In a previous paper we emphasised the changing national and international accounting standards used to measure net pension liability. Beginning with the implications of this analysis for the financing of German employer-sponsored pensions, in this paper we focus upon the internal management of corporate pension assets and liabilities. Two issues drive the analysis. One has to do with the emerging coalescence of interests joining corporate management and shareholders in relation to the management of pension assets and liabilities. Regulation in cyberspace does not consist only of laws issued and enforced by sovereigns. Instead, private parties and standard-setting bodies, employing the technology of online interaction, will increasingly be able to regulate activity, which might potentially upset many of the provisional balances we as a society have struck in areas such as free speech, privacy, and intellectual property. The question then becomes: how do we evaluate this "private" regulation? Are constitutional norms applicable? Let's Clear The Air: Enforcing Civil Penalties Against Federal Violators Of The Clean Air Act, Lisa M. Schenck

The Clean Air Act (CAA) includes enforcement provisions by which violators of the Act can be held civilly liable for penalties. When federal agencies violate the CAA, however, the Constitution and the sovereign immunity doctrine serve as obstacles to civil enforcement. Federal agencies contend that the Constitution's separation of powers doctrine, unitary executive theory, and "case or controversy" justiciability requirement bar the United States Environmental Protection Agency (EPA) from proceeding against them in civil enforcement actions. Coleomegilla maculata is a beneficial coccinellid commonly found in sweet cornfields in Kentucky. Previous work on C. maculata has shown an ovipositional preferencefor the weed Acalypha ostryaefolia, compared to three selected weed species and corn. Also, predation of C. maculata egg clusters on A. ostryaefolia was less compared toclusters on corn and the presence of A. ostryaefolia led to higher densities of C. maculata larvae on corn.

I determined C. maculata ovipositional preference among weed species in fieldtests using nine common weeds. I also examined ovipositional preference using just A.ostryaefolia and Abutilon theophrasti. I assessed the roles of …

A euphemism is defined as the substitution of an agreeable or inoffensive word or expression for one that is harsh, indelicate, or otherwise unpleasant taboo; allusion to an offensive thing by an inoffensive expression. This article deals with medical euphemisms used commonly through medical codes in hospitals for end-of-life patient care. It examines the extent to which fear shapes decision making in critical care units - fear of medical failure, and fear of litigation if not "everything" is done to prolong life, no matter how agonizing. This article analyzes the risk of shortfall in the expected retirement benefits in defined contribution plans, as regulated by the Employee Retirement Income Security Act of 1974 (ERISA). The article compares and contrasts the allocation of investment risks between defined benefit and defined contribution plans. This article demonstrates that current pension law offers inadequate protection of the expected retirement benefit in defined contribution plans and proposes additional fiduciary, insurance, and funding protection for defined contribution plans.

Textured films of molybdenum disulfide have been obtained by solid state reaction between the constituents in thin films form when a (200) oriented tungsten sheet is used as substrate. The crystallites have their c axis perpendicular to the plane of the substrate. The annealing conditions are T=1073K and t=30 min. The films are stoichoimetric and p type. Such highly textured films are achieved without foreign atom addition (Ni, Co...). It appears, as shown by x-ray photoelectron spectroscopy, that a thin WS₂ layer is present at the interface W/MoS₂. In this article, the author utilizes a theoretical approach to discuss the complexity of digital networks and the necessary cognitive adaptations humans need to process the amount of information shared over them. Several propositions are discussed including fuzziness, conscious Ideation, knowledge networks, idea structures, and idea coercion.
