A Preferred Vision For Administering Schools : A Reflective Essay, David W. Baker Jan 2000

A Preferred Vision For Administering Schools : A Reflective Essay, David W. Baker

Graduate Research Papers

The whole process I have gone through in this program has taught many things. I am excited because these lessons do not apply solely to education. These are lessons I have learned to apply to other areas of my life. I never really had a vision for my profession. I think of the words ofLirah Sabir (2000), "Principals face many challenges to make each child a success. But what works for me is developing a positive mindset, always thinking of the total learning environment, being the best instructional leader I can be, and never being afraid to stretch my own …

Against Fuller And Perdue, Richard Craswell Jan 2000

Against Fuller And Perdue, Richard Craswell

University of Chicago Law Review

The 1936 article by Lon Fuller and William Perdue, "The Reliance Interest in Contract Damages," deserves its place as a classic in the history of contract theory. As a piece of substantive contract scholarship, though, that article is several decades out of date, and is not even very useful as an organizing principle in teaching contract remedies. The first part of this Article surveys various normative theories that have been advanced by modern scholars, to show how little any of them employ or depend on Fuller and Perdue's three-way classification between expectation, restitution, and reliance "interests." The second part surveys …

Framing Frivolous Litigation: A Psychological Theory, Chris Guthrie Jan 2000

Framing Frivolous Litigation: A Psychological Theory, Chris Guthrie

University of Chicago Law Review

This Article uses an often-overlooked component of prospect theory to develop a positive theory of frivolous or low-probability litigation. The proposed Frivolous Framing Theory posits that the decision frame in frivolous litigation induces risk-seeking behavior in plaintiffs and risk-averse behavior in defendants. Because plaintiffs in frivolous litigation have a greater tolerance for risk than the defendants they have sued, plaintiffs in frivolous litigation have "psychological leverage" in settlement negotiations, which is likely to lead to plaintiff-friendly settlements or bargaining impasse. This, in turn, suggests that reformers concerned about frivolous litigation should target reform efforts at plaintiffs' decisionmaking in frivolous suits.

Web-Enabled Information And Referral Services: A Framework For Analysis, Mary Helen Fagan Jan 2000

Web-Enabled Information And Referral Services: A Framework For Analysis, Mary Helen Fagan

Management Faculty Publications and Presentations

Information & Referral (I&R) services help people obtain relevant and accurate information to meet specific needs. The provision of traditional I&R services by skilled specialists is being augmented by web-enabled I&R services, raising a number of issues and opportunities. First, this paper analyzes the literature on I&R services in order to understand key issues and common practices in the development of I&R services. Then a framework is presented that explores two key dimensions of I&R services: the communities of interest and communities of place that they serve. This I&R community analysis framework is illustrated with a number of mini-case studies, …

Are Payments To A Hospital For Services Provided Medicare Beneficiaries "Benefits" Under The Federal-Program Bribery Statute?, Richard W. Garnett Jan 2000

Are Payments To A Hospital For Services Provided Medicare Beneficiaries "Benefits" Under The Federal-Program Bribery Statute?, Richard W. Garnett

Journal Articles

From the Issue

In Fischer, the Supreme Court will resolve a split in the circuits over the question whether a health-care "organization" that receives payments through the Medicare Program in exchange for health-care services provided to individual beneficiaries thereby "receives ... benefits" within the meaning of Section 666(b). If the answer is "yes," then bribes involving the business of such an organization - more precisely, bribes concerning a transaction of the organization worth at least $5,000 - are federal crimes.

About Non-Spherically Symmetric Deformations Of An Incompressible Neo-Hookean Sphere, Marek Elźanowski Jan 2000

About Non-Spherically Symmetric Deformations Of An Incompressible Neo-Hookean Sphere, Marek Elźanowski

Mathematics and Statistics Faculty Publications and Presentations

A class of non-spherically symmetric deformations of a neo-Hookean incompressible elastic ball is considered. It is shown that the only possible solution, the cavitated radially symmetric solution and the deformation of radial inflation and polar stretching. These are the same solutions as found by Polignone-Warne and Warne [6] for a smaller class of deformations. This fact shows once again that the radial deformations are the only deformations, at least within the class considered, which may support a formation of a cavity in the center of an incompressible, isotropic, elastic sphere.

What O'Clock I Say: Juridical Epistemics And The Magisterium Of The Church, Robert E. Rodes Jan 2000

What O'Clock I Say: Juridical Epistemics And The Magisterium Of The Church, Robert E. Rodes

Journal Articles

Legal pronouncements to the effect that such and such is the case can be divided into three categories, which the paper calls normative, constitutive, and epistemic. The paper defines these three legal categories, explores examples of each of in the law of the state, and then examines church pronouncements under the same categories to see what light the analogy of secular law can shed on them. The Church's assertions of authority regarding faith and morals are epistemic in nature. Epistemic pronouncements by authority, whether in Church or state, are binding on anyone who is not better informed than the author, …

Does The Constitution Permit Federal Prosecution For The Arson Of A Private Residence?, Richard W. Garnett Jan 2000

Does The Constitution Permit Federal Prosecution For The Arson Of A Private Residence?, Richard W. Garnett

Journal Articles

From the Issue

The federal arson statute, 18 U.S.C. § 844(i), makes it a crime to "maliciously damage[I ... by means of fire or an explosive, any building ... used in interstate or foreign commerce or in any activity affecting interstate or foreign commerce[.]" The question in Jones is whether this statute and Congress' enumerated powers permit the "federalization" of the arson of a private residence. See Joint Appendix ("J.A.") 45. More particularly, is a private residence "used" in an "activity affecting interstate commerce," within the meaning of the statute, when it, for example, receives natural gas from out-of- state …
