Imagining Justice, Robin West Jan 2000

Imagining Justice, Robin West

Georgetown Law Faculty Publications and Other Works

As we approach the new century and the new millennium, those of us who are legal professionals in liberal capitalist democracies need to drastically improve our practices of law if we are to bring those practices in line with our professed ideals. The commodification and marketing of legal services, for example, combined with a nearly blind commitment to overly combative advocacy, puts legal assistance beyond the means of large segments of the public, severely undercutting our commitment to equality before the law. A different and perhaps harder question, however, is whether the ideals against which we judge our practices are …

Expressive Identity: Recuperating Dissent For Equality, Nan D. Hunter Jan 2000

Expressive Identity: Recuperating Dissent For Equality, Nan D. Hunter

Georgetown Law Faculty Publications and Other Works

Constitutional law has made a mess of the relationship between expression and equality. Much of the time, the two claims exist in sharp conflict, as in recent Supreme Court cases involving hate speech' and the effort by a gay and lesbian group to march in a St. Patrick's Day parade. In those cases, equality claims collided head-on with defenses based on a First Amendment right to express anti-equality values. In other instances, such as debates about whether viewpoint diversity can serve as a justification for affirmative action, or whether race-conscious redistricting can serve as a proxy for political interests under …

Impeachment As Congressional Constitutional Interpretation, Neal K. Katyal Jan 2000

Impeachment As Congressional Constitutional Interpretation, Neal K. Katyal

Georgetown Law Faculty Publications and Other Works

Constitutionalists have assumed, too quickly in my view, that symmetry should exist between the interpretive styles of the courts and Congress. This assumption, which I shall call the myth of interpretive symmetry, slights the many reasons why an interpretive method may work well in one area and not work as well in another. Instead of mapping out all these possible divergences, I illustrate the point with three examples: the roles of history, precedent, and moral philosophy. I show how, in each instance, arguments can be made to suggest that divergent institutional roles should be taken into account in formulating a …

Are There Nothing But Texts In This Class? Interpreting The Interpretive Turns In Legal Thought, Robin West Jan 2000

Are There Nothing But Texts In This Class? Interpreting The Interpretive Turns In Legal Thought, Robin West

Georgetown Law Faculty Publications and Other Works

Allan Hutchinson remarks at the beginning of his interesting article that Gadamer's writings have had only a peripheral influence on legal scholarship -- only occasionally cited, and then begrudgingly so, and never given the serious attention they deserve or require. Nevertheless, Hutchinson acknowledges, Gadamerian influences can be noted -- particularly in the now widely shared understanding that adjudication is, fundamentally, an interpretive exercise. Even with this qualification, though, I think Hutchinson understates Gadamer's impact. Whatever may be true of Gadamer's influence in other disciplines, his influence in law has been unambiguously both broad and deep -- although it has come …

Hard Choices: Thoughts For New Lawyers, David C. Vladeck Jan 2000

Hard Choices: Thoughts For New Lawyers, David C. Vladeck

Georgetown Law Faculty Publications and Other Works

Rarely do law schools challenge students to examine their assumptions about what being a lawyer really means. Seldom do law schools undertake a probing examination of the role that lawyers play in society and the choices that lawyers have to make in terms of how they spend their working lives. For example, how many of you have a clue about the basic facts of our profession? How many lawyers there are in the United States? What do they do? What percentage work for the government? For large law firms? For small firms? For legal services organizations? For public interest groups? …

Remarks, John H. Jackson

Georgetown Law Faculty Publications and Other Works

The limits of international trade must be understood within the context of the institutional framework of the WTO, in particular, the decision-making and dispute settlement processes. The WTO dispute settlement rules are contained in the Dispute Settlement Understanding (DSU), which is Annex 2 to the WTO agreement. The DSU includes some comments on the philosophy, the direction and the purposes of the dispute settlement procedures. Article 3.2 of the DSU has some very interesting phrases. One of those phrases (roughly paraphrased) says, ''None of the reports of the dispute settlement procedure should result in a change, addition, or subtraction from …

