Collecting Child Support: A History Of Federal And State Initiatives, Jane C. Murphy, Naomi R. Cahn Jan 2000

Collecting Child Support: A History Of Federal And State Initiatives, Jane C. Murphy, Naomi R. Cahn

All Faculty Scholarship

In this article we sketch an overview of the increasing federal involvement in the child-support area. Because the federal role has grown so dramatically over the past 25 years, family law practitioners need to understand the different federal programs and requirements that affect state management of child-support programs. While for many low-income parents state agencies handle child-support establishment and collection, the federalization of child support has practical implications when it comes to both establishing and enforcing child support. For example, as the time limits of the Personal Responsibility and Work Opportunity Reconciliation Act begin to have their effects, child support …

When The Wall Has Fallen: Decades Of Failure In The Supervision Of Capital Juries, José F. Anderson Jan 2000

When The Wall Has Fallen: Decades Of Failure In The Supervision Of Capital Juries, José F. Anderson

All Faculty Scholarship

Since the return of capital punishment after Furman v. Georgia nearly three decades ago, the Supreme Court of the United States has struggled to control the administration of capital punishment when those decisions are made or recommended by a citizen jury. Although there is no constitutional requirement that a jury participate in the death penalty process, most states do provide, through their capital punishment statutes, that a jury will participate in the decision. The preference for jury sentencing in these circumstances reflects a reluctance to leave power over life solely in the hands of one judge. Still, some scholars have …

Race, Space And Place: The Internal Critique Of The Empowerment Zones Program, Audrey Mcfarlane Jan 2000

Race, Space And Place: The Internal Critique Of The Empowerment Zones Program, Audrey Mcfarlane

All Faculty Scholarship

This Article examines the extent to which the Empowerment Zones Program is properly viewed as a neutral, rational, and beneficial program for poor, inner-city communities and their residents by exploring the limits and potential of its chief mechanism, economic development, as a tool to achieve social justice for the inner cities. This Article grounds its exploration within the contested terrain of the city, not simply as a legal or juridical concept, but in terms of its reality as a lived place on the eve of the 21st century.

Living Trusts In The Unauthorized Practice Of Law: A Good Thing Gone Bad, Angela M. Vallario Jan 2000

Living Trusts In The Unauthorized Practice Of Law: A Good Thing Gone Bad, Angela M. Vallario

All Faculty Scholarship

An elderly man recently lost his wife and visits the lawyer's office for assistance in the administration of her estate. After the attorney expresses her condolences, she asks if his wife had a will. The client reaches into a brown shopping bag and retrieves a two-and-a-half inch black binder containing several trusts. The elderly gentleman and his deceased wife were told this would eliminate the expensive legal nightmare of probate. Unfortunately, like many others, this couple was victimized by a trust mill.

Analysis Of Infragravity Frequency Sediment Transport On Macrotidal Beaches, Andrew Nicholas Saulter Jan 2000

Analysis Of Infragravity Frequency Sediment Transport On Macrotidal Beaches, Andrew Nicholas Saulter

Other Faculty of Science and Engineering Theses

Many cross-shore sediment transport models use simple treatments of infragravity frequency (0.005- 0.05Hz) processes. For example, infragravity waves have been assumed to provide solely a 'drift velocity' for transport of sediment mobilised by incident frequency waves (0.05-0.5Hz) and be 100% reflected at the shoreline. Furthermore, numerous models calculate broken incident wave heights on the basis of water depth only. This work investigates both the processes underlying infragravity frequency variations in the crossshore velocity field, and the resulting effect of such variations on sediment suspension and transport. Data were selected from three beach experiments in order to compare observations from a …

A Regional Coastal Zone Management System, Victor James Abbott Jan 2000

A Regional Coastal Zone Management System, Victor James Abbott

Other Faculty of Science and Engineering Theses

This thesis documents research undertaken to investigate the operation of coastal zone management in and around south Devon in the south west of the United Kingdom. The concept of coastal zone management has brought an integrated approach to the coastal zone in many placed around the world and examples of these are given (Chapter Two) to illustrate the mature nature of coastal zone management in these places. These are contrasted with the current UK use of a sectoral rather than a holistic approach.

