Bitter Medicine: A Critical Look At The Mental Health Care Provider’S Duty To Warn In Texas, Charles E. Cantú, Margaret H. Jones Hopson

Faculty Articles

A quarter of a century has passed since Tarasoff v. Regents of the University of California first imposed a duty of care upon mental health care professions for third parties. In Tarasoff, the California Supreme Court held that once a therapist determines, or reasonably should have determined, a patient poses a significant danger of violence to others, the therapist bears a duty to exercise reasonable care to protect the foreseeable victim from that danger.

Tarasoff has since been widely accepted by both legislatures and courts as the basis for imposing the duty of reasonable care upon mental health care professionals …

All ETDs from UAB

We evaluated the long-term effects of small for gestational age (SGA) and preterm birth on psychomotor and physical development of children. We followed 857 singleton newborns to assess their physical growth at 5 y of age using z Scores of weight-for-age, weight-for-height, and height-for-age. Of the 857 infants, 740 children were assessed at age 5 y for intelligence quotient (IQ) using Wechsler Preschool and Primary Scales of Intelligence-Revised. Vector -Borne Viral Diseases In The Amazonian Rain Forest Of Ecuador, Ricardo O. Izurieta

All ETDs from UAB

Population movement has been an important factor in determining the spread of viral diseases in the New World, including the Amazonian rainforest. In July and August of 1997, an epidemic outbreak of an unknown hemorrhagic fever was detected in the Pastaza Province in the Ecuadorian rainforest. The outbreak appeared among military personnel who were detached to the frontier with Peru during an armed conflict between Ecuador and Peru. A multidisciplinary team was mobilized by the Ecuadorian Armed Forces to investigate and control the outbreak. A cross-sectional seroepidemiological survey was conducted in the military personnel of a jungle garrison and its …

Self -Reports Of Reasons For Hospitalization By Young Adults: Validity And Risk Factors For Discordance With Medical Records, S M Atiqur Rahman

All ETDs from UAB

Two studies were undertaken focusing on the validity of young adults' self-reports of reasons for hospitalization and factors affecting validity. The first study assessed the concordance of self-reports by young adults of reasons for hospitalization with their medical records, and the second examined factors associated with discordance between self-reports and medical records. The first study demonstrated that although concordance or accuracy of self-reports was more than 90% overall, for specific disease categories it ranged from 80% for infections to 100% for injuries/fractures and procedures including surgeries. There was no significant difference in degree of concordance by method of collecting self-reported …

Influences On Initial Acceptance And Intention To Use A Modern Family Planning Method In Hiv -Discordant Couples In Lusaka, Zambia, David Emerson Roth

All ETDs from UAB

An important means of decreasing vertical transmission and numbers of AIDS orphans would be reducing the number of unwanted pregnancies in couples in which one or both members are HIV-positive. The use of family planning methods will be essential for this reduction. A previous study (Mark et al. submitted for publication) with HIV-discordant couples in Zambia attempted to influence acceptance of family planning methods in a three-armed intervention trial. The current study includes the same subjects as that intervention trial. Data on background characteristics, knowledge, attitudes and practices relevant to family planning were collected at the time of enrollment to …

State Safety Law And Loss Prevention Efforts As Predictors Of Safety Performance, Matthew Wayne Smitha Jan 2000

State Safety Law And Loss Prevention Efforts As Predictors Of Safety Performance, Matthew Wayne Smitha

All ETDs from UAB

Workers' compensation costs began a dramatic increase in the 1980s. During the late 1980s and early 1990s a wave of workplace safety initiatives and workers' compensation system reforms were promulgated by state governments. The state mandatory workplace safety initiatives can be classified into the following four specific categories: (a) mandatory employer health and safety program requirements, (b) mandatory employee safety committee requirements, (c) targeted safety initiatives directed toward high claims or high accident employers, and (d) state regulation of insurance carrier loss control services. Occupational injury rates declined in all states during the time period 1992–1997. The purpose of this …

Software As Discourse: The Power Of Intellectual Property In Digital Architecture, Brian F. Fitzgerald Jan 2000

Software As Discourse: The Power Of Intellectual Property In Digital Architecture, Brian F. Fitzgerald

Cardozo Arts & Entertainment Law Journal

As software increasingly facilitates our living, we are drawn more and more to conceptualize software as discourse. While this may sound trite, it is a fundamental point to appreciate.

One of the most significant intellectual developments of the latter part of the twentieth century has been the poststrucoturalist writing of thinkers like Foucault, Derrida, and Baudril-lard, who explain the multitude of power relationships we experience in our daily lives, the indeterminacy of law, the construction of meaning, and the role of language, or discourse, in the construction of meaning and identity. According to the post-structuralists, we live in an environment …
