The Personal Information Protection And Electronic Documents Act: A Lost Opportunity To Democratize Canada's "Technological Society", Tina Piper

Bill C-6, more recently known as the Personal Information Protection and Electronic Documents Act, is promoted by the Canadian government as privacy legislation to protect Canadians' personal information. This paper explores that characterization and concludes that it is inaccurate and misleading. The problems that motivated a response by Parliament are the proliferation and commercial importance of personal information, concerns Canadians have about its uncontrolled use by the private sector and the inadequacy of existing law to address those concerns. The Best Things In Law Are Free?: Towards Quality Free Public Access To Primary Legal Materials In Canada, Teresa Scassa

In this article the author explores the move in several jurisdictions towards providing primary legal materials online without charge. In Canada the federal government, most provincial governments and many courts currently provide some form of online access to primary legal materials. However, this is not done in a unified, comprehensive or systematic manner. The author evaluates the "legal information institute" model as it has emerged in Australia, the United Kingdom and the United States, and considers whether such a model would be useful or workable in Canada. Debtor In Possession Financing: The Jursidiction Of Canadian Courts To Grant Superpriority Financing In Ccaa Applications, Janis Sarra

Restructuring of insolvent corporations can be an effective means of a voiding the social and economic consequences of firm failure. Key to successful restructuring is financing (called DIP financing) in the interim period during which the corporation is attempting to develop a viable business plan that is acceptable to stakeholders. Canadian courts have exercised their inherent jurisdiction to grantsuch financing. A recent case before the Supreme Court of Canada settled. However, there continue to be challenges to the courts'jurisdiction. Property Ownership By Married Women In Victorian Ontario, Susan Ingram, Kris Inwood

Dalhousie Law Journal

This paper reports patterns of property holding by women and men in late nineteenth-century Ontario. We focus on the town of Guelph immediately before and after legislation in 1872 and 1884 which permitted married women to hold property in their own name. The female-held share of all property and the female share of all owners in the town increased sharply. The gains were made by married women, and even more strongly by single women and widows. However, there was little or no shift of property in nearby rural townships. We argue that an induced change in inheritance practice amplified the …

Shame In Adolescence: A Pilot-Study Utilizing The Thurston-Cradock Test, Renee K.P. Botero

This study was designed to contribute evidence for the validity of Thurston-Cradock Test (of Shame) and to contribute to the growing set of empirical studies relating to shame dynamics in adolescence. The Thurston-Cradock Test is a newly published projective instrument for assessing shame dynamics. Its use had previously been limited to adult populations. Subjects were research volunteers at adjudicated and a non-adjudicated private high schools ranging in age from 14-18 years. The adjudicated group included 31 subjects, 15 male and 16 female, while the private school group included 21 subjects, 11 male and 10 female. A comparison of means using …

Jewish Stars In Texas: Rabbis And Their Work By Hollace Ava Weiner (Review), Harriett Denise Joseph

In Jewish Stars in Texas, Hollace Ava Weiner uses a bibliographical approach to examine a century of "Texas history through the eyes of its rabbis" (p. xiv). She profiles eleven Jewish religious leaders who made an impact that extended far beyond their congregations. Chronologically they range from Heinrich Schwarz, Texas's first ordained rabbi (arriving in Hempstead in 1873), to civil rights activist Rabii Levi Olan, who served Dallas's Temple Emanu-El from 1949 to 1970. Employers' Perceptions Of Welfare Reform: Implications For Cooperative Extension Personnel, Bernice B. Wilson, Daisy L. Stewart

Journal of Extension

Federal legislation passed in 1996 mandated that each state establish welfare-to-work programs and required that recipients work or lose benefits after 2 years and a life-time limit of 5 years. This article discusses the perceptions of selected employers who were interviewed regarding factors contributing to their participation in welfare reform and affecting welfare recipients' entry into the workforce. Conclusions from the interview data related to willingness of employers to hire welfare recipients and to the importance of providing support for new employees, fostering cooperation among employers and agencies to provide education and training, examining welfare policies, and providing affordable child …
