"Awakenings" On Relational Ways Of Knowing: An Ecological Perspective On Curriculum., Elaine Kent Riley Jan 2000

"Awakenings" On Relational Ways Of Knowing: An Ecological Perspective On Curriculum., Elaine Kent Riley

LSU Historical Dissertations and Theses

The human species and all nonhuman forms on the planet, have co-evolved over a 14 billion-year process, yet many people operate as if planetary life existed to support and sustain human well-being alone. Separation, dualism, and power-over ways of knowing fuel a human-centered attitude which exalts our own species above the rest of the natural world. How humans will live with the earth in the next millennium (Hogan, 1996) is one of the most fundamental questions arising at the onset of the year 2000. The planet cannot sustain continued degradation of ecological systems stemming from depletion of natural resources and …

Activation And Metabolism Of P-Nitrosophenoland 2,2'-Thiobis-Ethanol By Horse Liver And Human Alcohol Dehydrogenase: Toxicological Implications., Billy Fred Dudley Jr Jan 2000

Activation And Metabolism Of P-Nitrosophenoland 2,2'-Thiobis-Ethanol By Horse Liver And Human Alcohol Dehydrogenase: Toxicological Implications., Billy Fred Dudley Jr

LSU Historical Dissertations and Theses

C-nitroso compounds are reactive intermediates in the toxic sequelae of nitroarene metabolism. Alcohol dehydrogenase (ADH) contributes significantly to NADH-dependent C-nitroso reduction by cytosol relative to NAD(P)H: quinone oxidoreductase (NQOR). NADPH-dependent pNSP reduction by liver cytosol of ADH+ animals is mostly dicumarol-sensitive which implicates NQOR as the major NADPH-dependent activity. Although, extensive structural homology between horse and different isozymes of human ADH exist, significant differences occur within the active site, which account for great variability among substrate specificities, kinetic constants, and response to inhibitors. We have studied the metabolic activity of horse liver alcohol dehydrogenase (HLADH), purified class I alphaalpha, beta …

Crystal Structures Of Various Organic Materials And A Statistical Analysis Of Single Crystal X -Ray Diffraction Data From Potassium -Doped Barium Plumbate., Jerome Gerard May Jan 2000

Crystal Structures Of Various Organic Materials And A Statistical Analysis Of Single Crystal X -Ray Diffraction Data From Potassium -Doped Barium Plumbate., Jerome Gerard May

LSU Historical Dissertations and Theses

A general explanation of the collection and reduction of crystallographic data is presented. This is followed by a brief explanation of routine crystal structure solution and refinement. The results of five routine organic structure solutions are included. A discussion of the perovskite structure aristotype is followed by an elaboration of four common distortions to the aristotype that result in perovskite hettotypes. A crystal structure for barium bismuthate is analyzed to explain its occurrence as a perovskite aristotype. A literature review of powder and neutron diffraction structures reported for barium plumbate included a wide variety of perovskite hettotypes and one aristotype. …

Transcriptional Regulation Of Chicken Apolipoprotein A-I Gene Expression, Wen Lin Kumfert Jan 2000

Transcriptional Regulation Of Chicken Apolipoprotein A-I Gene Expression, Wen Lin Kumfert

Theses and Dissertations in Biomedical Sciences

Deregulation of a set of critical cellular genes has long been speculated as a cause of the oncogenic transformation induced by v-Jun oncoprotein. In the past several years, extensive efforts have been made to identify such genes. Several target genes have been identified that are specifically associated with the v-Jun induced transformation phenotype in chicken embryo fibroblasts (CEF).

We have undertaken the objective to identify and characterize the genes that become deregulated in response to, or as a consequence of, Jun-induced transformation. By exploiting the difference in oncogenic potential between v-Jun and c-Jun in CEF, the chicken apolipoprotein A-I (apoA-I) …

The Practice Of Pediatrics In Pedagogy? The Costly Combination In Cedar Rapids Community School District V. Garret F., Jennifer L. Barnes Jan 2000

The Practice Of Pediatrics In Pedagogy? The Costly Combination In Cedar Rapids Community School District V. Garret F., Jennifer L. Barnes

University of Richmond Law Review

The Individuals with Disabilities Education Act ("IDEA")' was enacted in 1975 to ensure that all children with disabilities, like their nondisabled counterparts, have access to a free appropriate public education designed to meet their unique needs. This "appropriate education" mandate emphasizes the necessity of providing such children with special education and "related services," and federal funding is offered to state and local educational agencies to assist in implementing this objective.

Against Constitutional Law (Populist Or Otherwise), Michael Mandel Jan 2000

Against Constitutional Law (Populist Or Otherwise), Michael Mandel

University of Richmond Law Review

Mark Tushnet has written a great critique of constitutional judicial review. With his sure grasp of the scholarship, his commit- ment to the issues and the real people behind them, and his methodical, flawless reasoning, he has effectively blasted the theoretical foundations of judicial constitutional law to smithereens. As such, he has made a valuable contribution to legal scholarship that will remain so for a long time to come.

