcription of both genes in endothelial cells. To test whether NF-KB or AP-1 binding sites in the MnSOD and iNOS promoter region were important for transcriptional regulation, we performed induction analysis using various deletion constructs of MnSOD and iNOS …

Individual Differences And The Effects Of Time Of Day And Interference On Memory, Keelon L. Hinton

Using the Wickens, Born, Allen (1963) release from proactive interference paradigm, subjects were tested at both a morning and afternoon period in hopes of observing the effects time of day, age, and interference have on working memory. 42 college students and 21 participants over the age of 65 first completed the Horne-Ostberg (1976) questionnaire for morningness-eveningness. While most younger adults were evening and neutral types, the vast majority of older individuals showed a stronger preference for earlier hours of the day. Recall results indicated that recall performance of older participants decreased from morning to afternoon, while recall performance of younger …

Wrestling With Religion: Pullman, Pratchett, And The Uses Of Story, Elisabeth Rose Gruner

While children's and young adult fantasy literature is often concerned with "first things," with the struggle between good and evil, or with the fate of the cosmos, still it is rarely overtly religious in the sense of direct engagement with "faith, religion and church(es)" (Ghesquiere 307). Perhaps it is children's literature's vexed relationship with didacticism that keeps fantasy writers for children from engaging directly with religious language and concepts, or perhaps it is the setting in an alternate world that enables allegorizing impulse rather than direct engagement.
