New Technology Clauses Aren't Broad Enough: Why A New Standard Of Interpretation Must Be Adopted For Internet Distribution, Lisa A. Flate Jan 2000

New Technology Clauses Aren't Broad Enough: Why A New Standard Of Interpretation Must Be Adopted For Internet Distribution, Lisa A. Flate

UC Law SF Communications and Entertainment Journal

The distribution of films, specifically independent films, over the Internet often violates the distribution rights of multiterritorially distributed films created before Internet distribution was foreseeable. This article explores the history and development of Internet-distributed entertainment, what Internet distribution means to the independent film industry, how new technology clauses have been interpreted and why Internet distribution requires a fresh construction of these clauses, as well as the role technology plays in preventing problems with Internet distribution. The author poses an equitable solution to make Internet distribution possible and lucrative for all parties under United States and international copyright laws.

Recalibrating The Cost Of Harm Advocacy: Getting Beyond Brandenburg, S. Elizabeth Malloy, Ronald Krotoszynski Jr

Faculty Articles and Other Publications

This Article explores the possibility of shifting the cost of antisocial acts to artists, writers, and musicians when individuals decide to act on a creative artist's suggestions or, in some cases, detailed directions. The Article concludes that, at least in some limited circumstances, the First Amendment should not preclude the imposition of civil liability for those who write and distribute speech that both advocates and facilitates harm to others and proposes the creation of a new category of unprotected speech activity called Harm Advocacy.

Dancing Boys, Anthony Shay Jan 2000

Dancing Boys, Anthony Shay

Pomona Faculty Publications and Research

The informal, and occasionally formal, institution of the dancing boy--the term used by most Western writers in their descriptions of the Islamic world--has been attested for centuries by European observers throughout the Middle East, North Africa, and Central Asia, as well as the Indian subcontinent and throughout the Islamic areas of Southeast Asia such as Indonesia and the southern Philippines. These individuals have been called by a variety of names: bachchec [batcha], literally "child" in Persian and some Turkish languages, luti (itinerant performer), raqqas (dancer) in many regions, kocek (little) and tavsan (rabbit) in Ottoman Turkey, khawal in …