The Perils Of Globalization And The World Trading System, John H. Jackson Jan 2000

The Perils Of Globalization And The World Trading System, John H. Jackson

Georgetown Law Faculty Publications and Other Works

The post-World War II world trading system is now more than fifty years old, and not surprisingly, it has evolved through a number of different stages of development and survived a series of perils. Recently, however, the perils seem even greater than before. The failure of the Seattle Ministerial Meeting of November-December 1999 focused the attention of the international community, almost like a prospective execution focusing the attention of the targeted person. A number of different factors have contributed to this perilous situation, and in this brief Essay, I want to look particularly at some of the institutional characteristics of …

Eleventh Amendment Schizophrenia, Carlos Manuel Vázquez Jan 2000

Eleventh Amendment Schizophrenia, Carlos Manuel Vázquez

Georgetown Law Faculty Publications and Other Works

This article argues that conflicting analytical strains run through the Supreme Court's recent majority opinions in the area of state sovereign immunity. The "supremacy" strain stresses that, despite the Eleventh Amendment, the states remain obligated to comply with federal law, and that the Constitution envisions the "necessary judicial means" to enforce these obligations against the state. These means include suits by the federal government, private suits for injunctive relief, and suits seeking damages from state officials in their individual capacities. Thus, according to the supremacy strain, state sovereign immunity is unimportant because it merely bars unnecessary means of enforcing the …

The Difference In Women’S Hedonic Lives: A Phenomenological Critique Of Feminist Legal Theory, Robin West Jan 2000

The Difference In Women’S Hedonic Lives: A Phenomenological Critique Of Feminist Legal Theory, Robin West

Georgetown Law Faculty Publications and Other Works

Part One of this article provides a phenomenological and hedonic critique of the conception of the human - and thus the female - that underlies liberal legal feminism. Part Two presents a phenomenological critique of the conception of the human - and thus the female - which underlies radical feminist legal criticism. Again, I will argue that in both cases the theory does not pay enough attention to feminism: liberal feminist legal theory owes more to liberalism than to feminism and radical feminist legal theory owes more to radicalism than it does to feminism. Both models accept a depiction of …

Mothers And Fathers Of Invention: The Intellectual Founders Of Adr, Carrie Menkel-Meadow Jan 2000

Mothers And Fathers Of Invention: The Intellectual Founders Of Adr, Carrie Menkel-Meadow

Georgetown Law Faculty Publications and Other Works

When we think of the "founding" of the ADR movement (particularly, but not exclusively, in law), from when do we date it? Whom do we think of as our leaders? Many of us think of Frank Sander and the "multi-door courthouse" suggested by his famous paper, delivered at the Pound Conference on the Causes of Popular Dissatisfaction with the Administration of Justice in 1976. For others, the publication of Roger Fisher and William Ury's "Getting to Yes," signaled an interest in a changed paradigm for engaging in legal negotiations. Some may associate ADR's nascency with early practical efforts to institutionalize …

Dc Consortium Of Legal Service Providers: Legal Services 2000 Symposium, Peter B. Edelman

Georgetown Law Faculty Publications and Other Works

My main point is to urge you to the see what is possible in the way of what I might call a public health approach to lawyering for the poor. In a public health approach you find something that has polluted the river and you clean it up at its source instead of just treating its victims one by one. In legal and societal terms, when we are discussing why so many children are growing up poor and dying a slow death of disappointment, the challenge is to think about it in a public health way. Of course we cannot …

Monopole Equations On R^8: The Energy Integral, Ayşe Hümeyra Bi̇lge, Teki̇n Dereli̇, Şahi̇n Koçak

Turkish Journal of Physics

We discuss the Seiberg-Witten theory in four dimensions and possible generalizations to eight dimensions. We propose an action which is minimized by a set of monopole equations, previously obtained as a generalization of Seiberg-Witten theory to eight manifolds with Spin(7) holonomy.

