Achieving transformational change is a scholarly challenge best dealt with by practicing public scholarship, which is modeled by the leader and encouraged in other members of the campus community. Like all good scholarly work, good decision making by campus leadership begins with a base of scholarly knowledge generated and validated by higher education researchers.

“Gay Rights” For “Gay Whites”?: Race, Sexual Identity, And Equal Protection Discourse, Darren Lenard Hutchinson Jul 2000

“Gay Rights” For “Gay Whites”?: Race, Sexual Identity, And Equal Protection Discourse, Darren Lenard Hutchinson

UF Law Faculty Publications

While the resolution of the problem of gay and lesbian inequality will ultimately turn on a host of social, legal, political, and ideological variables, this Article argues that the success or failure of efforts to achieve legal equality for gays, lesbians, bisexuals, and transgendered individuals will depend in large part on how scholars and activists in this field address questions of racial identity and racial subjugation. Commonly, these scholars and activists currently discuss race by use of analogies between “racial discrimination” and “sexual orientation discrimination,” or between “people of color” and “gays and lesbians.” On one level, the “comparative approach” …

Literature And The Arts As Antisubordination Praxis: Latcrit Theory And Cultural Production: The Confessions Of An Accidental Crit, Pedro A. Malavet

UF Law Faculty Publications

I attend LatCrit conferences to be educated on what I regard as the most exciting legal scholarship being produced today. Therefore, I naturally jumped at the opportunity to help organize the Fourth Annual LatCrit Conference and to chair one of its Plenary Panels. I have penned this Essay for the purpose not only of joining Critical Race Theory ("CRT") discourse, but also to create a recorded history of LatCrit travels.

In Part I of this Essay, I will describe the process that led the Planning Committee to include the Literature and Arts as Antisubordination Praxis: LatCrit Theory and Cultural Production …

Education Faculty Publications

Barbara Reed, now in her eighties, is an individual who, for over fifty years, has been a leader in both children's drama and storytelling (for children and adults). It is because of her tenacious love of the performing arts that they flourish—albeit in some places more than others-for us today. Because of her, the imaginative lives of children and adults continues cyclically, each generation passing onto the next the rich experiences to be found in drama and storytelling.

Interstate Cooperation And Educational Development In Nigeria., Bankole Oni Jul 2000

Interstate Cooperation And Educational Development In Nigeria., Bankole Oni

Bullion

The paper highlights on interstate cooperation and educational development in Nigeria. Education is a major instrument for economic and social development. The process of allocating resources to the sector vis-a-vis other sectors depends again on the political priorities of the decision makers. Whether or not different states, which belong to the same ideological camp, can and will cooperate in the field of education in future is not certain. The empirical analysis of existing facts have further strengthened the hypothesis that there exists a structural and cause - effect relationship between education and other aspects of the social structure. Political competition …

Freedom Of Conscience And The Court-Ordered Apology For Defamatory Remarks, Dai-Kwon Choi Jul 2000

Freedom Of Conscience And The Court-Ordered Apology For Defamatory Remarks, Dai-Kwon Choi

Cardozo Journal of International and Comparative Law

The article critiques the Korean Constitutional Court's decision that court-ordered apologies for defamation violate the freedom of conscience under the Korean Constitution. The author argues that this ruling is misplaced, as it should have focused on the chilling effect on freedom of the press rather than freedom of conscience. The analysis emphasizes the cultural significance of apologies in Korean society and questions the court's approach to constitutional review.

Expressing Oneself Without A Constitution: The Israeli Story, Zaharah R. Markoe Jul 2000

Expressing Oneself Without A Constitution: The Israeli Story, Zaharah R. Markoe

Cardozo Journal of International and Comparative Law

The note examines the challenges to freedom of expression in Israel, highlighting the absence of a written constitution and the tension between security concerns, religious influences, and democratic values. It argues that while the High Court of Israel has played a crucial role in protecting civil liberties, the lack of constitutional protections leaves freedom of expression vulnerable, particularly in cases involving national security and religious sensibilities.

