A Realistic Consensus Approach To The Insurance Law Doctrine Of Reasonable Expectations, Peter N. Swisher

Law Faculty Publications

This article's fundamental premise is that, over the past three decades, despite all the debate and confusion surrounding the underlying theory and practice of the insurance law doctrine of reasonable expectations, a modem consensus approach has finally emerged within the academic community and the courts and among insurance law practitioners involving a realistic and viable application of the doctrine to the needs of contemporaryground" synthesis of traditional, objective, and contractually based reasonable expectations principles grafted onto elements of the more modem Keeton formulation of the doctrine. Moreover, this realistic consensus approach to the doctrine of reasonable expectations is both theoretically …

Similarities And Differences In European Conceptions Of Human Resource Management: Toward A Polycentric Study, Timothy Adrian Robert Clark, Derek Pugh

Research Collection Lee Kong Chian School Of Business

Increasingly managers need to distinguish between those oftheir activities and practices that can be successfully transferred acrossnational boundaries and those that will require modification in view ofdivergences between national settings. This can be determined by initiallyidentifying those features of managing organizations that remain similar acrossnational boundaries and those that are different, and then ascertaining thestrength of the forces for convergence or divergence. This article describes anexploratory attempt to conduct a polycentric (in the terms described below)research study of conceptions of human resource management in seven Europeancountries. It examines whether there is a single, shared conception of HRM thattranscends national boundaries, …

Arabica coffee was sampled from two sites in the central highlands of Kenya (Rurima, Ruiru) and one site on the western side of the Rift Valley (Koru). Three species of ceratitidine Tephritidae, Ceratitis capitata (Wiedemann), C. rosa Karsch and Trirhithrum coffeae Bezzi, were reared from sites in the central highlands, and an additional species, C. anonae Graham, was recovered from the western-most site. Ten species of parasitic Hymenoptera were reared from these tephritids. The parasitoid assemblage was dominated by koinobionts. Eight of the species are koinobiont endoparasitoids, but only one idiobiont larval ectoparasitoid was reared, and only one idiobiont pupal …

A Study Of High School Counselors Value Of Scans/Noicc Work Competencies Among Three Groups Of Students: At-Risk, Work-Bound And College-Bound, Alice Mitchell Rose

Theses and Dissertations

The purpose of this study was to investigate the value high school counselors assign to the fourteen national work competencies identified by the Secretary’s Commission on Achieving Necessary Skills (Author, 1991) and the National Career Development Guidelines (National Occupational Information Coordinating Committee, [NOICC] 1989) among different groups of students: at-risk, work-bound, and college bound. Rising national concern about economic competitiveness in the global marketplace has dictated the need to provide all students with the skills necessary to enter the workforce.

Two research questions were explored in this quantitative study. The data were acquired via a questionnaire adapted from a similar …

Human Agency And The Process Of Social Change In The Religious Structure Of A Traditional Society, Jonathan Mermis-Cava

Cal Poly Humboldt theses and projects

This thesis is an examination of human agency within the process of social change as it has been displayed by the members of a traditional society. It is based on participant observation data that was collected between 1995-97 when the author served as a Peace Corps Volunteer living amongst a tribe of maroons, known as Saramakans, deep in the rainforest of South America. Exploring the assumption that changes in traditional societies have been forced upon them, this thesis examines the transformations that have occurred in the religious structure of the Saramakan tribe. From a social constructionist theoretical viewpoint, data suggests …

The Internet As A Source Of Informal Social Control: Social Support In Pedophile Online Culture, Teelynn T. Mauney

Cal Poly Humboldt theses and projects

This thesis is an examination of pedophile use of the World Wide Web as a source of social support. I conduct a content analysis of pedophile Web sites that advocate sexual contact between men and boys. The themes on these sites are examined and compared to the themes found in stage one of my research program, which analyzed four of the eleven sites in the pedophile Web site sampling frame. This monograph draws on Mirkin’s (1999) theoretical framework that states that pedophiles are in stage one of a battle to legitimize their sexual orientation. This study finds that pedophile sites …

Successful Aging And Positive Deviance: A Sociological Investigation Of Eccentrics, Missy A. Peterson Jan 2000

Successful Aging And Positive Deviance: A Sociological Investigation Of Eccentrics, Missy A. Peterson

