Adolescents And Young Adults In Transition: From Homelessness To Permanent Housing, Tona L. Willand

Theses and Graduate Projects

This study explores the intrapersonal and environmental factors associated with change in the transition from homelessness to permanent housing from the perspective of young women who have experienced it. Three young women were interviewed face-to-face in semi-structured interviews, using a non-probability convenience sample. Content analysis was used to identify intrapersonal and environmental factors that affected the process of change. Research participants identified goal-directed behavior, persistence and hope as intrapersonal factors in effecting change. Supportive relationships and practical assistance were identified as supportive factors in the transition period. The findings are discussed in relation to research from the literature, and the …

Privacy, Publication, And The First Amendment: The Dangers Of First Amendment Exceptionalism, Richard A. Epstein

Articles

The coordination of common law and constitutional norms are of pressing importance on matters of freedom of speech. In the Supreme Court and elsewhere, it is possible to discern two sharply inconsistent attitudes toward this question. One view holds that the First Amendment simply prevents any legislative backsliding from the common law rules that protect freedom of speech and of the press, much as they protect freedom of contract and freedom of action generally. On this view, the standard rule governing damages and injunctive relief apply to speech much as they do anywhere else. On the alternative view of what …

Thoughts On Some Potential Appellate And Trial Court Applications Of Therapeutic Jurisprudence, Steve Leben Jan 2000

Thoughts On Some Potential Appellate And Trial Court Applications Of Therapeutic Jurisprudence, Steve Leben

Seattle University Law Review

To date, the application of therapeutic jurisprudence principles has been concentrated mainly on specialized trial courts: drug treatment courts, domestic violence courts, criminal courts, and juvenile and family courts. Its application to trial courts generally, as well as its application to the appellate courts, remains largely unexplored. This Article considers three areas in which trial and appellate courts may want to consider applying therapeutic jurisprudence.

Is Lowering The Age At Which Juveniles Can Be Transferred To Adult Criminal Court The Answer To Juvenile Crime? A State-By-State Assessment Jan 2000

Is Lowering The Age At Which Juveniles Can Be Transferred To Adult Criminal Court The Answer To Juvenile Crime? A State-By-State Assessment

San Diego Law Review

The trend toward "get tough" policies concerning juveniles has swept through just about every state in the nation, affecting younger and younger minors. In Texas in 1997, not long after a tougher law was passed, a fourteen-year-old girl accused of murder became the youngest juvenile ever to stand trial as an adult in Tarrant County. Texas lowered the age from fifteen to fourteen in a 1995 revision of the state's juvenile justice code. In Michigan, an eleven-year-old boy, Nathaniel Abraham, became one of the youngest persons in the United States to be tried for murder as an adult; he allegedly …

A Primer On The Civil Trial Of A Sexually Violent Predator, Joan Comparet Cassani Jan 2000

A Primer On The Civil Trial Of A Sexually Violent Predator, Joan Comparet Cassani

San Diego Law Review

Involuntary commitment' for sexually violent predators became the law in California in 1996. This law, the Sexually Violent Predator Act, provides for a civil jury trial.! This trial is unique, since some of the procedural protections afforded a criminal defendant apply. For example, a unanimous jury must find, beyond a reasonable doubt, that the individual is a sexually violent predator.

The Act provides for the treatment of the individual if committed, and carefully crafts the procedures for the mental health evaluation and review process. Unfortunately, the part of the statute that provides for the civil trial is not as tightly …

Studies Of Grief: Narratives Of Incarcerated Women Who Experienced The Death Of A Significant Person While In Prison, Ginette Gosselin Ferszt Jan 2000

Studies Of Grief: Narratives Of Incarcerated Women Who Experienced The Death Of A Significant Person While In Prison, Ginette Gosselin Ferszt

Open Access Dissertations

One of the most important issues that an individual confronts during one's life is the death of a significant person. Given the contextual nature of grief, incarcerated women are faced with unique challenges when the death of a person occurs during their imprisonment. Yet, little is known about grief experiences under these circumstances.

The research questions guiding this qualitative study were: What are the meanings of the grief experience of incarcerated women? How does their grieving process compare with images of grief depicted as a normal process? To what extent do the women perceive incarceration influencing their grief? In-depth interviews …

A Matter Of Principle And Consistency: Understanding The Battered Woman And Cultural Defenses, Sharan K. Suri Jan 2000

A Matter Of Principle And Consistency: Understanding The Battered Woman And Cultural Defenses, Sharan K. Suri

Michigan Journal of Gender & Law

To adequately explain and argue why feminists, as a matter of legal theory, must take both the BWS and cultural defenses seriously, these defenses need further elaboration. Section I details what these defenses are, how they developed, and how they work in the justice system. Section II enlarges the picture by revealing the similarities between the two defenses which share not only the same theoretical and practical goals, but also the same criticisms and flaws highlighted by scholars. Finally, Section III asserts that cultural evidence and evidence of battering must be admitted to show the absence of mens rea. However, …
