The purpose of this descriptive study was to examine whether or not selected variables used in the admission process can predict and the extent to which they can predict whether or not the student will graduate from an associate degree nursing program. The independent variables for this study were: Licensed Practical Nurse (LPN), number of courses completed prior to beginning the nursing program, the pre-admission Grade Point Average (GPA), the number of science courses completed pre-nursing, the number of courses repeated to earn a grade of C or better pre-nursing, and the number of hours transferred from other institutions of …

A Failed Eldorado: British Trusteeship, Luyia Land Rights And The Kakamega Gold Rush, 1930-1952., Priscilla Muronji Shilaro

This study analyzes the operations of British trusteeship with regard to Luyia land rights in Western Kenya between 1930 and 1952, using the Kakamega gold rush as a case study. It examines the determinant factors and interests, both imperial and local, that influenced and shaped the promulgation and adoption of the Native Land Trust Ordinance, 1930; and details how the gold discovery in North Kavirondo reserve in 1931 led to drastic land policy reversal entailed in the Native Land Trust (Amendment) Ordinance, 1932. The social norm movement in criminal justice has received a lot of attention in academic and public policy circles. This essay critically examines social norm writings and explores some of the implications for methods of proof and research design in the social sciences. In the process, the essay offers an alternative theoretical approach. This alternative focuses on the multiple ways in which the social meaning of practices (such as juvenile gun possession, gang membership, or disorderly conduct) and the social meaning of policing techniques (such as juvenile snitching policies, youth curfews, or order-maintenance policing) may shape us as contemporary subjects …

The law influences the behavior of its citizens in various ways. Well understood are the direct effects of legal rules. By imposing sanctions or granting subsidies, the law either expands or contracts the horizon of opportunities within which individuals can satisfy their preferences. In this way, society can give incentives for desirable behavior. The direct effects of legal rules on individual behavior have been a fruitful source of inquiry for analysts using the techniques of law and economics. Modeling the incentive effects of legal rules provides a useful predictive tool for positive theory and normative critique. Indeed, the tools of …

The distinguished scholars who gathered last year to honor Ian Macneil and to reflect on his contributions to the understanding of contract and contract law represent diverse methodologies, and they approach the vexing problems raised by relational contracts from different normative perspectives. But on one point, I daresay, they all agree: the central task in developing a plausible normative theory of contract law is to specify the appropriate role of the state in regulating incomplete contracts. Complete contracts (to the extent that they exist in the real world) are rarely, if ever, breached since by definition the payoffs for every …

The October 1999 Term was a year of consolidation in the law of police investigations in constitutional criminal procedure. In four short and compact opinions – three supported by sizeable majorities and three written by the Chief Justice – the Supreme Court synthesized and consolidated its criminal procedure jurisprudence, and offered clear guidance to law enforcement officers and private citizens alike. Miranda warnings are required by the Fifth Amendment, and the police must continue to "Mirandize" citizens before conducting any custodial interrogations. Reasonable suspicion under the Fourth Amendment calls for a totality-of-the-circumstances test, and a citizen's flight from the police …

Americans seem to be of two minds about the death penalty. In the last several years, the overall number of executions has risen steeply, reaching a fifty year high this year. Although two-thirds of the public support the penalty, this figure represents a sharp decline from the four-fifths of the population that endorsed the death penalty only six years ago, leaving support for capital punishment at a twenty year low. When life without parole is offered as an alternative, support for the penalty drops even more – often below a majority. Grants of executive clemency reached a twenty year high …

Patterns of "stop and frisk" activity by police across New York City neighborhoods reflect competing theories of aggressive policing. "Broken Windows" theory suggest that neighborhoods with greater concentration of physical and social disorder should evidence higher stop and frisk activity, especially for "quality of life" crimes. However, although disorder theory informs quality of life policing strategies, patterns of stop and frisk activity suggest that neighborhood characteristics such as racial composition, poverty levels, and extent of social disorganization are stronger predictors of race- and crime-specific stops. Accordingly, neighborhood "street stop" activity reflects competing assumptions and meanings of policing strategy. Furthermore, looking …

Traditionally job performance aids were only considered repositories for information and substitutes for training. There is a growing bipartisan consensus that flaws in America's death-penalty system have reached crisis proportions. Many fear that capital trials put people on death row who don't belong there. Others say capital appeals take too long. This report – the first statistical study ever undertaken of modern American capital appeals (4,578 of them in state capital cases between 1973 and 1995) – suggests that both claims are correct.
Capital sentences do spend a long time under judicial review. As this study documents, however, judicial review takes so long precisely because American capital sentences are so persistently and systematically fraught …

The study analyses trends in research activities in the sciences using data from theses submitted to the University of Malaya between 1971 and 1995. A total of 101 theses in nine disciplines in the sciences were studied during the 25- year period (1971-1995). The study is divided into two parts. The primary aim of this study was to assess the information needs of foreign women in Malaysia, with a particular focus on the Sudanese community. The study identified the main information needs, the sources they used to find the information, their use of the library and the types of materials they utilized in seeking information. A postal questionnaire was used for data collection. Ninety copies of questionnaires were distributed to the Sudanese women living in Kuala Lumpur and Petaling Jaya. Portraits of faculty form the largest part of the collection, also photos of: campus, buildings, students, staff, and events on campus. Especially: graduation, sports and beauty pageants. Some of the photos were published in The Geechee, Armstrong’s yearbook for 1967 and 1968, the yearbook was used to help identify the persons photographed.

Since start of the Asian Economy crisis in 1997, most industries in Malaysia have been experiencing a difficult time. Tourism industry had to face several challenges such as currency fluctuations, negative media reports, stringent government policies, reduced market demands and global competition. The negative effects on the industry were compounded by the national economic slowdown, i.e., GDP contraction of 6.7 per cent in 1998. The purpose of this study was to investigate the relationship between maternal employment and adolescent Adjustment. Adjustment in this research divided into two category, that is Personal Adjustment and Social Adjustment. Personal Adjustment has six sub-scales, namely Self Reliance, Sense Of Personal Worth, Sense Of Personal Freedom, Sense of Belonging, and Withdrawing Tendencies. This study analysed Malaysian computer science and information technology research works published within the period 1990 and 1998. The data was collected from three international CD-ROM databases. i.e.. COMPENDEX (1987- 1999), IEL (IEE/IEEE Electronic Library) (1988- 1999). and INSPEC (1990- 1998). The search contributed a total of 389 bibliographic records. Malaysian research contribution in the fields of computer science and in formation technology between 1990 and 1998 indicated two stages of development, i.e.. the exploration period from 1990 to 1994 and the rapid growth period during 1995 to 1998. In this paper, we use the case of Chinese religion in Singapore to examine the relationships between religion and modernity, and between social processes, on the one hand, and spatial conceptions, forms and structures and temporal practices, on the other. Specifically, we look at how traditional Chinese rituals are being modified, reinterpreted and invented to fit with modern living. Such ritual transformations entail reconstructed notions of space and time. Through such transformations, modernity does not simply lead to the demise of religious beliefs and practices but allows for a continued role for religion in providing a meaning system for Chinese …