Cal Poly Humboldt theses and projects

Successful aging has long been a focus in aging studies. Previous researchers have formulated bipolar theories, examined groups of successful-agers, and tested many variables thought to contribute to successful aging. Defined as the most effective way for the older person to adapt to the physical, psychological, and social changes that occur in later life, other research has suggested that successful aging might even be a matter of subjective definition. The main purpose of this thesis was to examine a group of older individuals who were thought to be successfully aging. Since findings generated from the pioneering research of Weeks and …

Who Exactly Is Living La Vida Loca: The Legal And Political Consequences Of Latino-Latina Ethnic And Racial Stereotypes In Film And Other Media, Ediberto Román Jan 2000

Who Exactly Is Living La Vida Loca: The Legal And Political Consequences Of Latino-Latina Ethnic And Racial Stereotypes In Film And Other Media, Ediberto Román

Faculty Publications

This piece, however, will not simply expose the insidious stereotypes of Latinas and Latinos. It will undertake the more involved task of drawing a nexus between the societal prejudice which leads to the stereotyping and the legal and political consequences that result from it. Specifically, I argue that these media images, myths, metaphors, and stereotypes play a critical role in establishing society's vision of Latinas and Latinos. In other words, these stereotypes serve to reinforce both the characterizations of Latinas and Latinos from the perspectives of both the dominant and the dominated. These stereotypes, in turn, foster and perpetuate two …

A Race Approach To International Law (Rail): Is There A Need For Yet Another Critique Of International Law, Ediberto Román Jan 2000

A Race Approach To International Law (Rail): Is There A Need For Yet Another Critique Of International Law, Ediberto Román

Faculty Publications

This work reviews an important shortcoming of the dominant public international paradigm and the recent methodical responses to that edifice. Specifically, this article argues that issues of race have not been significantly addressed in international law discourse. In particular, this Article notes that in the theoretical discourse some writers have discussed race, but the thrust of the discourse marginalizes the importance of race. In the practice of international law, people of color are affected but rarely recognized in policy debates. Additionally, this work attempts to explain how a discourse that positions race at the center of the discourse increases the …

The first achievement is her ground-breaking work on dependency, about which we will say more later. The second is her equally influential Feminist Theory Workshop, which she began at the University of Wisconsin, and has since moved to Columbia University and now to Cornell. The annual Workshop has provided the opportunity for scores of scholars to present papers related to feminist jurisprudence, helping …

Foreword-Symposium: Straightening It Out: Joan William On Unbending Gender, Adrienne D. Davis Jan 2000

Foreword-Symposium: Straightening It Out: Joan William On Unbending Gender, Adrienne D. Davis

Scholarship@WashULaw

As most men and women acknowledge, gender is a battleground. Most of us are fairly clear on biological sex: who bears children, who ejaculates sperm, even whose (big) hands might open a stuck jar and whose (smaller ones) could pull that cufflink out of the garbage disposal. What remains less clear is how social gender roles flow from this: Does lactation result in eighteen years of primary caregiving? Should the chemical realities of testosterone shape the law governing sexual assault? 3 Should the dynamics of heterosexual relationships mirror the physics of heterosexual intercourse (penetration equals power)? Does the reality of …

Establishing The Research Foundations For Successful Client-Server Computing: What Naturalistic Studies Could Contribute, Patricia Y. Logan, Charles M. Lutz Jan 2000

Establishing The Research Foundations For Successful Client-Server Computing: What Naturalistic Studies Could Contribute, Patricia Y. Logan, Charles M. Lutz

The Qualitative Report

What is the nature of the process of implementing a new technology? How should the dynamics of implementing a new technology be studied? What research methods are best-suited to the study of complex issues of social and organizational impacts arising from the implementation of a new technology? Client-server computing represents a significant new technology that has not been a focus of research investigations. As companies pursue client-server technology as a replacement for legacy computing systems, there is a need to provide practitioners with grounded research that discover patterns of organizational and social dynamics that influence the successful outcome of a …

Constant Comparison Method: A Kaleidoscope Of Data, Jane F. Dye, Irene M. Schatz, Brian A. Rosenberg, Susanne T. Coleman

The Qualitative Report

This paper will attempt to illustrate the use of a kaleidoscope metaphor as a template for the organization and analysis of qualitative research data. It will provide a brief overview of the constant comparison method, examining such processes as categorization, comparison, inductive analysis, and refinement of data bits and categories. Graphic representations of our metaphoric kaleidoscope will be strategically interspersed throughout this paper.
