Law And The Biology Of Rape: Reflections On Transitions, Owen D. Jones Jan 2000

Law And The Biology Of Rape: Reflections On Transitions, Owen D. Jones

UC Law SF Journal on Gender and Justice

The effectiveness of the legal system in preventing rape depends, in part, on the accuracy of the model of rape behavior on which it relies. To date, most models of rape reflect the disciplinary isolation of their proponents. In this article, Professor Jones argues that integrating life science and social science perspectives on sexual aggression can improve law's model of rape behavior and further our efforts to reduce the .incidence of rape. Extending his prior work on law, biology, and sexual aggression, Professor Jones addresses both why law's model of rape behavior can usefully incorporate insights from biobehavioral science in …

An Ethical Exploration Of Gender Inequality In Church Leadership, Elizabeth Rickert Jan 2000

An Ethical Exploration Of Gender Inequality In Church Leadership, Elizabeth Rickert

Honors Theses

An Ethical Exploration of Gender Inequality in Church Leadership provides a moral analysis of the current status of women leaders in the church. Drawing on socio- analytical, ethical-theological, and leadership studies perspectives, this thesis sheds light on the disparity between the theological principles of equality and the ecclesiastical practices of inequality that create an unhealthy moral environment in churches.

Gender inequality in church leadership exists today in both the congregations permitting the ordination of women as well as in those that do not. This widespread discrepancy between rules and practices concerning women leaders in the church points to the socially …

The Clapham Sect : An Investigation Into The Effects Of Deep Faith In A Personal God On A Change Effort, Victoria Marple Jan 2000

The Clapham Sect : An Investigation Into The Effects Of Deep Faith In A Personal God On A Change Effort, Victoria Marple

Honors Theses

This study was undertaken primarily out of an apparent inability of leadership material to answer the question of "Why" in their studies of change efforts. Despite many scholarly materials on how societal alterations occurs and steps to make social action successful, little has been written regarding the internal influences on individuals involved in these efforts and on how these influences make the leader or group successful. This particular case study has been chosen because of its clear portrayal of various leadership theories including catalytic leadership, charismatic leadership and change theory. Moreover, writings about the Clapham Sect clearly evidence that the …

The Value Of Dissent, Lawrence B. Solum Jan 2000

The Value Of Dissent, Lawrence B. Solum

Georgetown Law Faculty Publications and Other Works

This essay reviews Dissent, Injustice, and the Meanings of America by Steven H. Shiffrin (1999).

Theorizing about the freedom of speech has been a central enterprise of contemporary legal scholarship. The important contributions to the debate are simply far too numerous to categorize. One ambition of this theorizing is the production of a comprehensive theory of the freedom of expression, a set of consistent normative principles that would explain and justify First Amendment doctrine. Despite an outpouring of scholarly effort, the consensus is that free speech theory has failed to realize this imperial ambition. Rather than searching for the global …

Telling Stories In School: Using Case Studies And Stories To Teach Legal Ethics, Carrie Menkel-Meadow Jan 2000

Telling Stories In School: Using Case Studies And Stories To Teach Legal Ethics, Carrie Menkel-Meadow

Georgetown Law Faculty Publications and Other Works

In this Foreword I will explore why we use stories and case studies (and whether stories and case studies are equal to the task) to examine ethical and moral issues in the practice of law and provide an introduction to the interesting tales which will enfold in this Symposium issue. I conclude with some thoughts about how stories and cases should be used to teach legal ethics.

The Constitution Of Civil Society, Mark V. Tushnet Jan 2000

The Constitution Of Civil Society, Mark V. Tushnet

Georgetown Law Faculty Publications and Other Works

This Article . . .sketches how the free expression, freedom of religion, and substantive due process provisions of the U.S. Constitution have been interpreted to define and protect families, religious institutions, non-political associations, and political parties. I have organized the discussion by topics rather than by institutions. The next section examines the ways in which constitutional law defines civil society's institutions, and Section III examines the extent to which it allows government to regulate them. Section IV deals with the constitutional restrictions on government's power to give unconditional or conditional grants to civil society's institutions. The Conclusion returns to the …

Crossing The River Of Blood Between Us: Lynching, Violence, Beauty, And The Paradox Of Feminist History, Emma Coleman Jordan Jan 2000

Crossing The River Of Blood Between Us: Lynching, Violence, Beauty, And The Paradox Of Feminist History, Emma Coleman Jordan

Georgetown Law Faculty Publications and Other Works

Understandably, early feminist legal theory and history focused almost exclusively on establishing white women's autonomy against white male dominance. The vehicles of nineteenth century women's liberation included elements of public equality such as ownership of property, the right to vote, access to male dominated occupations, equal education and employment opportunity. Twentieth century feminists extended the equality project by penetrating the "private" sphere and attacking the very notion of a separate zone of family relations which was immune from government intervention to protect women from male abuse. Cultural feminists like Carol Gilligan took another approach, arguing that women's experiences as sexual …

Willard Hurst And The Administrative State: From Williams To Wisconsin, Daniel R. Ernst Jan 2000

Willard Hurst And The Administrative State: From Williams To Wisconsin, Daniel R. Ernst

