Health Policy and Management Issue Briefs
This Issue Brief, prepared for the Substance Abuse and Mental Health Services Administration (SAMHSA), examines contracts between managed care organizations (MCOs) and community-based providers of mental illness and addiction disorder treatment and prevention services (MI/AD providers). Building upon initial research published in 1997, this brief explores in depth one of the most hidden aspects of managed care: the relationship between the managed care organizations and health care providers.

Death Penalty: Texas Law - Subsequent Writs And Abuse Of The Writ Doctrine In Texas, Charles M. Mallin
Death Penalty: Texas Law - Subsequent Writs And Abuse Of The Writ Doctrine In Texas, Charles M. Mallin
Texas Wesleyan Law Review
The purpose and scope of this paper is to introduce the practitioner to the concept of the "abuse-of-writ" doctrine as made applicable to death penalty habeas litigation via the recent enactment of article 11.071, section 5(a) of the Texas Code of Criminal Procedure.' It is generally pertinent in the context of serial or subsequent writ filings by the applicant. It is hoped that this article will help guide both the State's and defendant's habeas attorney through the various intricacies of the subsequent application for a writ of habeas corpus in death penalty litigation. Part I of this article examines the …
Impact Of Violence Prevention Programs On The Attitudes Towards Guns And Violence Among Third Through Sixth Grade And Seventh Grade Students In The Bowling Green Independent School District, Michelyn Bhandari
Masters Theses & Specialist Projects
The purpose of this study is to assess the efficacy of violence prevention programs on the attitudes toward guns and violence among students in grades three through seven. This study represents an attempt to prove that third through sixth grade students who receive anger control training and seventh grade students who receive conflict resolution training will show a significantly lower attraction towards guns and violence than students receiving no such training. By understanding interrelation between adolescents' attitudes towards guns and violence and their psychosocial functioning, the public can seek out ways of preventing violence. To measure the impact and to …

Three Arguments Against Mt. Healthy: Tort Theory, Constitutional Torts, And Freedom Of Speech, Michael Wells
Three Arguments Against Mt. Healthy: Tort Theory, Constitutional Torts, And Freedom Of Speech, Michael Wells
Mercer Law Review
Mt. Healthy City School District Board of Education v. Doyle is among the most important, and least discussed, cases in constitutional tort law. It stands for the abstract principle that the "but-for" rule of causation, which is the usual test in common-law torts, applies in constitutional tort suits as well. To understand the principle and its implications, it is helpful to have in mind a concrete example of its application, and Mt. Healthy provides as good an illustration as any other case. Doyle, a nontenured school teacher, quarreled with another teacher, with school employees, and with students. Two specific incidents …

Strategic Auditing In A Political Hierarchy: An Informational Model Of The Supreme Court's Certiorari Decisions, Charles M. Cameron, Jeffrey A. Segal, Donald Songer
Strategic Auditing In A Political Hierarchy: An Informational Model Of The Supreme Court's Certiorari Decisions, Charles M. Cameron, Jeffrey A. Segal, Donald Songer
Faculty Publications
We examine how the Supreme Court uses signals and indices from lower courts to determine which cases to review. In our game theoretic model, a higher court cues from publicly observable case facts, the known preferences of a lower court and its derision. The lower court attempts to enforce its own preferences, exploiting ambiguity in cases' fact patterns. In equilibrium, a conservative higher court declines to review conservative decisions from lower courts regardless of the facts of die case or the relative ideology of the judges. But a conservative higher court probabilistically reviews liberal decisions, with the "audit rate" tied …

Drazen Erdemovic. The name may be unfamiliar to many outside the former Yugoslavia. The name will surely be unknown by most people outside the international community and those committed to the universal protection of human rights through criminal prosecution. Drazen Erdemovic is a confessed killer. Drazen Erdemovic has confessed to killing somewhere between seventy and one hundred unarmed Muslims in a mass execution as a member of the Bosnian Serb army in July 1995. In this regard, he is the first convicted defendant to stem from the International Criminal Tribunal for the former Yugoslavia (ICTY) established by the United Nations …

Twenty-Five Years Of Black America: Two Steps Forward And One Step Back?, Glenn C. Loury
The Journal of Sociology & Social Welfare
The nature of social and economic inequality as it exists now between Blacks and Whites in the United States is explored in this paper. Summary statistics on education, earnings, employment, family structure, incarceration and life expectancy are presented by age, sex and race. It is suggested that, while progress has been made in narrowing the racial gap in social standing, there remains a significant disparity that warrants continuing concern.
Who Cares About Racial Inequality?, Glenn C. Loury
Who Cares About Racial Inequality?, Glenn C. Loury
The Journal of Sociology & Social Welfare
The issue of Affirmative Action is discussed, identifying some difficulties with the way that this policy has been pursued in the past: Racial preferences can be a poorly targeted method of closing the gap in social status between Blacks and Whites, and can have negative unintended consequences for incentives and for the reputations of its beneficiaries. Nevertheless, it is argued that some form of affirmative action continues to be needed. The concept of "developmental affirmative action" is introduced. This form of racially targeted policy focuses primarily on the enhancement of competitive skills. In so doing, it avoids many of the …
