Consultations Under The Wto's Dispute Settlement System, Robert Alilovic Jan 2000

Consultations Under The Wto's Dispute Settlement System, Robert Alilovic

Dalhousie Journal of Legal Studies

The aim of this paper is to demonstrate that consultations remain a vital element of the World Trade Organization’s dispute settlement process. The study begins with a brief look at consultations under the General Agreement on Tariffs and Trade and the procedural difficulties which were inherent in its dispute resolution system. In order to discern how the system currently operates, it is important to understand how conflicts were resolved where no binding panel system loomed to threaten reprisals should talks fail. Next, the paper discusses the Understanding on Rules and Procedures Governing the Settlement of Disputes (DSU) rules detailing the …

The Collusion Of Law And Science In The Piracy Of Human Genes, Tina Piper Jan 2000

The Collusion Of Law And Science In The Piracy Of Human Genes, Tina Piper

Dalhousie Journal of Legal Studies

Advances in biotechnology over the last decade have created a demand for biological resources by transnational corporations. The search for biological resources has primarily focused on acquiring these resources from indigenous communities and countries of the South. However, the means by which these biological resources are obtained is exploitative and often tantamount to theft (or, as it is commonly known, biopiracy). As a result of communities attempting to prevent this theft and corporations seeking more international legitimacy for their "bioprospecting", "bioprospecting contracts" are more frequently being concluded between governments and corporations. Through the prism of current events in Iceland, I …

Employee Drug Testing: Orwellian Vision Or Pragmatic Approach To Problems In The Workforce, Julie A. Godkin Jan 2000

Employee Drug Testing: Orwellian Vision Or Pragmatic Approach To Problems In The Workforce, Julie A. Godkin

Dalhousie Journal of Legal Studies

Until very recently, there has been no case law considering the legitimacy of employee drug testing under Human Rights legislation or the permissibility of drug testing policies and what they should stipulate. In light of two relatively recent cases, Entrop v. Imperial Oil and Toronto-Dominion Bank v. Canadian Human Rights Commission and Canadian Civil Liberties Association, a re-examination of the legitimacy of employee drug testing is warranted, along with the arguments concerning what the policies should target and how they should be implemented. Furthermore, the EDT jurisprudence exemplifies the discrepancies in the human rights framework, as articulated by the Supreme …

Don't Get Lost In Translation: Teaching Law Students To Work With Language Interpreters, Angela Mccaffrey Jan 2000

Don't Get Lost In Translation: Teaching Law Students To Work With Language Interpreters, Angela Mccaffrey

Clinical Law Review

The General Practice Clinic at Hamline University School of Law was established in 1985. It was designed to provide civil legal services to low income persons, including persons who are relative newcomers to Minnesota, as a result of being refugees from their homelands. Over the years the students have assisted clients with family law matters, supplemental security insurance hearings, consumer cases, reemployment insurance hearings and immigration cases, particularly related to family reunification. As a result of client priorities and the availability of other resources in the community, the largest area of client need has been in the immigration area. Of …

Clinical Education For This Millennium: The Third Wave, Margaret Martin Barry, Jon C. Dubin, Peter A. Joy

Clinical Law Review

This article focuses on the continuing transformation of legal education and the role of clinical legal education in training competent, ethical practitioners. Part I examines the primary challenges that clinicians confronted in the past: to create a clinical legal education teaching methodology and to establish viable, enduring clinical programs in law schools throughout the country. Part II discusses a variety of different models for integrating clinical methodology either throughout the curriculum or as a core feature of the curriculum. In Part III, we analyze a variety of the most pressing challenges and opportunities for clinical legal education and the larger …

Left Over Rights, Daria Roithmayr Jan 2000

Left Over Rights, Daria Roithmayr

Publications

This Essay focuses on Duncan Kennedy's argument for a "post-rights" position, in the wake of the earlier critical legal studies critique of rights and the ensuing response by Critical Race Theorists. I argue that, notwithstanding Kennedy's loss of faith in rights discourse, rights talk might still be pragmatically useful for communities of color to operate strategically within the accepted legal framework, or to subvert that framework in order to advance particular political commitments for particular communities of color at particular moments in history.

Publications

This Article explores the competing resource protection and production interests surrounding President Clinton's proposal to ban new road building in areas of the Tongass National Forest. The Tongass is currently exempted from a temporary moratorium on road building while the Forest Service determines whether to include the Tongass in the roadless ban. This Article analyses the current legislative framework that guides Forest System management of the Tongass and legal challenges to the roadless ban's application to the Tongass. Finally, the Author suggests a potential compromise that balances commercial and production interests.

