Adr: An Eclectic Array Of Processes, Rather Than One Eclectic Process, Lela P. Love, Kimberlee K. Kovach

Articles

When mediators try to resolve a controversy by providing their analysis of the legal – or other – merits, they are providing the service that judges, arbitrators and neutral experts provide. In essence, such endeavors use the neutral’s judgment, award or opinion to determine or jump-start a resolution. This article urges that this add-on activity to mediation should be called by its proper name. The essay highlights the advantages of calling "mediation plus evaluation" a mixed process and discusses the advantages of having an eclectic and diverse mix of processes from which parties and counsel can choose to promote party …

The History And Archeology Of Bethsaida, Kristen Sibold Jan 2000

The History And Archeology Of Bethsaida, Kristen Sibold

Presidential Scholars Theses (1990 – 2006)

About one mile north of the Sea of Galilee, in the Jordan River delta, stands a twenty-acre archeological mound known as et-tell. This ancient site has been under excavation since 1987, under the direction of Israeli archaeologist Dr. Rami Arav. In 1989 the Israeli government officially recognized et-tell as the site of Bethsaida, the third most frequently-mentioned city in the New Testament behind Jerusalem and Capernaum ("Bethsaida" 1). The rich history of Bethsaida began long before the New Testament was written, and archeological discoveries provide scholars with a first-hand look at what life was like over two thousand years ago.

Software Piracy: Attitudes & Opinions Of Computer Users And Implications For Software Manufacturers & Consumers, Bharath Pola Jan 2000

Software Piracy: Attitudes & Opinions Of Computer Users And Implications For Software Manufacturers & Consumers, Bharath Pola

Presidential Scholars Theses (1990 – 2006)

Computer software became registered as a form of literary expression by the United States Copyright Office in 1964. By 1980, the Copyright Act was amended to explicitly include software applications. Today, it is illegal to create copies of original program disks without express permission from the manufacturer (Microsoft 1994). The Software and Information Industry Association (SIIA) states that $2.4 billion worth of copyrighted software was pirated in 1990. This figure represents almost one-half of the total revenue of the software industry for that year. An additional $10 to $12 billion was lost to pirates overseas. However, such statistics maintained by …

An Inquiry Into The Development Of Expert Systems In Legal Reasoning, Trevor K. Sheeley Jan 2000

An Inquiry Into The Development Of Expert Systems In Legal Reasoning, Trevor K. Sheeley

Presidential Scholars Theses (1990 – 2006)

The first goal of this paper is to review some of the steps necessary in developing a system that reasons effectively in some domain of law. The paper will begin by addressing the issues of domain selection, domain analysis and knowledge acquisition, knowledge representation, and selection of an inference method. After presenting a brief argument against using rule-based reasoning as the primary mode of inference, the paper will go on to expound the virtues of Kevin Ashley's HYPO, a software model of case based legal argument. It will conclude with a short description of my experience implementing part of a …

Fit To Print: A Content Analysis Of The Regent Universities' Student Papers, Ivy A. Sprague Jan 2000

Fit To Print: A Content Analysis Of The Regent Universities' Student Papers, Ivy A. Sprague

Presidential Scholars Theses (1990 – 2006)

To the best of my knowledge, this is the first comparative study conducted regarding the student publications for the three Iowa Regents' universities. The data collected shows that the three publications are not as different in terms of content as many of their readers seem to believe. As the data reflects, the Northern Iowan is significantly more campus-centered in its coverage. However, the difference is not so significant that the staff of the Northern Iowan could not increase its national and international coverage to make it more comparable to the other two newspapers. I hope this research can be of …

Another Attack On The Fast Track, Constance Z. Wagner

All Faculty Scholarship

Although the Congressional fight over the North American Free Trade Agreement (NAFTA) may have ended when the NAFTA Implementation Act passed by a narrow margin, the controversy surrounding NAFTA has not. In Made in the USA Foundation v. United States, the United Steel Workers of American and others asserted that NAFTA was void because it had been approved as a congressional-executive agreement when it should have been approved as a treaty under Article II, Clause 2 of the U.S. constitution. The author discusses the constitutional law issue raised by the lawsuit, namely the validity of the long-standing U.S. practice of …

The Legal Duty Rule And Learning About Rules: A Case Study, Joel K. Goldstein Jan 2000

The Legal Duty Rule And Learning About Rules: A Case Study, Joel K. Goldstein

All Faculty Scholarship

Early in their law school careers, most students find that the notions they brought with them about law clash with the ideas encountered there. As a traditional first semester course, Contracts is one arena in which students experience most acutely that tension between expectation and reality.
/="/">
/="/">Most new law students probably expect law school professors to spend more time teaching basic legal rules.[1] They anticipate the education in black letter law that is the distinctive trait of bar review courses. They are, therefore, surprised by their professors’ suggestion, whether explicit or implicit, that being a good lawyer is …

