Emerging Issues In The Use Of Binding Arbitration To Resolve Disputes Between Individuals And Health Plans, Karl Polzer

After briefly describing the federal legal framework fostering the growth of binding arbitration, this paper identifies controversies surrounding arbitration as well as arguments supporting and opposing its use. The paper describes the use of arbitration among certain types of collectively bargained employee health plans regulated under the Employee Retirement Income Security Act of 1974 (ERISA), by health maintenance organizations (HMOs) in California, and by a large employer operating a self-insured ERISA health plan. Evidence cited by the California Supreme Court that the largest HMO in California operated its mandatory arbitration program in an unfair way is presented, along with the …

Health Policy and Management Issue Briefs

This issue brief examines Medicare and managed care for Medicare beneficiaries with behavioral health needs. Although only a relatively small proportion of Medicare beneficiaries are enrolled in managed care arrangements at the present time, proposals to expand the use of Medicare managed care can be expected to receive a good deal of attention in the coming years as part of a larger debate over Medicare's long term future. Thus, this issue brief examines the Medicare+Choice (M+C) program from the perspective of Medicare beneficiaries with mental illness and addiction disorders.

Abstract: This research examines how peer facilitators in an experiential learning model of communication in introductory speech communication courses offered at the University College of Cape Breton in Nova Scotia, Canada, are able to meet the specific learning needs of male and female students simultaneously. Also examined is the perceived role of these facilitators within the model. Data in the report are based on focus group interviews with peer facilitators and literature on experiential learning and Cape Breton cultures. This dissertation focuses on the contemporary informal labor sector in Nicaragua. Central to the study are four research questions concerning the informal labor sector in Nicaragua; they are: (1) Are Nicaraguans positively or negatively selected into the informal/formal sector? That is, do Nicaraguans participate in their respective sector by choice (e.g., positive selection) or by force (e.g., negative selection)? This Article argues that the rise of economic regulation by international organizations is transforming federal government in much the same way as the rise of administrative agencies transformed it at the beginning of the twentieth century. Just as administrative agencies came to be recognized as a de facto "fourth branch" of federal government, United States participation in international economic organizations has generated a de facto "international branch" of federal government.

In the enclosed study, Professor Little analyzes judicial review from a perspective never before explored: civilization's understanding of jealousy and envy. For her raw material, Professor Little uses the recently aggressive decisions of the United States Supreme Court interpreting federalism and separation of powers issues. She scrutinizes the decisions in light of scholarship in philosophy, psychology, and other social sciences studying the sources and cures for envy and jealousy. This study tests for the norm of the consolidation of responsibility for participation in discussion in the mixed-age college classroom. Students who accept and reject this responsibility are identified through observation. The definitions of the college classroom employed by each group of students are contrasted through interviews and survey.

Few would dispute that law and legal procedures lie at the core of American self-identity and are woven deeply into the fabric of our culture. Indeed, our nation's faith in law has frequently been the subject of criticism. Most recently, self-proclaimed "communitarian" commentators have warned that our insistence on legal solutions is encouraging us to become a society of litigants whose attachment to "rights talk" and legal battles is thwarting our ability to reach consensus on social issues or instill shared values in our communities. Objektif kajian ini adalah untuk mengkaji kesan sosio-ekonomi migrasi keluar desa ke atas komuniti pertanian. yang mengalami pengurangan penduduk. Data yang digunakan dalam kajian ini berasaskan survei isi rumah yang dijalankan di Kerian, Hilir Perak, Sabak Bemam dan Rembau. Keputusan Regresi Logit Multinomial menunjukkan rnigrasi keluar desa memberikan kesan positif ke atas taraf hidup isi rumah melalui wang kiriman yang dihantar oleh migran. The parachute force of the Malaysian Army was formed less than a decade ago to provide the Armed Forces with the elements of "reach" and "responsiveness". "Reach" because they can be deployed swiftly by air and engaging in tactical air landed operations (TALO). "Responsiveness" because they are always held at a high state of readiness. The Americans with Disabilities Act (ADA) has been hailed by advocates for persons with disabilities as the most important civil rights act passed since 1964, and as the “Emancipation Proclamation” for Americans with disabilities. Critics of the ADA “cast the law as overly broad, difficult to interpret, inefficient, and as a preferential treatment initiative.” Other question whether the law’s economic benefits outweigh its administrative costs. Every year in the United States, thousands of employees are illegally fired for joining or supporting unions. These employees must bring their claims to the National Labor Relations Board (the “Board”), which applies its famous Wright Line standard to decide thousands of discrimination cases each year. Probably the most common issue in labor discrimination cases is “pretext.” In virtually every case, an employer claims that it fired an employee not for an illegal antiunion motive, but for a legitimate business reason. New Provision For Tolling The Limitations Periods For Seeking Tax Refunds: Its History, Operation And Policy, And Suggestions For Reform, The, Bruce A. Mcgovern

This Article examines a provision of the Internal Revenue Code that Congress enacted in 1998 that suspends the running of the limitations periods that apply to claims for tax refunds. The provision suspends the limitations periods when a taxpayer is "financially disabled," which is defined as being unable to manage one's financial affairs due to a sufficiently severe, medically determinable physical or mental impairment. Congress enacted this provision in response to a series of cases that culminated in a decision of the United States Supreme Court in which the Court held that courts could not equitably suspend, or "toll," the …