Small Towns And The Rural Economy : A Study Of Their Contemporary Functions And Potential Role In Rural Development, Paul Richard Courtney Jan 2000

Small Towns And The Rural Economy : A Study Of Their Contemporary Functions And Potential Role In Rural Development, Paul Richard Courtney

Other Faculty of Science and Engineering Theses

As Rural Development assumes a greater importance in European policy, one strategy to stimulate economic activity across a broad range of sectors is to use small towns as a focal point for economic development. This may be particularly relevant in the UK where there is increasing concern over the future vitality and viability of these towns. However, such a strategy rests on the assumption that there is a strong level of interdependence between small towns and their surrounding areas. While their historical legacy suggests close integration, developments in the wider economy and resultant socio-economic restructuring have undermined the traditional functions …

Emission, Dispersion And Local Deposition Of Ammonia Volatilised From Farm Buildings And Following The Application Of Cattle Slurry To Grassland, Richard Alexander Hill Jan 2000

Emission, Dispersion And Local Deposition Of Ammonia Volatilised From Farm Buildings And Following The Application Of Cattle Slurry To Grassland, Richard Alexander Hill

Other Faculty of Science and Engineering Theses

Emissions of ammonia (NH3) into the atmosphere, principally from agricultural sources, have been implicated in the pollution of forests, moorlands and grasslands, through the subsequent deposition of reduced nitrogen (NHx -N). Consequently, legislation has been implemented to control both the transboundary transport and local environmental impacts of NHx. This thesis investigates the emission, dispersion and local deposition of NH3 from two sources that are major components of national NH3 emissions inventories, slurry applied to grassland and naturally ventilated cattle buildings. A N balance method was identified for determining the time-average deposition of NH3 downwind of a farm building, whilst an …

However, these activities have rarely been considered to date. This project consists of three parts. Firstly a review of service marketing approaches, their status and development, the nature of marketing strategies and the marketing mix had to be provided. Also the development of marketing in seaports had to be examined. The focal elements discussed were the elements of the services provided by seaports, and competition between them in the context of Poland Secondly the situation in Eastern …

The Thermal Properties Of Cob Buildings Of Devon, Steve Goodhew Jan 2000

The Thermal Properties Of Cob Buildings Of Devon, Steve Goodhew

Other Faculty of Science and Engineering Theses

Little has been published concerning the thermal properties of existing unbaked earth walls. In order to model the thermal behaviour of a building constructed using traditional cob walls, the thermal conductivity and thermal diffusivity need to be established. The Centre for Earthen Architecture (CEA), based at the University of Plymouth's School of Architecture has carried out research into various aspects of cob architecture typical to the Devon area. This study supplements other work concerning the moisture content, structure and pathology of cob as a building material. This research concentrates upon the development of a time dependent probe technique for the …

Likewise in the voluntary /hobbyist sector, the chapter notes membership numbers, …

The Architectural Expression Of Anglican Rituals As Disseminated Through A Photographic Enquiry Of Six Devon Churches, Simon Standing Jan 2000

The Architectural Expression Of Anglican Rituals As Disseminated Through A Photographic Enquiry Of Six Devon Churches, Simon Standing

Other Faculty of Arts, Humanities and Business Theses

There have been a number of publications that have set out to clarify the relationship between architectural, liturgical and ritual developments within the nineteenth century Anglican church; especially that part of the Victorian Gothic Revival where fundamental developments in architectural design and doctrinal change occurred - 1840 to 1900. A variety of graphic illustrations have supported these texts and as a photographer who has had a long standing interest in visual forms of religious expression, it has raised the question as to whether new meanings of the architectural/ecclesiastical relationship could be established through a photographic-based research investigation. During the MPhil …

Writing The Real: The Collages Of Hannelore Baron, Valerie James Reardon Jan 2000

Writing The Real: The Collages Of Hannelore Baron, Valerie James Reardon

Other Faculty of Arts, Humanities and Business Theses

Baron's work has not been extensively studied nor is it known in full. Critical writings and scholarly attention have focused on the work as representative of Holocaust suffering. This thesis intervenes in that assumption by arguing that it is possible to understand Baron's processes of making collage as a significant case study in the problematic of signification and a complex of differences none of which are reducible to or deducible from each other. Drawing together a range of biographical information, primary source material and close readings of many of Baron's collages (including two hitherto unseen series) traces are revealed of …

Criminality Of Women In The 18th Century In The South West Of England, Amy Alexander Williams Jan 2000

Criminality Of Women In The 18th Century In The South West Of England, Amy Alexander Williams

Other Faculty of Arts, Humanities and Business Theses

Chapter 1: Debates and Developments in the fields of Crime History and Women's History: Frameworks, Methodolozies and Consolidation. This chapter falls into three sections. The first outlines some key issues in Crime History. The second examines the development of women's history and discusses the introduction of gender into Crime History. It is argued that the new issues that have arisen from the joining of these two disciplines have enhanced the development of Crime History. The third section discusses women's history and the study of crime and gender in the early modem period, the source material used and methodology employed in …