Global Results In Space Of Inter-Monomer Interactions For Hp Lattice Model, M. R. Ejtehadi̇, V. Shahrezaei̇, N. Hamedani̇

Turkish Journal of Physics

Using the ground state candidates for Hydrophobic-Polar lattice model on a two dimensional square lattice, we exactly enumerate the native states of proteins with length up to 20 for a wide range of energy parameters. We find the reduced set of contact maps, ground state candidates, perfectly stable sequences and designability of configurations.

Multi-Species Asymmetric Exclusion Process In Ordered Sequential Update, M. Ebrahi̇m Fouladvand, Farhad Jafarpour

Turkish Journal of Physics

A multi-species generalization of the asymmetric simple exclusion process (ASEP) is studied in ordered sequential and sub-lattice parallel updating schemes. In this model, particles hop with their own specific probabilities to their rightmost empty site and fast particles overtake slow ones with a definite probability. Using Matrix Product Ansatz (MPA), we obtain the relevant algebra, and study the uncorrelated stationary state of the model both for an open system and on a ring. A complete comparison between the physical results in these updates and those of random sequential introduced in [20,21] is made.

Old And New Anti-Epileptic Drugs In Pregnancy, Giovanni Regesta, Paolo Tanganelli Jan 2000

Old And New Anti-Epileptic Drugs In Pregnancy, Giovanni Regesta, Paolo Tanganelli

Saudi Medical Journal

During the recent years, a significant number of anti-epileptic drugs have been approved for prescription in different countries. In addition, some other promising drugs are in various stages of development. Soon after each drug has found its place in the therapeutic arsenal, pregnancies with exposure occur, with an increased risk of birth defect and developmental disturbances. As regards the possible teratogenic effect of the new anti-epileptic drugs, apart some individual reports we have only the results of pre-clinical toxicological studies which are difficult to extrapolate to the human situation, because of the well-known interspecies differences in pharmacokinetics and pharmacodynamics. Furthermore, …

Adolescent Endocrinology In Saudi Arabia, Mohamed A. Abdullah, Hamad S. Al-Salhi, Mona A. Anani, Liza Q. Melendrez

Saudi Medical Journal

OBJECTIVE: The importance of providing special health care services for adolescents has been recently stressed. In Saudi Arabia, adolescents have no special services. In this study, we describe our first 5 years experience of an adolescent endocrinology clinic in Security Forces Hospital. We believe it is the first clinic with this objective in the Kingdom. METHODS: An adolescent endocrinology clinic was run by a team composed of pediatric endocrinologist, diabetic nurse educator, clinic nurse and a dietician in collaboration with other supportive staff and consultants from other disciplines. The methodology of setting up, staffing and running the clinic is described. …

Substance Dependence. A Hospital Based Survey, Nayyer Iqbal Jan 2000

Substance Dependence. A Hospital Based Survey, Nayyer Iqbal

Saudi Medical Journal

OBJECTIVE: To collect basic data on multiple and diverse issues such as drugs of dependence, smoking, initiation age, injection related harm, nutritional status, trauma, accidents, abnormal laboratory parameters and co-morbid conditions. METHODS: Seven hundred and ninety nine subjects from a voluntary detoxification unit were studied. Four hundred and ninety seven charts from June 1995 to December 1995 were reviewed retrospectively. For the other 302 subjects admitted between September 1996 to December 1996, information regarding drug use, smoking, trauma, accidents and co-morbid conditions was recorded during the admission interview while the remaining data was later obtained from the charts. RESULTS: Sixty …

Image-Driven Simplification And Optimization Of Polygonal Models, Peter Lindstrom Jan 2000

Image-Driven Simplification And Optimization Of Polygonal Models, Peter Lindstrom

Link Foundation Modeling, Simulation and Training Fellowship Reports

Model simplification is often used in computer graphics to reduce the complexity of large polygonal models. For many graphics applications, the goal of this process is to produce a coarser model that is visually similar to the original, allowing the complex original model to be replaced with little or no loss in perceived quality. Existing simplification techniques, however, rely on geometry-based heuristics as an indirect indicator of visual similarity. We propose a novel image-driven simplification method that uses rendered images of a model and an image metric as a means of measuring visual similarity. Using this approach, changes in appearance …