An Efficient Algorithm To Determine The Periodic Steady-State Solutions Of Nonlinear Systems Using Extended Spectral Analysis, Gülay Tohumoğlu Jan 2000

An Efficient Algorithm To Determine The Periodic Steady-State Solutions Of Nonlinear Systems Using Extended Spectral Analysis, Gülay Tohumoğlu

Turkish Journal of Electrical Engineering and Computer Sciences

A new method for the solution of nonlinear periodic systems was developed. It avoids the time domain calculations of the whole network equations. In the proposed method, by forming the augmented network as linear and nonlinear subnetworks these subnetworks are formulated in complex frequency and time domain respectively. Using spectral analysis the steady-state periodic solution of the whole nonlinear network is reached by an iterative approach. The method can be applied efficiently to weak and strong nonlinear circuits equally well. When we divide the network into a large linear subnetwork and a small nonlinear subnetwork, this method can be applied …

Agreements To Waive Or To Arbitrate Legal Claims: An Economic Analysis, Keith N. Hylton Jan 2000

Agreements To Waive Or To Arbitrate Legal Claims: An Economic Analysis, Keith N. Hylton

Faculty Scholarship

As arbitration agreements have grown in use, they have become controversial, with many critics describing them as a disguised form of waiver. This paper presents an economic analysis of waiver and arbitiation agreements and applies this analysis to the evolving arbitration case law in the Supreme Court and elsewhere. The paper examines the conditions under which parties have an incentive to enter into these types of agreement, and their welfare implications. It shows that, if parties are well informed, they will enter into waiver agreements when and only when litigation is socially undesirable, in the sense that the deterrence benefits …

Going Private: Technology, Due Process, And Internet Dispute Resolution, Elizabeth G. Thornburg Jan 2000

Going Private: Technology, Due Process, And Internet Dispute Resolution, Elizabeth G. Thornburg

Faculty Journal Articles and Book Chapters

Despite cliches about Internet speed, disputes that arise on and about the Internet can be time-consuming to resolve, legally murky, and factually complex. In response, Internet players with market power are opting out: mandatory arbitration is replacing both substantive law and court procedure, and technological remedies are providing self-help without any dispute resolution at all. These alternative procedures tend to move faster than courts and to cost their corporate creators less than lawsuits. They are also structured to maximize the success of the powerful. But faster is not always better. Cheap is not always fair or accurate. Market power is …

Just Because John Marshall Said It, Doesn't Make It So: Ex Parte Bollman And The Illusory Prohibition On The Federal Writ Of Habeas Corpus For State Prisoners In The Judiciary Act Of 1789, Eric M. Freedman Jan 2000

Just Because John Marshall Said It, Doesn't Make It So: Ex Parte Bollman And The Illusory Prohibition On The Federal Writ Of Habeas Corpus For State Prisoners In The Judiciary Act Of 1789, Eric M. Freedman

Hofstra Law Faculty Scholarship

In recent times, both the Court and Congress (in the Anti-Terrorism and Effective Death Penalty Act of 1996, known as AEDPA) have placed increasingly severe restrictions on the ability of state prisoners to challenge the constitutionality of their convictions by bringing federal habeas corpus proceedings. At some point, these developments risk offending the Suspension Clause of the Constitution, which provides: "The Privilege of the Writ of Habeas Corpus shall not be suspended, unless when in Cases of Rebellion or Invasion the public Safety may require it."

In considering the scope of the Suspension Clause, the Court and scholars alike have …

Parental Influence On Career Development Among College Students, Michael W. Ladd Jan 2000

Parental Influence On Career Development Among College Students, Michael W. Ladd

Masters Theses

The purpose of this study was to examine the relationship between students' perceptions of parental influence on their college and career choices and their emotional independence from parents. The relationship between satisfaction with career/major choice (as demonstrated by vocational commitment) and parental influence was also examined. In addition, relationships between emotional independence from parents and commitment to a career field were explored.

To meet the research objectives, four research questions were addressed. First, is the Perceived Parental Influence scale, developed for this study, a reliable and valid scale? Second, is there a significant relationship between students' perceptions of parental influence …

Differences In The Dreaming Style Of Schizophrenic And Non-Schizophrenic Subjects Based On Subscales Of The Dreaming Style Questionnaire, Larry Knopp Jan 2000

Differences In The Dreaming Style Of Schizophrenic And Non-Schizophrenic Subjects Based On Subscales Of The Dreaming Style Questionnaire, Larry Knopp

Masters Theses

The differences in dreaming style between 25 participants diagnosed with schizophrenia and 90 participants comprising a control group were examined. A Dreaming Style Questionnaire (DSQ), was administered to each participant. Nine subscales of the DSQ were used to explore differences in dreaming style between these two groups. A significant difference (p <.003) was found for the familiarity of characters subscales, showing those diagnosed with schizophrenia report that the characters in their dreams are unfamiliar to them. Trends were noted for the subscales assertiveness, low involvement, participation, and bizarreness. Information processing, function of rapid eye movement (REM) sleep, and dreaming style, were reviewed. It is concluded that dreaming style differences are found between the two groups. The significance of dream research is that innovative treatment methods for common mental health issues are being implemented and are proving to exhibit benefits to the recipient. Hopefully, research will shed some light on the etiology of mental health disorders resulting in better treatment methods.

"Retracing Our Steps": Storytelling, Time, And Traditional Referentiality In Mama Day And Absalom, Absalom!, Christine Ann Roth

Masters Theses

Gloria Naylor and William Faulkner turn to the history and tradition of oral storytelling in their novels. Mama Day and Absalom, Absalom! especially present the concepts and techniques of the storytelling act. The complexities of the audience-performer dynamic and non-linear time in an oral storytelling event create obstacles for the teller (the writer) and confuse the role of the audience (the readers). Writers create the role of listening audience for the readers, changing the accepted rules of the readers by asking them to become participants. In Mama Day and Absalom, Absalom!, Naylor and Faulkner create connections between audience …