Annual Survey Of Virginia Law: Antitrust And Trade Regulation Law, Michael F. Urbanski, James R. Creekmore Jan 2000

Annual Survey Of Virginia Law: Antitrust And Trade Regulation Law, Michael F. Urbanski, James R. Creekmore

University of Richmond Law Review

During the past year, this country has devoted much attention, with good reason, to the Microsoft trial and appeal. Not since the breakup of Ma Bell's stronghold on the telecommunications industry in the early 1980s has a single legal battle posed so significant a change for both an industry and its consumers. In fact, given the far-reaching effects of this decision on other related industries and consumers, it likely will be years before its ultimate impact can be assessed.

Annual Survey Of Virginia Law: Labor And Employment Law, Thomas M. Winn Iii Jan 2000

Annual Survey Of Virginia Law: Labor And Employment Law, Thomas M. Winn Iii

University of Richmond Law Review

This article discusses four principal areas of employment and labor law in which there was significant activity in Virginia's courts and/or the legislature over the past year: (1) public policy wrongful discharge; (2) negligent hiring, retention, and supervision; (3) employment references; and (4) covenants not to compete and the employee's fiduciary duties owed to the employer. Beyond the scope of this article are decisions rendered in other areas of law affecting the employment relationship, including workers' compensation, unemployment, wage payment, and public sector employment.

Annual Survey Of Virginia Law: Legal Issues Involving Children, Robert E. Shepherd Jr. Jan 2000

Annual Survey Of Virginia Law: Legal Issues Involving Children, Robert E. Shepherd Jr.

University of Richmond Law Review

The past year generally has been another quiet one for children's legal issues in Virginia, although it was a busier than normal year in the United States Supreme Court with the grandparents' visitation case, the Texas high school football game prayer case, a significant Title I case involving the provision of instructional material to religiously operated schools, and the gay Boy Scout leader case. Not as much occurred at the state level, with little legislation of great significance to children and youth being enacted at the 2000 General Assembly session. However, a succession of cases interpreting and applying Baker v. …

University of Richmond Law Review

This article reviews significant, recent developments in the law affecting Virginia taxation. Each section covers recent judicial decisions and legislative changes over the past two years. The overall purpose of this article is to provide Virginia tax and general practitioners with a concise overview of the recent developments in Virginia taxation most likely to have an impact on Virginia practitioners. This article, however, will not discuss many of the numerous technical legislative changes to the State Taxation Code of Title 58.1.

What Passes For Policy And Proof In First Amendment Litigation?, Rodney A. Smolla Jan 2000

What Passes For Policy And Proof In First Amendment Litigation?, Rodney A. Smolla

University of Richmond Law Review

In this Allen Chair Symposium issue of the University of Richmond Law Review, three outstanding scholars have written provocative pieces on the First Amendment. Professor John Nowak engages in an exercise of constitutional futurism, "'remembering the future" to propose a number of relatively radical alterations of First Amendment doctrine to achieve what he argues should be the appropriate balance between freedom of speech and fair trials in "cyber world." Professor Paul Carrington, arguing that a communitarian right of citizens to self-government is the principal that ought to animate our politics and law, has launched a broadside indictment against contemporary First …

Safety Valve Closed: The Removal Of Non-Violent Outlets For Dissent And The Onset Of Anti-Abortion Violence, Mark L. Rienzi Jan 2000

Safety Valve Closed: The Removal Of Non-Violent Outlets For Dissent And The Onset Of Anti-Abortion Violence, Mark L. Rienzi

Scholarly Articles

This Note examines abortion opposition over the past two centuries and the extent to which recent trends toward violence have followed from the elimination of major nonviolent methods of dissent. Part I explores the history of abortion opposition prior to Roe, noting that opponents during this period relied almost exclusively on legislative action to effect change. Roe removed this principal nonviolent outlet, and the first wave of anti-abortion violence in American history en-sued. Even within this post-Roe violence, an examination of the rise and fall of mass nonviolent civil disobedience in the late i98Os and the dramatic increase in anti-abortion …

The Reawakening Of Marriage, Raymond C. O'Brien Jan 2000

The Reawakening Of Marriage, Raymond C. O'Brien

Scholarly Articles

This Article contends that the convergent societal pressures from the same-sex marriage debate, the effect of the welfare legislation to define family, and the allowance of greater religious involvement in marriage preparation and divorce will precipitate a reawakening of marriage. The emergence of covenant marriage, the public debate over no-fault divorce, the resurgence of fault grounds, and Florida's enactment of its Marriage Preparation and Preservation Act are ramifications of this reawakening. Public concern over the frequency of divorce and the resulting adverse consequences for children and adults, indicate a change in attitude concerning marriage, divorce and family. Covenant marriage is …

Towards A Defensible Free Exercise Doctrine, Frederick Mark Gedicks Jan 2000

Towards A Defensible Free Exercise Doctrine, Frederick Mark Gedicks

Faculty Scholarship

Almost from the moment that the Supreme Court abandoned the religious exemption doctrine in Employment Division v. Smith, its defenders have worked to bring it back. More than a decade later, however, Smith remains well-entrenched; not only has the Court confirmed Smith's basic holding, but it also struck the Religious Freedom Restoration Act, Congress's first effort to restore the exemption doctrine, at least as it applied to the states.

