Moral And Legal Rhetoric In International Relations: A Rational Choice Perspective, Eric A. Posner, Jack L. Goldsmith

Critics of realist and rational choice approaches to international law argue that if nations were motivated entirely by power or self-interest, their leaders would not make moral and legal arguments because no one would believe them. Thus, the prevalence of moral and legal rhetoric on the international stage refutes the behavioral assumptions of realism and rational choice. This paper argues that even if nations are not motivated by a desire to comply with morality or law, the use of moral and legal arguments could occur in equilibrium. Patent applications are evaluated in light of the prior art. What this means is that patent examiners evaluate a claimed invention by comparing it with what in a rough sense corresponds to the set of ideas and inventions already known to the public. This is done for three reasons. First, the comparison helps to ensure that patents issue only in cases where an inventor has made a non-trivial contribution to the public’s store of knowledge. It is well understood that corporate capital structure affects tax collections. Most basically, corporate interest expense is deductible. With each interest accrual, the corporate tax base shrinks. Thus, there is a broad range of circumstances in which corporate managers are encouraged by the Internal Revenue Code (the "Code") to load their corporate capital structures with debt. But there is little support for the proposition that Conpress desires corporations to adopt such debt-laden capital structures. Indeed, much tax legislation suggests congressional displeasure with the achievable degree of corporate self- integration. On the other hand, corporate equity has its charms: shareholders are …

The United States has turned away immigrants infected with the human immunodeficiency virus ("HIV") under the public health exclusion of the Immigration and Nationality Act ("INA") since the mid-1980's. Since Congress codified the HIV exclusion in 1993, any alien applying for an immigrant or nonimmigrant visa, adjustment of status to lawful permanent resident, or refugee status must first have a blood test for HIV. The HIV exclusion is not absolute, however. Each HIV-positive alien can apply for one of two waivers of the HIV exclusion that are available in the INA. Thickness Analysis Of Silicon Membranes For Stencil Masks, E. Sossna, R. Kassing, I. W. Rangelow, C. M. Herzinger, T. E. Tiwald, John A. Woollam, Th. Wagner

Stencil masks are key to charged particle projection lithography, in particular for ion projection lithography. To fulfill pattern printing requirements in the sub-70 nm regime, excellent thickness uniformity and thermal emissivity control are critical parameters for high quality stencil mask fabrication. We propose and demonstrate a technique based on infrared variable angle spectroscopic ellipsometry (IR-VASE) to measure these parameters with adequate accuracy and precision. The refractive index of the Si membrane was evaluated using a Sellmeier dispersion model combined with a Drude model. Because of its spectral range from 2 to 33 μm, the IR-VASE method is sensitive to the …

My purpose here is to situate gender as a key factor in a historical movement toward prison abolition. A shift toward restorative or transformative justice, theoretically, is reintegrative in that it benefits the offender, the victim and the community. The first offenders to be diverted from prison to any new program are generally those with the least serious offences and/or those who pose no risk of committing violence; women commonly fall into this category, but, as discussed, very few community alternatives exist for them. The purpose of my memory work project and this article is to begin to create a “history of the present” (Dean, 1994) through collective remembering in Lipsitz’s (1988) sense of “shared experiences and perceptions about the past that legitimate action in the present” (p. 288). I adapt Nasstrom’s (1999) analysis of memory and narrative and women’s activism to the memory work with my WCTU family, friends and neighbours in the farming community in Ontario where I grew up. We “become historical actors who intervene between the past and the present, continually reframing the movement” (p. 134).

Agricultural production contracts are becoming more widespread in Nebraska. (Contract production should be distinguished from custom farming, which is not at issue here). Under ag production contracts, farmers may contract to produce crops or livestock typically for processors. Contracting is widespread in the broiler industry, and is becoming more common in the swine and beef industry, and for some crops. The Producer Protection Act of 2000 (PPA) is a proposed model state statute prepared by the National Association of Attorney Generals to deal with legal issues associated with agricultural contracting. Electric Field-Induced Acoustic-Optic Mode Coupling In An Anticlinic Liquid Crystal, Shiyong Zhang, Rolfe G. Petschek, Charles Rosenblatt

A dc electric field was applied perpendicular to the tilt plane of a pitch-compensated (unwound helix) anticlinic liquid crystal. By means of quasielastic light scattering, the field was found to couple the acoustic and optic Goldstone modes, resulting in an increase of the relaxation time τβ of the acoustic like eigenmode. Elastic constants were estimated from the relaxation time data.

Voltage Stability Analysis: V-Q Power Flow Simulation Versus Dynamic Simulation, Badrul H. Chowdhury, C. W. Taylor

Electrical and Computer Engineering Faculty Research & Creative Works

Several analysis methods are available for long-term voltage stability. The V-Q curve power flow method is widely used by Western Systems Coordinating Council utilities, and has some advantages. Long-term dynamic simulation with proper modeling, however, is clearly the most accurate simulation method. The authors compare the two methods for wintertime voltage stability problems in the Portland, Oregon, USA, load area. Results from the V-Q method can be misleading. The same is true of other power flow program based analysis employing conventional modeling. Results from these power flow methods may be pessimistic, causing overdesign or overly conservative operation.

The Eco-Industrial Park concept is a new paradigm of Industrial Ecology, in which, an industrial system of planned materials and energy exchanges occurs, creating sustainable economic, ecological and social relationships. Superplasticity has evolved to become a significant industrial forming process. The phenomenon of superplasticity is explored at high strain rates where it is economically more attractive. True tensile superplasticity has been demonstrated in nanocrystalline materials. The difference in the details of superplasticity between the nanocrystalline and microcrystalline state is emphasised.
