[A] prosecutor…enters a courtroom to speak for the People and not just some of the People. The prosecutor speaks not solely for the victim, or the police, or those who support them, but for all the People. That body of "The People" includes the defendant and his family and those who care about him

Public Perceptions Of Quick-Care Clinic And Hospital Emergency Department Capabilities: A Pre-Illness And Injury Analysis, Paul D Shapiro
UNLV Retrospective Theses & Dissertations
This dissertation examines the public and medical professionals' perceptions of the capabilities of quick-care clinic and hospital emergency departments. A probability-based survey was administered to three hundred and sixty-six adults in the Las Vegas metropolitan area detailing twenty-one medical conditions ranging in severity from an ingrown toenail to a child not breathing. For each scenario the respondent was asked to select either a hospital emergency department or a quick-care clinic as the appropriate facility for the proper treatment of each medical condition. Their responses were then compared to a medical benchmark which was established by a sample of one hundred …

Television Crime Drama Program Viewing And O J Simpson Bias: Applying The Cultivation Theory, Allan Pearlstein

According to media critics, no criminal event has ever received as much publicity as the O. J. Simpson double murder case. The purpose of conducting this research was to apply the cultivation analysis theory to the O. J. Simpson case to see if heavy daily television viewers, heavy viewers of crime drama programs both realistic and fictional, and heavy newspaper and magazine readers expressed guilt against O. J. Simpson With the assistance from personnel at the Clark County Courthouse in Las Vegas, Nevada, the researcher administered 205 survey questionnaires to summoned jurors who were released from jury service. A negative …

Fear As A Predictor Of Firearm Ownership And Concealed Weapons Permits In Clark County, Nevada, Becky Beckstead Harris
UNLV Retrospective Theses & Dissertations
This study is specific to Clark County, Nevada. Two relationships, the relationship between fear and gun possession [defined in terms of firearms registration] and the relationship between fear and the issuance of concealed weapons permits, were posited. Data for the number of registered firearms and issued concealed weapons permits were obtained from the Las Vegas Metropolitan Police Department Firearms Detail and CCW Detail. Criminal incidents involving firearms in public areas that appeared to be random in nature [stranger to stranger violence] were gathered through an archive search of Nevada's largest newspaper servicing Clark County, the Las Vegas Review-Journal; Statistical analysis …

The Constitutional Legacy Of Chief Justice Brian Dickson, Robert J. Sharpe
The Constitutional Legacy Of Chief Justice Brian Dickson, Robert J. Sharpe
Osgoode Hall Law Journal
Chief Justice Brian Dickson played a central role in the elaboration of the fundamental values of the Canadian Constitution. He took a balanced approach to federalism, favouring neither federal nor provincial claims and inviting cooperation through overlapping jurisdiction. Dickson transformed the rule of law from a background value to an operative constitutional principle. His judgments on the rights of minorities reflect a remarkable empathy for the plight of the disadvantaged. Democracy informed all aspects of his constitutional thinking. Dickson rejected the contention that judicial review is anti-democratic, and his constitutional legacy reflects a sustained effort to harmonize all four fundament …

The Court in Apprendi v. New Jersey, ___ U.S. ___ (2000), held as a matter of due process that any fact, other than a prior conviction, that increases the penalty for an offense beyond the prescribed statutory maximum must be submitted to a jury and proven beyond a reasonable doubt. In a longer forthcoming article, we attempt to answer some of the profound questions raised by the case concerning constitutional oversight of legislative authority to define what is a "crime," questions that will ripen over the years as legislatures look for ways around the rule and litigants test these legislative …