Health Care Divided: Race And Healing A Nation, Sidney D. Watson Jan 2000

Health Care Divided: Race And Healing A Nation, Sidney D. Watson

All Faculty Scholarship

Race matters. Race—particularly racial segregation—casts a pervasive shadow over the organization of American health care. It influences the ownership and governance of institutional providers. It helps account for the high cost of health care in the United States. It contributes to America’s abysmal health status, among the worst of the industrialized world. It is reflected, in part, in the lack of national health insurance. So David Barton Smith begins this book, a book he describes as the story of “a divided nation, a divided health care system, and the uncompleted journey to heal both.”[1]

Most of us are not comfortable …

Structuring The Financial Service Conglomerates Of The Future: Does The Choice Of Corporate Form To House New Financial Activities Of National Banks Matter?, Constance Z. Wagner

The Gramm-Leach-Bliley Act became law on November 12, 1999, bringing to an end a twenty year effort to expand bank powers by amending the Glass-Steagall Act and the Bank Holding Company Act of 1956. Although styled as banking reform legislation, the new law will have a wide ranging impact on the financial services industry generally. A wave of merger activity will likely occur in this industry because many of the legal restrictions on bank affiliations with other financial services providers have been removed. An end result of the new legislation will be the creation of financial services conglomerates offering a …

The Urban Housing Issues Symposium: Interdisciplinary Study In A Clinical Law & Policy, Peter W. Salsich Jan 2000

The Urban Housing Issues Symposium: Interdisciplinary Study In A Clinical Law & Policy, Peter W. Salsich

All Faculty Scholarship

This article describes the Urban Housing Issues Symposium, an interdisciplinary program that began in 1992 as a cooperative experiment between the Saint Louis University School of Law and the Washington School of Architecture. The program, which soon expanded to include social work and public policy students, used hypothetical problems, and later real life problems, as a way of demonstrating the importance of interdisciplinary relationships that the professions have in the context of real estate development. By giving the students the chance to interact, the students learned a greater appreciation for the variety of disciplines that are involved in the development …

Asset Protection Trusts: Trust Law's Race To The Bottom?, Stewart E. Sterk Jan 2000

Asset Protection Trusts: Trust Law's Race To The Bottom?, Stewart E. Sterk

Articles

The article examines the evolution and implications of asset protection trusts, highlighting how their use has expanded beyond high-net-worth individuals to professionals like physicians. It critiques the race among jurisdictions, particularly smaller states such as Alaska and Delaware, to create favorable trust laws, arguing that this competition may lead to inefficient and unfair legal frameworks. The analysis emphasizes the tension between creditor rights and debtor protections, suggesting that without federal intervention or multistate coordination, this race could undermine the balance between these interests, potentially harming the broader economy.

[Introduction To] Crossing The Color Line: Readings In Black And White, Suzanne W. Jones Jan 2000

[Introduction To] Crossing The Color Line: Readings In Black And White, Suzanne W. Jones

Bookshelf

The complex truth about the color line -- its destructive effects, painful legacy, clandestine crossings, possible erasure -- is revealed more often in private than in public and has sometimes been visited more easily by novelists than historians. In this tradition, Crossing the Color Line, a powerful collection of nineteen contemporary stories, speaks the unspoken, explores the hidden, and voices both fear and hope about relationships between blacks and whites. The volume opens with stories by Alice Adams, Toni Cade Bambara, Ellen Douglas, Reynolds Price, Ekwueme Michael Thelwell, and John A. Williams that focus on misunderstandings created by racial stereotypes …

Amatory Jurisprudence And The Querelle Des Lois, Peter Goodrich Jan 2000

Amatory Jurisprudence And The Querelle Des Lois, Peter Goodrich

Articles

It is my view, and here, no doubt, I am pre-empting my conclusion, that what literary and feminist historicism recognizes as the querelle des femmes, the debate as to the status and political role of women, is in fact underpinned and motivated by a much less explicit, yet nonetheless portentous, querelle des lois. The querelle des femmes, in other words, was always a polemic as to the legal status of women, as to their definition and role in theology and jurisprudence, canon and civil law. More than that, however, what the recovery of amatory jurisprudence can help to show is …

Rethinking The Penalty Phase, Kyron Huigens Jan 2000

Rethinking The Penalty Phase, Kyron Huigens

Articles

This article argues that the chaos of the US Supreme Court’s death penalty jurisprudence can be sorted with the use of a single point of clarification. That jurisprudence uses the term “culpability” – and similar terms, such as desert, responsibility, and blameworthiness – without regard to a critical ambiguity. We use “culpability” to refer to fault in wrongdoing, as reflected in “culpability elements” such as purpose or recklessness. We also use culpability to refer to eligibility for punishment, which is at issue in the defenses of insanity or minority. Death sentencing is structured around aggravating and mitigating factors, but aggravation …

Student-Led Conferences : A Better Way, Beverly A. Maronn Jan 2000

Student-Led Conferences : A Better Way, Beverly A. Maronn

Graduate Research Papers

The purpose of this journal article is to inform teachers and administrators of a better way to conduct student-led conferences. The typical format is to hold these conferences in a small, advisory setting. This paper describes an alternative format, a "homeroom" arrangement, in which one teacher is available to facilitate the conferences of 12-20 students. The staff at Harlan Community Middle School has found that a large group, everybody together-type setting works better. The gym/commons/media center location alleviates many of the problems associated with the small group setting.