Georgetown Law Faculty Publications and Other Works

This article follows Willard Hurst from his undergraduate days at Williams College through the start of his teaching career at Wisconsin in the fall of 1937. During these years Hurst acquired an abiding interest in the rise of the administrative state as well as some of the insights he would use to account for it in his mature work. For the most part, the article proceeds chronologically through four episodes in Hurst's training: (1) his year-long study of Charles and Mary Beard's "Rise of American Civilization" undertaken as an undergraduate at Williams College; (2) his three years as a student …

A Guide For Personal Testimony: The Art Of Using Your Personal Experiences To Influence Policy Decisions, Tom Seekins Ph.D., Stephen B. Fawcett, University Of Montana Rural Institute

Independent Living and Community Participation

The quality of life in any community is determined to some extent by the laws and policies of governmental units and agencies. One way of changing community conditions is to change the laws and policies. From a group’s perspective, any proposed change may be for the better or the worse. However, for changes in laws, regulations, or policies to occur, a public hearing is often required. During public hearings, people have an equal opportunity speak either for or against proposed changes. Many different types of testimony can be and usually are provided during public hearings. These may range from detailed, …

A Guide To Writing Letters To Public Officials: Contributing To Important Decisions Affecting You And Others, Tom Seekins Ph.D., Stephen B. Fawcett, University Of Montana Rural Institute Jan 2000

A Guide To Writing Letters To Public Officials: Contributing To Important Decisions Affecting You And Others, Tom Seekins Ph.D., Stephen B. Fawcett, University Of Montana Rural Institute

Independent Living and Community Participation

A well-written personal letter may be the most effective way to communicate with public officials. They want to know how their constituents feel about issues, especially when those issues involve decisions by elected officials. Public officials usually know what lobbying groups are saying about an issue, but often they do not understand how a particular decision affects you. A well-written letter describing your experiences, observations, and opinions may change an official’s mind. The same guidelines are also useful for writing to private officials such as business owners, executives of groups like the chamber of commerce, or presidents of corporate boards …

A Guide To Writing Letters To The Editor: Expressing Your Opinion To The Public Effectively, Tom Seekins Ph.D., Stephen B. Fawcett, University Of Montana Rural Institute

Independent Living and Community Participation

One way to express your opinion publicly is through a letter to the editor in your local newspaper. While every letter may not be published, editors pay attention to well-written letters. This is especially true when there are many letters written on the same topic. In turn, elected officials are also influenced by letters newspapers have chosen for publication. This guide will help you prepare an effective letter to the editor that expresses your opinion on an issue. It includes two letters about a controversial issue and specific guidelines on how to prepare a successful letter yourself. After you read …

Redemption And Recovery: An Ethnographic Comparison Of Two Drug Rehabilitation Programs, A Faith Community And A Therapeutic Community, Daniel E. Hood Jan 2000

Redemption And Recovery: An Ethnographic Comparison Of Two Drug Rehabilitation Programs, A Faith Community And A Therapeutic Community, Daniel E. Hood

Dissertations, Theses, and Capstone Projects

This ethnography of long-term residential programs for drug users compares a therapeutic community (TC) with an evangelical Christian "training program." Using participant observation and life history interviews, it pursues three themes. The first is comparative and descriptive. It poses a basic similarity between the ideologically disparate programs. Parallels in program process and personal experience of "identity transformation" (conversion) are described. Despite the religious/secular divide, important similarities in anthropological assumptions are also identified. Contrary to earlier research, the singularity of the clientele is demonstrated. Other parallels include the ritual function of prayer and encounter, the centrality of selective biographical reconstruction, and …

"I'M Right There": Central Appalachian Women In Public School Leadership., Kathy L. Seelinger Jan 2000

"I'M Right There": Central Appalachian Women In Public School Leadership., Kathy L. Seelinger

Graduate Theses, Dissertations, and Problem Reports (ETD)

Despite a deluge of national attention to equity issues, public school administration is still the domain of men. Research attention to women in leadership has done little to close the gender gap in superintendents' and secondary school principals' offices, perhaps because of its focus on successful men rather than on the women who hold these positions. Qualitative interviews examine seven central Appalachian women school leaders in light of feminist standpoint theory, focusing on the way the women enter leadership, articulate a personal construction of the leadership role, and negotiate the borders between their own constructions and the prevailing ones. Profiles …

The Establishment Of A Lay Evangelism School At The Ephesus Sda Church In Richmond, Virginia, Gene Michael Donaldson Jan 2000

The Establishment Of A Lay Evangelism School At The Ephesus Sda Church In Richmond, Virginia, Gene Michael Donaldson

Doctor of Ministry Projects

Problem

Sharing the good news is an imperative issued by the Supreme Commander, Jesus Christ for all who call Him Lord. Every member of the church is a minister with the responsibility to bring others to faith. The mandate to witness to others in the context of the three angels message of Revelation 14 is of paramount importance to the Seventh-day Adventist Christian. The purpose of this study was to prepare a training program to equip lay persons in the Virginia area churches of the Allegheny East Conference on how to bring others to faith.

Method

An equipping course called, …
