This Note argues that Tribes have parens patriae standing to protect their citizens through litigation on their behalf, even if not all of their citizens are engaged in the litigation. Part I examines the current requirements of parens patriae standing, as articulated by the Supreme Court. Part II briefly examines the nature of tribal sovereignty within American jurisprudence and concludes that parens patriae standing is a retained right of the Tribes. By evaluating immigration and custody law from a father's perspective and thereby uncovering and addressing the biases held against men, both fathers and mothers will achieve greater recognition. Beyond revealing gender discrimination, such a study also demonstrates the disparate views still harbored toward unmarried parents. Examining custody and immigration law with an emphasis on these issues will hopefully foster a dialogue that brings the law in line with the reality of today's families and promotes each family member's individual potential.

This Essay will focus on "racial profiling" not just in the way many people think about the term-that is, with respect to stopping motorists for traffic violations based solely on their race, so-called "Driving While Mexican" or "Driving While Black"-but also in the context of "affirmative action"-namely, using race as a factor in employment and educational decisions. More broadly, then, the author wants us to think of "racial profiling" as simply "the use of race to develop an understanding of an individual," which moves us slightly away from more pejorative notions of the phrase that have seeped into the national …

This Article articulates a theory of Puerto Rican cultural nationhood that is largely based on ethnicity. In linking ethnicity and citizenship, it is imperative, however, to avoid the evils of ethnic strife and balkanization, while celebrating rather than imposing difference; community consciousness cannot degenerate into fascism.

How parents view the nature of a child and their own role as parents has great influence over the life of that child. Many perspectives about the nature of children have arisen in the course of Western Civilization that have shaped childrearing practices for centuries, including the increasingly accepted scholarly view that parents matter relatively little in children’s lives. (2) This chapter emphasizes inspired, eternal principles that are supported by empirical and conceptual scholarship, which suggests that optimal parenting does indeed matter in children’s lives.

In Western Shoshoni, a Uto- Aztecan language spoken in northern Nevada, coronal obstruents are found in distributional patterns which depend on the presence or absence of a preceding front vowel ([i] or [e]). In the pattern I refer to as FRONTING, alveolar stops alternate with dental stops - dental stops occur following front vowels (la), while alveolar stops occur elsewhere (lb); this pattern is common to all dialects:

Personal values are increasingly recognized as important factors in work environments, including health care systems (Cameron & Whetten, 1995; Covey, Merrill, & Merrill, 1995; Fagermoen, 1997). The personal values of nursing students have been explored (Eddy, Elfrink, Weis, & Schank, 1994; Sivberg & Petersson, 1997) as have those of nurses, in the context of work design (Koerner, 1993 ). Factors of nurses' work satisfaction have also been studied extensively (Avallone & Gibbon, 1998; Brown, Naughton, & Nolan, 1998; Johnston,1997; Kangas, Kee, & McKee-Waddle,1999; Seymour & Buscherhof,1990). Orientation of extracellular matrix fibers in the skin is a key ingredient of tissue appearance and function, and differences in fiber alignment are one of the main distinctions between scar tissue and normal skin. In this paper, the authors develop a mathematical model for alignment of collagen fibers and the fibroblast cells that remodel them; the model extends previous work in which spatial variation was excluded. Numerical simulations of the model are presented, which show spatial variations in alignment over long transients, but with spatially uniform behavior in the long term. The immigrants are all new converts to the Mormon religion and will swell the number of adherents to the Brigham Young faith in the territory considerably. Estimating Tessellation Parameter Intervals For Rational Curves And Surfaces, Thomas W. Sederberg, Jianmin Zheng

This paper presents a method for determining a priori a constant parameter interval with which a rational curve or surface can be tessellated such that the deviation of the curve or surface from its piecewise linear approximation is within a specified tolerance. The parameter interval is estimated based on information about the second order derivatives in the homogeneous coordinates, instead of using affine coordinates directly. This new step size can be found with roughly the same amount of computation as the step size presented in [Cheng 1992], though it can be proven to always be larger than Cheng's step size. …

Ethnic Representation In A Sample Of The Literature Of Applied Psychology, Leslie Case, Timothy B. Smith

