Variables And Risk Factors In Day Care Settings, Ruth B. Schumacher Ph.D., Rebecca S. Carlson B.M.
Electronic Journal for Inclusive Education
Objective: This article was developed to identify the variables associated with abuse of children in day care centers and homes, and to specify risk factors to guide professionals and parents.
Method: The literature regarding child abuse [physical (PA), sexual (SA), and ritual (RA)] was reviewed, with emphasis on identification of variables associated with victims, perpetrators, and settings. Three factors increased the complexity of the review: (1) Differences in definition and categorization complicated study comparison. (2) Emotional tone affected some reviewers' definitions, methodology, and conclusions. (3) Some aspects of child abuse in day care homes and centers have not been well …

"Trapped" In Sing Sing: Transgendered Prisoners Caught In The Gender Binarism, Darren Rosenblum
"Trapped" In Sing Sing: Transgendered Prisoners Caught In The Gender Binarism, Darren Rosenblum
Michigan Journal of Gender & Law
This Article first summarizes gender, transgendered identity, and legal issues facing transgendered people to contextualize the lives of transgendered prisoners. Parts II and III explore respectively the placement and treatment issues that complicate the incarceration of the transgendered. Corrections authorities, through indifference or incompetence, foster a shockingly inhumane daily existence for transgendered prisoners. In Part V, I examine the plight of transgendered prisoners through the metaphor of the miners' canary. Transgendered prisoners signal the grave dangers facing all of us in a wide array of social structures, elucidating the apparently intractable problems of gender. This Article simultaneously explores a human …

Punishment, Postgenocide: From Guilt To Shame To Civis In Rwanda, Mark A. Drumbl
Punishment, Postgenocide: From Guilt To Shame To Civis In Rwanda, Mark A. Drumbl
Scholarly Articles
Following the 1994 Rwandan genocide, national and international trials set out to encourage national reconciliation, promote peace, punish perpetrators, foster a culture of human rights, and effect justice. In this Article, Professor Mark Drumbl questions the ability of these trials to achieve these goals and suggests they may in fact aggravate ethnic identity politics, thereby threatening Rwanda's long-term stability. He argues that the highly interdependent yet dualist nature of Rwandan society, together with the widespread level of participation in and victimization by the genocide, create a situation where accountability for the violence and the deterrence of future violence can be …

"On Horror's Head Horrors Accumulate": A Reflective Comment On Capital Child Rape Legislation, J. Richard Broughton
"On Horror's Head Horrors Accumulate": A Reflective Comment On Capital Child Rape Legislation, J. Richard Broughton
Duquesne Law Review
The constitutionality of imposing capital punishment for the crime of child rape remains an open question. The author asserts that state capital child rape statutes are constitutional. The author bases his conclusion on the United States Supreme Court's capital punishment decisions, the historical treatment of sex offenses and non-homicide capital crimes, and the brutality of rape, itself. Finally, the author urges caution to ensure that capital punishment is not meted out in a racially discriminatory manner.
The Approaching Death Of The Collective Right Theory Of The Second Amendment, Roger I. Roots
The Approaching Death Of The Collective Right Theory Of The Second Amendment, Roger I. Roots
Duquesne Law Review
The notion that the Second Amendment right to bear arms is a collective rather than an individual right has persisted even though it has been buried by scholarly criticism. The author predicts that the collective right theory will finally collapse under the pressure of this scholarly criticism and the historical evidence that such a theory was not contemplated by the Founders when the Constitution and the Bill of Rights were created. According to the author, the federal district court decision in United States v. Emerson may be the impetus for this impending demise.

Crime, Punishment, And Romero: An Analysis Of The Case Against California's Three Strikes Law, Brian P. Janiskee, Edward J. Erler
Duquesne Law Review
In a well-received study, Crime and Punishment in California: The Impact of Three Strikes and You're Out, Franklin E. Zimring, Sam Kamin, and Gordon Hawkins assert that California's Three Strikes law has failed to deter crime. The authors submit that the study has not provided sufficient statistical evidence to prove that Three Strikes does not deter crime. The authors argue that the statistical methodology employed in the study was flawed, and that this flaw created a distorted view of the deterrent effect of Three Strikes. The authors do not attempt to demonstrate that Three Strikes deters crime; however, they …
No Women At The Center: The Use Of The Canadian Sentencing Circle In Domestic Violence Cases, Rashmi Goel
No Women At The Center: The Use Of The Canadian Sentencing Circle In Domestic Violence Cases, Rashmi Goel
Sturm College of Law: Faculty Scholarship
For Canadian Aboriginal women, domestic violence is pervasive. A report by the Ontario Native Women’s Association indicates that eighty percent of Aboriginal women surveyed had personally experienced family violence. In this context, Rashmi Goel looks at the use of sentencing circles to respond to wrongdoing by Aboriginal people. Current Aboriginal justice initiatives emphasize a return to traditional values and processes, manifested in one way in the sentencing circle. Yet, states Goel, such initiatives fail to restore Aboriginal women to their honored place. Contemporary Canadian sentencing circles exemplify this problem; they further injure victims in several respects. Hence, Goel argues that …
