Distributive justice refers to the perceptions of fairness of outcomes received by individuals for their efforts in organizational settings. Punishment is frequently used to eliminate offensive or undesirable behavior in organizations. The present study was based on distributive justice theory and assessed the effects of severity of punishment and the application of distributive justice rules in a sports team setting. Eight scenarios were developed combining two levels of distribution of punishment (consistent or conditional), two levels of severity of misconduct (severe or moderate), and two levels of severity of punishment (severe or moderate). The Equal Employment Opportunity Guidelines on Sexual Harassment identify six factors that are relevant in determinations of sexual harassment. This study attempted to determine if three of these factors (i.e., frequency of harassment, number of victims and number of perpetrators) drive perceptions of what constitutes sexual harassment. Participants role-playing jurors on an hostile environment sexual harassment case demonstrated no differences in perceptions as a function of number of victims or number of perpetrators. The significant effect for frequency of harassment was not in the hypothesized direction, with less frequent harassment being perceived as more likely to constitute sexual harassment. The …

Hemin-Binding Surface Protein From Bartonella Quintana, James A. Carroll, Sherry A. Coleman, Laura S. Smitherman, Michael F. Minnick

Bartonella quintana, the agent of trench fever and a cause of endocarditis and bacillary angiomatosis in humans, has the highest reported in vitro hemin requirement for any bacterium. We determined that eight membrane-associated proteins from B. quintana bind hemin and that a similar to 25-kDa protein (HbpA) was the dominant hemin binding protein. Like many outer membrane proteins, HbpA partitions to the detergent phase of a Triton X-114 extract of the cell and is heat modifiable, displaying an apparent molecular mass shift from approximately 25 to 30 kDa when solubilized at 100 degreesC. The conserved cp32 plasmid family of Borrelia burgdorferi was recently shown to be packaged into a bacteriophage particle (C. H. Eggers and D. S. Samuels, J. Bacteriol. 181:7308-7313, 1999), This plasmid encodes BlyA, a 7.4-kDa membrane-interactive protein, and BlyB, an accessory protein, which were previously proposed to comprise a hemolysis system. Our genetic and biochemical evidence suggests that this hypothesis is incorrect and that BlyA and BlyB function instead as a prophage-encoded holin or holin-like system for this newly described bacteriophage, An Escherichia coli mutant containing the blyAB locus that was defective for the normally cryptic host hemolysin SheA was …

Nonmajority Unions, Employee Participation Programs, And Worker Organizing: Irreconcilable Differences?, Carol Brooke
Chicago-Kent Law Review
The debate over section 8(a)(2) of the National Labor Relations Act and the appropriate role of employer-sponsored employee participation plans ("EPPs") in the workplace coincides with growing attention to the usefulness of nonmajority unions ("NMUs") in providing a voice for workers. This Note examines the effectiveness of an NMU in a manufacturing plant in rural North Carolina, and the interaction of that worker-run organization with EPPs established by management. The experience of these workers suggests that section 8(a)(2) should be amended to require employers with EPPs to offer equal support and assistance to NMUs.

The Design Of Supranational Organizations For The Provision Of International Public Goods: Global Environmental Protection, E. Wesley F. Peterson

An international environmental organization would need to be loosely structured initially with a focus on a narrow range of environmental issues. It also would need to emphasize consensus and limit the scope of its interventions to avoid defections by important participants. The benefits of such an organization include the potential for achieving more nearly optimal levels of environmental protection, cost savings from reduction of duplication and managerial economies of scale, and the strengthening of environmental interests in negotiations on the coordination of the environmental regime with other international regimes such as those focusing on trade or development.

This exploratory study exarnined the attribution of blame in father-daughter incest cases by surveying the perceptions of 100 social workers and case aides. The random sample of 74 women and 26 men were mailed a self-repoft survey packet including two Likert-type, ordinal level scales: The Jackson Incest Blame Scale (JIBS) which measured offender, victim, societal and situational factors; and the JEL Blame Scale which measured mother blame. With a response rate of 30Vr, findings were reported in the median and mode. JIBS findings indicated most blame was aftributed to the offender, little to the victim, with varying amounts of blame …

This Article begins with the puzzle of why law does not embrace the "product rule"; a mathematically-inclined judge or jury that thought a defendant .6 likely to have been negligent and .7 likely to have caused plaintiff's harm might conclude that plaintiff had failed to satisfy the preponderance of the evidence standard. Following some discussion of a number of reactions to this puzzle, the Article advances the idea that the process of aggregating multiple jurors' assessments overlooks valuable information. First, following the Condorcet Jury Theorem, agreement among jurors might raise our level of confidence beyond what the jurors themselves report. …

The City Court of Atlanta, the primary traffic court for Atlanta, Georgia, has exercised jurisdiction since 1996 over more than one million traffic violations and, since 1988 and under two statutes, some fifty thousand nontraffic misdemeanors. The City Court's first predecessor, the Traffic Court of Atlanta, adjudicated traffic law violations from 1955 to 1967 and was replaced in 1967 by a second court, also known as the City Court, which existed until 1996. That City Court's jurisdiction was expanded in 1988 to include nontraffic misdemeanors arising from the same occurrence as the traffic violation. In 1996 the City Court was …