A number of authors have raised concerns over the external validity of psychological research. This study examined the extent to which empirical articles include human participants from diverse ethnic backgrounds. Articles published over a 5-year period in 14 selected journals representing 3 applied subdisciplines of psychology were examined. Of the 2,536 articles coded, only 61% indicated the ethnicity of the participants. For those articles, the ethnic compositions approximated U.S. Census estimates, with the exception of an over representation of African Americans and an under representation of Hispanic Americans. Women working as nude dancers have been depicted both in academia and popular literature either as victims of patriarchal exploitation and economic oppression, or as empowered women choosing the most profitable form of work out of the limited options provided for them. This study explores these opposing motivational factors for the entrance and continuance of nude dancing, integrating the theoretical framework of Sex Positive feminism with Strauss and Corbin's (1990) grounded theory approach. The global nth order rate equation has been criticized for lack of theoretical basis and has been shown to be inadequate for modeling char oxidation rates as a function of total gas pressure. The simple Langmuir rate equation is believed to have more potential for modeling high pressure char oxidation. The intrinsic Langmuir rate equation is applied to graphite flake oxidation data and agrees well with reaction rates at three temperatures over the entire range of oxygen pressure (1–64 atm). Summary: The purpose of this study was to evaluate the effects of bilateral botulinum toxin injection into the thyroarytenoid (TA) muscles of a patient with essential voice tremor. Acoustic and aerodynamic data were collected weekly over a 16-week period. Flexible nasolaryngoscopy was performed prior to injection and 2, 6, 10, and 16 weeks post injection. Perceptual analyses of the acoustic and nasolaryngoscopic data were performed. A reduction in frequency tremor and, to a lesser extent, amplitude tremor was observed during the 1-10 week period. Estimated laryngeal resistance decreased after injection and was accompanied in perceptual measures by a reduction in …

Summary: Seven patients with Parkinson’s disease were implanted with deep brain stimulators to provide chronic electrical stimulation to the subthalamic nucleus bilaterally. Acoustic recordings and neurologic assessments were undertaken before surgery in the medication-off and medication-on conditions and after surgery with and without electrical stimulation in the medication off and medication-on conditions. The data showed significant improvements in limb motor performance in response to medication before surgery and when the subthalamic nucleus was stimulated after surgery. Six months after surgery, there were small but statistically significant increases in sound pressure level and fundamental frequency variability in response to stimulation in …

Ultracold plasmas are typically formed by photo-excitation of ultracold atoms to an energy region near (both above and below) an ionization threshold. Excitation to bound, highly-excited Rydberg states can lead to formation of a plasma via several processes, including collisions between Rydberg atoms. Three-body recombination in an ultracold plasma can also result in the production of ultracold Rydberg atoms. Influenza infections result in activation of cellular and humoral immune responses, leading to stimulation of cytotoxic T cells (CTL) and helper T cells with subsequent viral clearance.

By using an assay of granzyme B activity, the in vivo cellular-mediated immune response of old adults was found to be significantly decreased in comparison to young adults. The effect of aging on the CTL response was further investigated via enzyme-linked immunospot technique. A significant increase in number of virus-specific T cells occurred in older adults after vaccination, although the magnitude of the CTL response decreased in comparison to young adults. This is the first work examining the utility of scale chemistry for determining natal origins and habitat associations. I quantified a relationship of scale chemistry to water chemistry, quantified geographic variation in scale chemistry, and evaluated stability of scale chemistry through maturation. Scale chemistry accurately reflected trace element composition of the water in which fish had lived. Juvenile spot (Leiostomus xanthurus) were held in four concentrations of Sr, Cd, and Ba maintained at either 20°C or 25°C, for 42 days. Strontium:Ca, Cd:Ca, and Ba:Ca levels in scales were linearly related to environmental concentrations while temperature had no effect. …

Using the human placental choriocarcinoma JEG-3 cell line as an in vitro human placental model, I studied the mechanisms of the tissue-specific expression and steroid hormone regulation of the hGnRH gene in the human placenta. The results showed that all of the previously identified four elements are required for the full activity of the hGnRH upstream promoter in JEG-3 cells, while the element 4 (FP4, −987/−968) is the most important. Studies performed with 5′ end deletion of this region confirmed these observations.