Law & Literature And The Moderns: Explorations, George Anastaplo Jul 2000

Law & Literature And The Moderns: Explorations, George Anastaplo

Northern Illinois University Law Review

Law and Literature courses are intended, at least in part, to supply the sound moral understanding as well as the elementary intellectual skills that law students need before they can learn to read in the way that is needed for a profession which very much depends upon disciplined reading and writing. Unfortunately, many if not most of the texts drawn upon in the Law and Literature courses are, or are treated as if they were, of the third or fourth rank. These are texts which are mined in such courses for "cases" and legal issues rather than approached as texts …

Perceptions Of Police Abusive Behavior: Factors Influencing Citizens' Attitudes Toward The Police Use Of Excessive Force, Debra P. Laville-Wilson

Sociology & Criminal Justice Theses & Dissertations

This study analyzed several factors to determine their influence on the public's perceptions of the police use of excessive force or police brutality. Conflict theory and cognitive consistency theory were used to conceptualize the perceptions of police brutality. Based on these theories, five hypotheses were predicted. Secondary data from a 1995 National Opinion Survey of Crime and Justice were re-analyzed. The data provide 1,005 respondents for the analyses. Analyses were performed at the bivariate and multivariate level.

Findings from the bivariate analysis show that Blacks were three (3) times more likely than Whites to perceive the police use of excessive …

An Investigation Into The Relationship Between Language Attitudes And Academic Performance In Northampton County, Virginia, Public Schools, Glenda L. Rose

English Theses & Dissertations

This language attitude study targets third grade, fifth grade, eighth grade and high school students in the Northampton County, Virginia, Public School System. Two hypotheses were proposed. First, students exhibiting negative attitudes toward their own dialect have a lower performance level in language arts classes than students expressing positive attitudes. Second, factors such as sex, race, grade level, and level of exposure to other dialects are reflected in language attitudes. In order to determine the validity of these hypotheses, school officials were asked to identify five students performing well and five students having difficulty in the language arts. Ten third …

The present research study attempts to fill this void. The following research questions will be reviewed and evaluated throughout the current study: (1) What personal factors if any influence medical students' willingness or unwillingness to terminate a pregnancy; (2) Are medical students willing to perform abortions for the reasons that women are requesting them; …

Victimless Crime: A Comparison Of Public Offense Ratings Of Misdemeanor Offenses And Virginia Sentencing Guidelines, Theresa M. Dutton Jul 2000

Victimless Crime: A Comparison Of Public Offense Ratings Of Misdemeanor Offenses And Virginia Sentencing Guidelines, Theresa M. Dutton

Sociology & Criminal Justice Theses & Dissertations

This study was designed to explore the hypothesized gap between what state guidelines on criminal sanctioning recommend for misdemeanor offenses, and what the public perceives· as just punishment for these offenses. The research also addresses the issue of victimless crime. In this regard it was additionally hypothesized that there exists a significant difference in public opinion towards sentencing those crimes that specifically do not have a victim, with those that do.

The design of this study is based on one conducted by Peter Rossi and Richard Berk (Rossi and Berk 1997). For this study, a sample of students attending college …

Facilitative Mediator Responds, A, Zena Zumeta Jul 2000

Facilitative Mediator Responds, A, Zena Zumeta

Journal of Dispute Resolution

I appreciate the thoughtfulness and conclusions of Professor Jeffrey Stempel in his article. His title, "The Inevitability of the Eclectic," seems completely right to me. Most mediators I know who have had training in mediation are more eclectic than squarely in one camp or another. They use techniques that are geared both to their own personalities and to the needs of the case. This, indeed, is a level of sophistication that is a heartening indication of the maturity of the field of mediation. However, there are many points in Stempel's argument that I disagree with, including some of his most …
