Greater Than The Sum Of Its Parts: Integrating Trial Evidence & Advocacy, Alan D. Hornstein, Jerome E. Deise Jan 2000

Greater Than The Sum Of Its Parts: Integrating Trial Evidence & Advocacy, Alan D. Hornstein, Jerome E. Deise

Clinical Law Review

The recent past has seen a spate of curricular experiments in legal education, perhaps as a response to the MacCrate Report, but more likely merely accelerated by its concern with the inadequacy of the standard curriculum, especially with respect to the inculcation of "skills and values." In the first year curriculum, these innovations often take the form of introducing the skills of legal writing and research into traditional doctrinal courses. More recently, curricular reform has included the introduction of "lawyering" materials in courses in the first year and beyond. The University of Maryland School of Law has been one of …

Clinical Education For This Millennium: The Third Wave, Margaret Martin Barry, Jon C. Dubin, Peter A. Joy

Clinical Law Review

This article focuses on the continuing transformation of legal education and the role of clinical legal education in training competent, ethical practitioners. Part I examines the primary challenges that clinicians confronted in the past: to create a clinical legal education teaching methodology and to establish viable, enduring clinical programs in law schools throughout the country. Part II discusses a variety of different models for integrating clinical methodology either throughout the curriculum or as a core feature of the curriculum. In Part III, we analyze a variety of the most pressing challenges and opportunities for clinical legal education and the larger …

Clients Don't Take Sabbaticals: The Indispensable In-House Clinic And The Teaching Of Empathy, Philip M. Genty Jan 2000

Clients Don't Take Sabbaticals: The Indispensable In-House Clinic And The Teaching Of Empathy, Philip M. Genty

Clinical Law Review

After almost 12 years in law teaching, I approached my first sabbatical with a single goal: to free myself from cases. At that time my clinic clients were primarily parents who were involved in family court proceedings in which they were trying to preserve their parental rights and get their children out of the foster care system. Such cases are emotionally draining for both the client and the lawyer. Thus, while I welcomed the chance to have a semester off from teaching and attending faculty and committee meetings, I felt that I needed a break from the demands of lawyering …

Mission Impossible?: Ethical Community Lawyering, Shauna I. Marshall Jan 2000

Mission Impossible?: Ethical Community Lawyering, Shauna I. Marshall

Clinical Law Review

Lawyers working in low income and poorly resourced communities as well as teachers and law students working in clinical programs engage, from time to time, in a style of practice known as community lawyering. The practice is premised upon the belief that one way to remedy certain types of problems in poor communities is for the community to be an integral part of the development and implementation of the solutions to those problems. This style of lawyering envisions lawyers becoming a part of the community in which they work, bringing to the community the knowledge and expertise that they have …

Montaigne And The Coherence Of Memory, Douglas Mcfarland Jan 2000

Montaigne And The Coherence Of Memory, Douglas Mcfarland

Quidditas

Among the many classical authorities to whom Montaigne refers either through direct reference or quotation, little attention has been paid to Lucan and to his contribution to the intellectual and rhetorical strategies of the Essais. Hugo Friedrich, for instance, in his chapter on Montaigne’s intellectual inheritance from the classical world, does not even mention Lucan’s name. Although Virgil, Lucretius, Plutarch, and several others clearly have influenced both the style and content of the Essais in seemingly more direct and overt ways, Montaigne, nevertheless, turns to Lucan consistently and with regularity. The essayist directly alludes to Lucan on three occasions …

Meter Change As A Relic Of Performance In The Middle English Romance Sir Beues, Linda Marie Zaerr Jan 2000

Meter Change As A Relic Of Performance In The Middle English Romance Sir Beues, Linda Marie Zaerr

Quidditas

Despite the paucity of direct evidence of performance, some form of public representation of the Middle English popular verse romances remains a possibility, and that possibility has been reached by extrapolation from a number of directions. The convergence of evidence, though indirect, has become convincing, and a new approach strengthens that likelihood even further. In an attempt to understand if and how the romances were performed, scholars have considered internal references to performance, historical documents of performance and audience, physical evidence from the manuscripts, cognitive theory, theory of orality and “mouvance,” and evidence from textual variants.

"Journal Of The Branch Of The Church Of Christ In Pontiac,…1834": Hyrum Smith's Division Of Zion's Camp, Craig K. Manscill

BYU Studies

On April 21, 1834, Hyrum Smith and Lyman Wight set out from Kirtland, Ohio, for Pontiac, Michigan, to recruit volunteers for the march of Zion's Camp. Their objective was to lead their recruits on a six-hundred-mile march to a prearranged rendezvous with Joseph Smith's Kirtland division in Missouri. Typically, scholarly treatments of the march of Zion's Camp have focused on the accounts of the Kirtland, Ohio, legion while overlooking the Hyrum Smith-Lyman Wight division of Zion's Camp. Yet Hyrum's group, when compared with Joseph's command, demonstrated a similarly significant commitment to addressing the needs of their fellow Saints in Missouri. …

Variable Léxica Y Comparación Dialectal, Orlando Alba Jan 2000

Variable Léxica Y Comparación Dialectal, Orlando Alba

Faculty Publications

Évaluation De La Concentration De Fibres D'Amiante Émises Dans L'Air Ambiant De Bâtiments Scolaires, Chantal Dion, Guy Perrault Jan 2000
