Congress Arrogance, Yale Kamisar Oct 2000

Congress Arrogance, Yale Kamisar

Law Quadrangle (formerly Law Quad Notes)

Does Dickerson v. U.S., reaffirming Miranda and striking down § 3501 (the federal statute purporting to "overrule" Miranda), demonstrate judicial arrogance? Or does the legislative history of § 3501 demonstate the arrogance of Congress?

Shortly after Dickerson v. U.S. reaffirmed Miranda and invalidated § 3501, a number of Supreme Court watchers criticized the Court of its "judicial arrogance: in peremptorily rejecting Congress' test for the admissibility of confessions. The test, pointed out the critics, had been adopted by Congress after extensive hearings and debate about Miranda's adverse impact on law enforcement.

The Dickerson Court did not discuss the legislative history …

China Rising: New Challenges To The U.S. Security Posture, Jason D. Ellis, Todd M. Koca Oct 2000

China Rising: New Challenges To The U.S. Security Posture, Jason D. Ellis, Todd M. Koca

Strategic Forums

This Strategic Forum explores how China’s growing military capabilities and strategic ambitions are reshaping U.S. defense planning. It points to China’s expanding defense budget, modernization of its forces, and increasing missile capabilities as key factors driving concern in Washington. The paper also highlights persistent uncertainty surrounding China’s intentions, including limited transparency, tensions over Taiwan, and concerns about proliferation and espionage. These dynamics make it difficult for U.S. policymakers to assess future risks and plan effectively. It also emphasizes that China’s rise presents long-term strategic challenges, requiring the United States to adapt its security posture, maintain deterrence, and prepare for a …

A Historian In Cyberspace, Edward L. Ayers

History Faculty Publications

I am writing here about an American Place, but not about Thomas Jefferson's town, where I live, or about the South, to which I have devoted my working life. Rather, I am writing about that new American place we cannot see but whose effects we increasingly feel, cyberspace.

The Great Valley And The Meaning Of The Civil War, Edward L. Ayers Oct 2000

The Great Valley And The Meaning Of The Civil War, Edward L. Ayers

History Faculty Publications

To understand the coming of the Civil War, then, we need to pick up the story before Fort Sumter and to carry it deeper than national events. We need to understand both the advocated of conflict and those who sought to avoid it regardless of the cost. We need to understand the communities people fought to defend, the institutions that held them together and that drove them apart.

Independence And The Director Of Public Prosecutions: The Marshall Inquiry And Beyond, Philip C. Stenning Oct 2000

Independence And The Director Of Public Prosecutions: The Marshall Inquiry And Beyond, Philip C. Stenning

Dalhousie Law Journal

The author describes the reforms to the prosecution system in Nova Scotia which were recommended by the Marshall Inquiry in its 1989 report, and reviews the extent to which they have been effectively implemented during the ensuing decade. He concludes that many of the objectives originally identified by the Marshall Inquiry in this respect have been substantially met, but that in some areas there is still room for improvement. Finally, he notes the absence of systematic evaluations of prosecutorial institutions and practices in Canadian jurisdictions, and that because of this, it is difficult to say whether the Marshall Inquiry's objectives …

The full name behind the acronym was “The Nordic Cooperative Council for Research Libraries and Scientific Information and Documentation.”

When looking at the history of Nordic research library cooperation, it is clear that the members of the committee that suggested the establishment of an institution that would combine librarianship, documentation and information were people that understood what developments were …

The Americans With Disabilities Act And Academic Libraries In The Southeastern United States, Linda Lou Wiler, Eleanor Lomax Oct 2000

The Americans With Disabilities Act And Academic Libraries In The Southeastern United States, Linda Lou Wiler, Eleanor Lomax

E-JASL: Electronic Journal of Academic and Special Librarianship (1999-2009, Volumes 1-10)

Individuals with disabilities are one of the fastest-growing segments of United States society. In 1970, 11.7% of the United States population was limited in activity, a major factor in measuring and identifying people with disabilities. In 1990, because of the aging of America, 13.7 % of the population could be so identified. By 1994, 15% of the population fell into this group. During this latter period, the older population stayed fairly stable but children and younger adults with disabilities increased greatly. Many different figures, depending upon the method of counting, e.g., age groups included, or whether residence was in a …

This study compares and contrasts InfoTrac and ProQuest primarily as full-text resources to supplement retrieval of references contained in the CINAHL database. These databases are analyzed by examining their scope in terms of the number and types of serials covered within specific areas using Ulrich's subject headings. Another important aspect of this study relates to the effectiveness of the two search engines for end-user retrieval and collection development.

Global Forces And Latino Population Growth In The Midwest: A Regional And Subregional Analysis, Lourdes Gouveia, Rogelio Saenz

Great Plains Research: A Journal of Natural and Social Sciences (through 2013)

The last decade has seen a significant growth of the Latino population in the Midwest, particularly in rural communities. We discuss the forces that have stimulated the growth of the Latino population in the region. We use data from the Current Population Surveys (1988-1997) to assess the demographic and employment growth of the Latino population in the Midwest. Because of the limitations of secondary data, we also illustrate the growth of the Latino population with evidence from Nebraska and a selected area of the state. Data analysis suggests that population estimates of the Latino population generated by the US Bureau …

Review Of The Sacred World Of The Penitentes By Alberto Lopez Pulido, Gustavo Paz Oct 2000

Review Of The Sacred World Of The Penitentes By Alberto Lopez Pulido, Gustavo Paz

Great Plains Research: A Journal of Natural and Social Sciences (through 2013)

In The Sacred World of the Penitentes, Alberto Lopez Pulido addresses popular religion in the southwestern United States from an innovative point of view. By concentrating on the story of the penitentes as told by actual participants in the religious brotherhood, he is able to deliver an interpretation that transcends the official history as well as popular beliefs held since the nineteenth century. Lopez Pulido also breaks away from common views on penitentes by focusing more on the beliefs (the sacred) and less on the ritual components of the brotherhood.

The penitentes, a Catholic brotherhood (with possible Franciscan origins) …
