Impeaching Lying Parties With Their Statements During Negotiation: Demysticizing The Public Policy Rationale Behind Evidence Rule 408 And The Mediation-Privilege Statutes, Lynne H. Rambo

Washington Law Review

Virtually all American jurisdictions have laws—either rules of evidence or mediation-privilege statutes or both—that exclude from evidence statements that parties make during negotiations and mediations. The legislatures (and sometimes courts) that have adopted these exclusionary rules have invoked a public policy rationale: that parties must be able to speak freely to settle disputes, and they will not speak freely if their statements during negotiation can later be admitted against them. This rationale is so widely revered that many courts have relied on it to prohibit the use of negotiation statements to impeach, even when the inconsistency of the negotiation statement …

Doctoring Prescriptions: Federal Barriers To Combating Prescription Drug Fraud Against On-Line Pharmacies In Washington, Eric M. Peterson

Washington Law Review

Prescription drug abuse represents a significant portion of drg abuse in the United States. Drug-seeking individuals alter, steal, or forge prescriptions to sustain their own dependence on prescription medications or to divert the drugs to sell to others at inflated rates. On-line pharmacies are a relatively new source for prescription medications and a potential target for prescription drug fraud. The federal government recently enacted the Electronic Signatures in Global and National Commerce Act (E-SIGN), which governs electronic signatures and preempts inconsistent provisions of state laws, such as the Washington Electronic Authentication Act (WEAA). Animal stιιdies have shown that dietary intake of benzo[α]pyrene (BaP), a polycyclic aromatic hydrocarbon (ΡΑΗ), causes increased levels of tumors at several sites, particιιlarly ίη the upper gastrointestinal tract. However, the role of dietary intake of BaP and cancer ίη humans is not clear. We CIeated a BaP database of selected food products that could be lίnl(ed to Food Frequency Qnestionnaires (FFQs) to estimate BaP intake. BaP levels were measnred for each food line-item (composite samples) which consisted of a variety of foods ίη a FFQ. Prevalence Of Non-O157:H7 Shiga Toxin-Producing Escherichia Coli In Diarrheal Stool Samples From Nebraska, Paul Fey, R. S. Wickert, M.E. Rupp, T. J. Safranek, S. H. Hinrichs

We determined the prevalence of Shiga toxin-producing Escherichia coli (STEC) in diarrheal stool samples from Nebraska by three methods: cefixime-tellurite sorbitol MacConkey (CT-SMAC) culture, enterohemorrhagic E. coli (EHEC) enzyme immunoassay, and stx1,2 polymerase chain reaction (PCR). Fourteen (4.2%) of 335 specimens were positive by at least one method (CT-SMAC culture [6 of 14], EHEC enzyme immunoassay [13 of 14], stx1,2 PCR [14 of 14]). Six contained serogroup 0157, while non-0157 were as prevalent as 0157 serogroups.

Endocrine Cell Dysplasia (Nesidioblastosis): A Relatively Unrecognized Entity In Pakistan?, Nasim Sabir, Irshad Nabi Soomro, Zafar Nazir, Abdul Jabbar, Sheema Hasan

Nesidioblastosis is quantitative as well as qualitative abnormality of pancreatic endocrine cells. There is scattering of small endocrine cell clusters arranged haphazardly rather than the peripheral location within the lobule1,2. Islet contours are irregular, tailing off into parenchyma3. These islets are present in intimate association with ducts forming ductuloinsular complexes1 We recently encountered a new born baby with signs and symptoms of endocrine cell dysplasia.

Exterior Caustics Produced In Scattering Of A Diagonally Incident Plane Wave By A Circular Cylinder: Semiclassical Scattering Theory Analysis, James A. Lock, Charles L. Adler, Edward A. Hovenac

Rie use the semiclassical limit of electromagnetic wave scattering theory to determine the properties of the exterior caustics of a diagonally incident plane wave scattered by an infinitely long homogeneous dielectric circular cylinder in both the near zone and the far zone. The transmission caustic has an exterior/interior cusp transition as the tilt angle of the incident beam is increased, and each of the rainbow caustics has a far-zone rainbow/exterior cusp transition and an exterior/interior cusp transition as the incident beam tilt angle is increased. Late-Talking Toddlers: Mlu And Ipsyn Outcomes At 3;0 And 4;0, Leslie Rescorla, Katherine Dahlsgaard, Julie Roberts

Psychology Faculty Research and Scholarship

Expressive language outcomes measured by MLU and the Index of Productive Syntax (IPSyn) at ages 3;0 and 4;0 were investigated in 34 late talkers with normal receptive language identified between 2;0 to 2;7 and 16 typically developing comparison children matched on age, SES, and nonverbal ability. Late talkers made greater gains than comparison children between 3;0 and 4;0 in both MLU and IPSyn raw score. However, when age-standardized x-scores were analysed, the late talkers were about 2.5 Standard deviations below comparison children on both measures at both ages. It has long been known that security is easiest to achieve when it is designed in from the start. Unfortunately, it has also become evident that systems built with security as a priority are rarely selected for wide spread deployment, because most consumers choose features, convenience, and performance over security. Thus security officers are often denied the option of choosing a truly secure solution, and instead must choose among a variety of post hoc security adaptations. We classify security enhancing methods, and compare and contrast these methods in terms of their effectiveness vs. cost of deployment. Our analysis provides practitioners …