Acts Of Writing: Writings On Contemporary Performance, Richard David Allsopp Jan 2000

Acts Of Writing: Writings On Contemporary Performance, Richard David Allsopp

Other Faculty of Arts, Humanities and Business Theses

The work published between 1992- 2000 and presented here forms a continuing meditation on, and exploration of contemporary performance. The term 'contemporary performance' is used to refer to practices and discourses in the performance arts that have occurred over the last decade. There is a particular emphasis on those unstable, hybrid and interdisciplinary areas of performance (including performance art, installation, 'new' dance, 'experimental' theatre, 'live' art) which resist easy definition or categorisation, and which may be further characterised as postmodern in the sense of a reflexive, contextualised and knowingly problematic practice. More specifically the work builds a sustained thesis on …

The Mechanism Of Action Of Liquid Seaweed Extracts In The Manipulation Of Frost Resistance In Winter Barley (Hordeum Vulgare. L), Stephen Burchett Jan 2000

The Mechanism Of Action Of Liquid Seaweed Extracts In The Manipulation Of Frost Resistance In Winter Barley (Hordeum Vulgare. L), Stephen Burchett

Other Faculty of Science and Engineering Theses

Frost assays carried out on winter barley (Hordeum vulgare cv Igri) showed that a single (10ml I) application of liquid seaweed extract (LSE) marginally increased the frost resistance of non-acclimated (NA) plants by 2.3% compared to NA controls and cold-acclimated (CA) plants by 2.1% compared to CA controls. Three applications of LSE increased the frost resistance of NA plants by 16% compared to NA controls and CA plants by 7.5% compared to CA controls. These observations were durable in a small scale field trial where LSE increased plant dry weights (control 0.55, single LSE, 0.611 and multiple LSE 0.621 log …

Multidimensionality Of Entrepreneurial Firm-Level Processes: Do The Dimensions Covary?, Phil E. Stetz, Roy Howell, Alex Stewart, John D. Blair, Myron D. Fottler Jan 2000

Multidimensionality Of Entrepreneurial Firm-Level Processes: Do The Dimensions Covary?, Phil E. Stetz, Roy Howell, Alex Stewart, John D. Blair, Myron D. Fottler

Management Faculty Research and Publications

Covariance (or not) among the first-order dimensions of firm-level entrepreneurial processes underpins a fundamental and non-trivial difference between the entrepreneurial orientation and entrepreneurial posture constructs. Utilizing a typology developed for multi-dimensional constructs, we operationalized each construct according to its specific conceptualization (relationships among the dimensions) and compared and contrasted each construct in an identical nomological network. Although we found support for both theories, the entrepreneurial orientation construct was more robust in explaining additional variance in growth. Additionally, our findings suggest that the means through which the first-order dimensions are operationalized—latent vs. summates— significantly affect the analysis.

South Asian Divorce And Disputes Involving Children Of South Asian Origin, William Hay Jan 2000

South Asian Divorce And Disputes Involving Children Of South Asian Origin, William Hay

Both themes are explored empirically by means of a qualitative research study conducted in an urban and industrial area of Britain with a high South Asian population. The thesis thus seeks to provide much needed information concerning what are currently two poorly understood social problems. The material is presented in three main sections. The first section provides the wider context to the study including a discussion of the changing face of South Asian social relations …

The Disappearing Frame.: A Practice-Based Investigation Into Composing Virtual Environment Artworks, Thomas James Patrick Corby Jan 2000

The Disappearing Frame.: A Practice-Based Investigation Into Composing Virtual Environment Artworks, Thomas James Patrick Corby

Other Faculty of Arts, Humanities and Business Theses

Through creative art making practice, research seeks to contribute a body of knowledge to an under researched area by examining how key concepts germane to computer based, interactive, three-dimensional, virtual environment artworks might be explicated, potential compositional issues characterised, and possible production strategies identified and/or proposed. Initial research summarises a range of classifications pertaining to the function of interactivity within virtual space, leading to an identification and analysis of a predominant model for composing virtual environment media, characterised as the "world as model": a methodological approach to devising interactive and spatial contexts employing visual and behavioural modes based on the …

Processing Writing: From Text To Textual Interventions, Caroline Bergvall Jan 2000

