The Wacky World Of Collision And Comprehensive Coverages: Intentional Injury And Illegal Activity Exclusions, Johnny Parker

Nebraska Law Review

The objective of this article is to develop an appropriate analytical basis for evaluating the illegal activity exclusion in the context of automobile comprehensive coverage. Because the illegal activity exclusion has not been the subject of any reported decision in the context of comprehensive coverage, this article attempts to achieve its goal by examining intentional injury and prohibitive use exclusions in the context of automobile liability and collision coverages, respectively. The purpose of this examination is to ascertain whether the analytical tools employed in the liability and collision coverages arenas are appropriate in the context of the primary thesis. Part …

A Call For A Modified Standard: The Supreme Court Struggles To Define When Private Organizations Can Discriminate In Contravention Of State Antidiscrimination Laws In Boy Scouts Of America V. Dale, 120 S. Ct. 2446 (2000), Sean B. Druyon

Nebraska Law Review

Since the Civil Rights Act of 1964, the federal government has played a significant role in reducing invidious discrimination against individuals on the basis of race, religion, color, and national origin. In the wake of even broader state laws against discrimination lie many private organizations treading to stay afloat in what has become a tumultuous sea of clashing constitutional rights. These private organizations justify discriminatory membership policies on the grounds they engage in expressive association protected by the First Amendment, while individuals denied membership to these organizations claim equal protection of the law under the Fourteenth Amendment and under state …

Faithful To The Constitution: The Roadblock For Nebraska's Schools, Richard E. Shugrue Jan 2000

Faithful To The Constitution: The Roadblock For Nebraska's Schools, Richard E. Shugrue

Nebraska Law Review

For six decades, American schools have been the major battleground in the controversy surrounding the doctrine of separation of church and state. There are huge problems and tensions among the warring parties in religion-school cases, and resort to state constitutional law will not make them disappear. The determined federal judiciary chooses to snub history, tradition, and settled state law to inject its version of civic religion back into the schools. Courts ought to undertake careful examination of the history, language, and experience before embracing a one-size-fits-all rule. For more than a century, states such as Nebraska have fought the battle over …

Multi-Sensor 3d Image Fusion And Interactive Search, W. D. Ross, A. M. Waxman, W. W. Streilein, M. Aguilar, J. Verly, F. Liu, M. I. Braun, P. Harmon, S. Rak

Research, Publications & Creative Work

We describe a system under development for the 3D fusion of multi-sensor surface surveillance imagery, including electro-optical (EO), IR, SAR, multispectral and hyperspectral sources. Our approach is founded on biologically-inspired image processing algorithms. We have developed an image processing architecture enabling the unified interactive visualization of fused multi-sensor site data which utilizes a color image fusion algorithm based on retinal and cortical processing of color. We have also developed interactive Web-based tools for training neural network search agents that are capable of automatically scanning site data for the fused multi-sensor signatures of targets and/or surface features of interest. Each search …

Reading The World Of University : What Counts?, Pamela Green, Gloria Latham

Australian Journal of Teacher Education

This paper will address the issues encountered by first year students in reading and reshaping the culture of university. The interim findings of a six year study will be dismantled in order to uncover what counts in the experience of first year university and the ramifications for educational practice and discourse. Feedback from staff continues to indicate that there is growing disparity between their expectations of first year students and student performance in areas such as independent learning, research skills, academic reading and writing, as well as the use of new technologies. There also seems to be a gap between …

The Integrated Expressive Arts And Humanities : Coping With Curriculum Change, Linley Campbell Jan 2000

The Integrated Expressive Arts And Humanities : Coping With Curriculum Change, Linley Campbell

Australian Journal of Teacher Education

The concept of curriculum integration in education has recently received increased attention. This has been largely due to the introduction of Learning Area Profiles, Statements and Outcomes, and most recently the Curriculum Framework. 'Integration, breadth and balance' is one of the seven key principles underlying The Curriculum Framework for Western Australian Schools. (Curriculum Council of Western Australia, 1998). Collectively, these documents emphasise the integration of knowledge, skills and values in the eight key learning areas of the curriculum. Such a holistic view of the curriculum is considered to be fundamental to sound educational practice.

Reanimator: Mark Tushnet And The Second Coming Of The Imperial Presidency, Neal Devins Jan 2000

Reanimator: Mark Tushnet And The Second Coming Of The Imperial Presidency, Neal Devins

University of Richmond Law Review

A world without judicial review? Not that long ago-when the Left fought tooth and nail to defend the legacy ofthe Warren and (much of the) Burger Courts-the thought of taking the Constitution away from the courts would have been horrific. Witness, for example, Edward Kennedy's depiction of "Robert Bork's America!' as "a land in which women would be forced into back-alley abortions, blacks would sit at segregated lunch counters, [and] rogue police could break down citizens' doors in midnight raids." Bork's sin, of course, was embracing a kind of populist constitutional discourse, that is, the notion that the founders "banked …

This Action Plan covers the partridges, quails, francolins, snowcocks, guineafowl, and turkeys, a group of nearly 150 ground-dwelling gamebirds found in every continent apart from Antarctica. Although they are very widespread, little is known about the species occurring outside Europe and North America. Several species are considered to be at grave risk of extinction, while others are so poorly known that it is difficult to evaluate their conservation needs. In 1995, the first …
