Traces Of Violence: Gadamer, Habermas, And The Hate Speech Problem, R. George Wright Dec 2000

Traces Of Violence: Gadamer, Habermas, And The Hate Speech Problem, R. George Wright

Chicago-Kent Law Review

This Article offers fresh insight into the controversial issue of hate speech regulation by borrowing major themes from the works of Hans-Georg Gadamer and Jürgen Habermas. Wright emphasizes Gadamer's connection between language and historical traditions to demonstrate how hate speech differs from any real attempt at genuine speaking. Wright then focuses on Habermas's notion of a communicative ideal that helps differentiate between speakers who intend to invite open discourse and typical epithet speakers who likely have no such purpose. Wright concludes that the contributions of Gadamer and Habermas enable us to determine what types of speech promote the values underlying …

The New Deal At Work, Peter Cappelli Dec 2000

The New Deal At Work, Peter Cappelli

Chicago-Kent Law Review

The traditional employment system with secure, lifetime jobs offering predictable advancement and stable pay has given way to a new, more open-ended arrangement that is continually being negotiated between employer and employee. Evidence is presented both about the factors driving this new relationship and the subsequent changes in labor market outcomes. Tighter labor markets have, perhaps temporarily, shifted power from employers to employees, leading to new problems for employers and fundamental challenges to traditional models for management. These developments also raise new challenges for society and in particular to the long-standing interest in protecting employees from some of the destructive …

Don't Take His Eye, Don't Take His Tooth, And Don't Cast The First Stone: Limiting Religious Arguments In Capital Cases, John H. Blume, Sheri Lynn Johnson Dec 2000

Don't Take His Eye, Don't Take His Tooth, And Don't Cast The First Stone: Limiting Religious Arguments In Capital Cases, John H. Blume, Sheri Lynn Johnson

William & Mary Bill of Rights Journal

Professors John H. Blume and Sheri Lynn Johnson explore the occurrences of religious imagery and argument invoked by both prosecutors and defense attorneys in capital cases. Such invocation of religious imagery and argument by attorneys is not surprising, considering that the jurors who hear such arguments are making life and death decisions, and advocates, absent regulation, will resort to such emotionally compelling arguments. Also surveying judicial responses to such arguments in courts, Professors Blume and Johnson gauge the level of tolerance for such arguments in specific jurisdictions. Presenting proposed rules for prosecutors and defense counsel who wish to employ religious …

A Communitarian Critique Of The Child Protective System, Toni Terling-Watt Dec 2000

A Communitarian Critique Of The Child Protective System, Toni Terling-Watt

The Journal of Sociology & Social Welfare

Child Protective Services (CPS) has been defined as an ineffective system. Common criticisms are that the system is overburdened and that family preservation policy pressures CPS to reunite families that can't be repaired. However, empirical analyses that identify the deficiencies of this organization are limited. This study utilizes case files and in-depth interviews with interventionists within and outside of CPS to explore the issue. Results reveal that the most common criticisms of the system do have merit. However, it reveals additional system limitations. Results suggest that the child protective system is characterized by an individualistic approach and that this focus …

Job Stability And Wage Progression Patterns Among Early Tanf Leavers, Steven G. Anderson, Anthony P. Halter, George Julnes, Richard Schuldt Dec 2000

Job Stability And Wage Progression Patterns Among Early Tanf Leavers, Steven G. Anderson, Anthony P. Halter, George Julnes, Richard Schuldt

The Journal of Sociology & Social Welfare

This article reports on first-year employment experiences of a randomly selected sample of 213 Illinois TANF leavers. Aggregate employment levels were 70 percent at exit, and leavers typically generated earnings from a single full-time job. However, employment often was unstable, so that only about one-fourth of leavers had the same job both at exit and when interviewed 10-11 months later. Employment instability resulted from the marginal or temporary nature of many jobs, as well as employment barriers such as health problems and lack of day care. Average wage levels easily exceeded the minimum wage and grew during the first year …

Is Welfare Reform Working? A Study Of The Effects Of Sanctions On Families Receiving Temporary Assistance To Needy Families, Taryn Lindhorst, Ronald J. Mancoske, Alice Abel Kemp Dec 2000

Is Welfare Reform Working? A Study Of The Effects Of Sanctions On Families Receiving Temporary Assistance To Needy Families, Taryn Lindhorst, Ronald J. Mancoske, Alice Abel Kemp

The Journal of Sociology & Social Welfare

This research provides a preliminary descriptive analysis of the impact of new welfare sanctions on recipients living in a southern metropolitan region. The data from this phone survey indicate that many families report considerable hardship no matter why they exited from welfare. Compared to those who left voluntarily, those who were sanctioned off welfare were significantly different in terms of having unmet medical needs, going without food, and having their utilities turned off. Given the high number of problems reported and the low income reported by these respondents, it is not surprising to find that only 10 percent of former …

A Comparison Of The Characteristics Of Gardeners, Their Motivations For Gardening And Management Practices Of Blackacre Community Garden And Limerick Community Garden In Jefferson County, Kentucky., Robin Oxnard Grossman 1974- Dec 2000

A Comparison Of The Characteristics Of Gardeners, Their Motivations For Gardening And Management Practices Of Blackacre Community Garden And Limerick Community Garden In Jefferson County, Kentucky., Robin Oxnard Grossman 1974-

Electronic Theses and Dissertations

Using four surveys, two created by this researcher, another created by Walizcek, Mattson, and Zajicek, and a fourth created by Herbach, the researcher compared the characteristics of community gardeners, their motivations for gardening, and the management practices of the inner-city Limerick Community Garden and the suburban Blackacre Community Garden in Jefferson County, Kentucky. 33 Blackacre gardeners, 16 Limerick gardeners, two garden managers, and two garden administrators participated in the study. The researcher hypothesized that the location of the garden could be influential in determining who the gardeners are and what their motivations for gardening are. The inner-city garden was expected …

Gis-Based Decision Support For Drained Wetland Resoration In The Eel River Watershed Of N. E. Indiana, Xiangheng Yang Dec 2000

Gis-Based Decision Support For Drained Wetland Resoration In The Eel River Watershed Of N. E. Indiana, Xiangheng Yang

All-Inclusive List of Electronic Theses and Dissertations

The objective of this research is to develop cost-effect and accurate methods to identify optimal restorable drained wetland cropland sites. Landsat Thematic Mapper (TM) data analysis was used to identify the potential cropland candidate sites in the initial step. The result of digital TM data analysis shows that the overall classification accuracy in identifying classes of potential restoration candidate hydric soils is 86.7%. This accuracy shows that the TM data digital analysis is a cost-effective method for identifying poorly drained cropland hydric soils potentially suitable for wetland conversiOn. To support multi-factorial analysis in the final site screening, a Spatial Decision …