Proponents of religious exemptions cannot ignore the hard truth that they can no longer be defended. During the nineteenth and early twentieth centuries, American society viewed the practice of religion-mostly Christian …

Protecting The Sacred Sites Of Indigenous People In U.S. Courts: Reconciling Native American Religion And The Right To Exclude, Kevin J. Worthen Jan 2000

Protecting The Sacred Sites Of Indigenous People In U.S. Courts: Reconciling Native American Religion And The Right To Exclude, Kevin J. Worthen

Faculty Scholarship

The key to understanding current U. S. caselaw concerning the protection of Native American sacred sites is arguably found in the dissenting opinion of an eighteen-year old case involving not religious freedom, not sacred sites, and not cultural heritage - but the right of Indian tribes to impose severance taxes on non-tribal members who extract oil and gas from tribal lands. In Merrion v. Jicarilla Apache Tribe, Justice Stevens refused to join the majority’s conclusion that the inherent sovereignty of the Jicarilla Apache Tribe included the power to impose such a tax. In his view, a tribe’s authority to regulate …

Tracing Image And Bodily Displacement In Modern And Postmodern Dance, Carolyn Margaret Griffiths Jan 2000

Tracing Image And Bodily Displacement In Modern And Postmodern Dance, Carolyn Margaret Griffiths

Theses: Doctorates and Masters

Through time the dancer has been both celebrated and disadvantaged by antithetical ideas: the division of soul and body, form and matter, life and death, artist and audience. For the romantics, the dancing body stood in a relationship to poetic thought in much the same way as the dancer stood to the body. Notions of the body in early modernism arose from cultural and political constructs through which poets and writers examined the nature of truth. These poets, Yeats in particular, hinted at a premise that a whole history of culture may be necessary to explain why women and art …

Identifying The 'Aboutness' Of Highly Structured Expository Documents, N. Stuart Hawthorne Jan 2000

Identifying The 'Aboutness' Of Highly Structured Expository Documents, N. Stuart Hawthorne

Theses: Doctorates and Masters

The increases in commercial documentation over the past 50 years and the permeation of computers into all areas of business has led to a major increase in the individual's reading load. This thesis proposes a method of writing procedural documentation to enable rapid appreciation of the 'aboutness' of such material, thus making the reading task more efficient. The method is derived from a document structure which is used as a basis for the development of rules to construct a hierarchy of in-text headings which encapsulates the 'aboutness' of the text. Reading efficiency is achieved through needing to only interpret the …

Comparison And Evaluation Of The Moral Significance Of Emotions In Aquinas, The Manualists And Catholic Moral Theology 1960-1990, Thomas Ryan Jan 2000

Comparison And Evaluation Of The Moral Significance Of Emotions In Aquinas, The Manualists And Catholic Moral Theology 1960-1990, Thomas Ryan

Theses

This is a comparative study of the moral significance of emotions in Catholic Moral Theology. It is done with reference to Thomas Aquinas, to selected Manualist authors immediately prior to Vatican II, to representative Catholic theologians 1960-1990 and to a sample of contemporary writers from other disciplines. The project argues five points. Firstly, Aquinas sees emotions as designed to have a necessary and constructive significance in moral reasoning and moral development. In their habituated form as affective virtues, they enable a person to have the right emotional responses in terms of their object and intensity. Secondly, the Manualists, by a …

Church Discipline And Grace, Stefan Radu Jan 2000

Church Discipline And Grace, Stefan Radu

Doctor of Ministry Projects

Problem. Local churches are in general confusion about the meaning, importance, and function of church discipline. Hence, this biblical task is mostly ignored, or even opposed by many as being judgmentalism. As a result, baptismal candidates are poorly prepared and sometimes members are allowed to continue in sinful habits. This study sought to research and present material about why and how the church ought to work with sinning believers.

Method. Based on a search of the Holy Scripture, the writings of Ellen G. White, and other theological literature, material for a seminar about church discipline and grace was produced. A …

The Enforcement Of Environmental Law In England And Wales, Lisa Jane Page Jan 2000

The Enforcement Of Environmental Law In England And Wales, Lisa Jane Page

Plymouth Business School Theses

The control of environmentally damaging activities has become one of the most important areas for concern in recent years. The amount of legislation relating to this subject area has increased several-fold, with European Directives and domestic laws being introduced in response to pressure from a variety of avenues. Key studies on the enforcement of environmental law have been carried out. However, this work was undertaken prior to the expansion of legislative provisions at the start of the 1990s. In the light of this new legislation, new regulatory agencies, and changing public opinion, the following research aims were formulated: 1. To …