Processing Writing: From Text To Textual Interventions, Caroline Bergvall

Other Faculty of Arts, Humanities and Business Theses

This submission comprises the main bulk of the critical and textual work I have researched and developed over the last five years. Throughout this period, I have been particularly interested in exploring issues of interdisciplinarity for writers and text-practitioners, at both a critical and a methodological level. An interest in cross-media and site-related approaches to writing plays an important role in this. This is reflected in the thematics of the various critical texts, as well as in the fairly broad range of textual modes submitted. As a whole, this work can be seen in close continuity with my pedagogical involvement …

The Relationship Between Teachers' Understanding Of The Nature Of Science And Their Science Practice : Four Case Studies From An Urban Primary School., Stephen Laurence Waters-Adams Jan 2000

The Relationship Between Teachers' Understanding Of The Nature Of Science And Their Science Practice : Four Case Studies From An Urban Primary School., Stephen Laurence Waters-Adams

Plymouth Institute of Education Theses

This thesis explores the relationship between a teacher's understanding of the nature of science and her practice. The idea that teachers' understanding of the nature of science is a powerful determinant of their actions in the classroom has a strong intuitive appeal. Research over the last forty years has provided inconclusive results; however, there is a clear implication within recent central policy on teacher education that such knowledge should translated directly into practice. This has led to the identification within teacher training, materials of specific expectations regarding understanding of the nature of science (DfEE 1998a). This thesis presents four case …

The Power Of The Treasury: Racial Discrimination, Public Policy And "Charity" In Contemporary Society, David A. Brennen Jan 2000

The Power Of The Treasury: Racial Discrimination, Public Policy And "Charity" In Contemporary Society, David A. Brennen

Scholarly Works

The Treasury Department is empowered to enforce “established public policy” with respect to tax-exempt charities. Under this public policy power, the Treasury has revoked the tax-exempt charitable status of organizations that discriminated against blacks, organizations whose members engaged in civil disobedience against war, and organizations involved in illegal activity. The Treasury interprets its public policy power as applying to any activity that violates clear public policy. Thus, presumably, the Treasury could use this power to deny tax-exempt charitable status to an organization that engages in conduct that violates assisted suicide laws, anti-abortion laws, or other sufficiently “established” public policies.

Much Ado About Spam: Unsolicited Advertising, The Internet, And You., Scot M. Graydon Jan 2000

Much Ado About Spam: Unsolicited Advertising, The Internet, And You., Scot M. Graydon

St. Mary's Law Journal

Internet users need protection from unsolicited commercial emails (UCEs), and this protection should come from federal legislation. Despite seventeen states having passed some sort of legislation regulating UCEs, this is insufficient to protect Internet users from UCEs. State laws are not uniformed and UCEs frequently cross state lines. Internet advertisers prefer commercial emails because of the ability to market to millions of consumers at a low cost. Consumers, however, suffer delays to their Internet access because of the amount of data UCEs accumulate, and in some cases may have to pay additional fees if they exceed the data limits of …

A Holy Mess: School Prayer, The Religious Freedom Restoration Act Of Texas, And The First Amendment., David S. Stolle Jan 2000

A Holy Mess: School Prayer, The Religious Freedom Restoration Act Of Texas, And The First Amendment., David S. Stolle

St. Mary's Law Journal

In Employment Division, Department of Human Resources of Oregon v. Smith, the U.S. Supreme Court held the traditional compelling state interest standard for Free Exercise Clause jurisprudence should be replaced by a new test requiring a statute or government action to be facially neutral and generally applicable. In response to Smith, Congress, relying on its Enforcement Clause powers under the Fourteenth Amendment, attempted to resurrect the compelling state interest standard by passing the Religious Freedom of Restoration Act (RFRA). In June 1999, the Texas legislature passed the Texas Religious Freedom Restoration Act (TRFRA). This Comment argues the TRFRA is unnecessary …

Its effective and appropriate links to PL 94-142, PL 101-476, and the IDEA are presented.

Collaborative teaching is then defined as an alternative to students being pulled out to receive resource room services. The premises of collaborative teaching are shared. Included …

Effective Multidisciplinary Team Problem Solving : A Review Of Literature, Debra S. Meyer Jan 2000

Effective Multidisciplinary Team Problem Solving : A Review Of Literature, Debra S. Meyer

Graduate Research Papers

The historical legislation mandating multidisciplinary teams (MDTs) in schools is well known, yet relatively little attention has been directed toward either evaluating systematic processes that would lead to the desired outcome of better services to all students or educating team members in problem solving content and process. The purpose of the study was to examine the factors that influence problem solving outcomes and other aspects of service delivery in MDT settings, including the changing role of school psychologists.

Results indicated much variability and little consensus in several areas: clarity of role expectations, family involvement, interdisciplinary collaboration, continuing educational training, and …
