Special Division Agonistes, John Q. Barrett Jan 2000

Special Division Agonistes, John Q. Barrett

When the independent counsel law sank, the casualties included a special "division" of the United States Court of Appeals for the District of Columbia Circuit. This division was the special court that Congress had created "for the purpose of appointing independent counsels." The now-expired 1994 independent counsel statute had, like its three predecessors, directed the Chief Justice of the United States to appoint three judges from the Supreme Court and/or the federal Courts of Appeals to serve on the special court for two-year terms. This independent counsel court, which was located for administrative purposes in the United States Court of …

What Makes Teachers Good?, Donald R. Cruickshank Jan 2000

What Makes Teachers Good?, Donald R. Cruickshank

Mid-Western Educational Researcher

Over time and depending upon circumstances Americans flip-flop over what we think makes teachers good. Thus, several visions of good teachers have appeared and disappeared. In part, our inability to sustain agreement on what makes teachers good results from a belief that all good teachers are or should be the same, that one size fits all. We fail to embrace or even consider the idea that there are multiple kinds of good teachers. Here ten visions of good teaching are described. The challenge is to validate as many as possible and then permit teachers to describe, and when appropriate, document …

Development Of Attitude Toward Teaching Career, Fred L. Pigge, Ronald N. Marso Jan 2000

Development Of Attitude Toward Teaching Career, Fred L. Pigge, Ronald N. Marso

Mid-Western Educational Researcher

The purpose of this longitudinal study was to investigate whether selected academic ability indices and personal characteristics of 117 teachers were associated with changes in their attitude toward teaching as a career measured upon the commencement of teacher preparation, the end of student teaching, and upon completion of their fifth year of teaching. Mixed model two-way ANOVA procedures revealed that the attitude toward teaching of the neophyte teachers remained stable and positive during teacher preparation but were less positive near the end of their fifth year of teaching; that ACT scores, Rotter’s locus of control, Myers-Briggs Type Indicator preferences, gender, …

Culture And Strategy In Business Schools: Links To Organizational Effectiveness, Christopher Clott, Nancy Fjortoft Jan 2000

Culture And Strategy In Business Schools: Links To Organizational Effectiveness, Christopher Clott, Nancy Fjortoft

Mid-Western Educational Researcher

The purpose of this study is to examine the independent and conditional effects of organizational culture type and managerial strategy on the organizational effectiveness of higher education schools of business. While significant differences are found for both culture type and managerial strategy on the effectiveness measures, there were no significant interactive effects between the two independent variables. The implications of these findings for efforts to enhance the effectiveness of professional and pre- professional collegiate programs are discussed.

Preparing Principals For New Roles: Advice From The Field, Carla Edlefson Jan 2000

Preparing Principals For New Roles: Advice From The Field, Carla Edlefson

Mid-Western Educational Researcher

A university professor and a graduate student interviewed 10 high school administrators who were leaders of innovation. The interviews enabled the university team to conceptualize 3 new roles for principals that guided the revision of the university program in educational administration: the principal as Leader of Leaders, as Advocate, and as Catalyst for Change. The practitioners’ advice to the university was to focus on leadership of change; shift from thinking about management to thinking of continuous improvement; develop learning opportunities outside the university classroom; prepare students for the incredible pace and workload; and assign quality work to administration students.

Teacher-Centered Fallacies Of Classroom Assessment Validity And Reliability, Craig A. Mertler Jan 2000

Teacher-Centered Fallacies Of Classroom Assessment Validity And Reliability, Craig A. Mertler

Mid-Western Educational Researcher

The general purpose of this descriptive study was to examine the current assessment practices of teachers in the state of Ohio. Specifically, the aim of this study was to gain an understanding of the methods used to insure the validity and reliability of their classroom assessments. It builds on previous research by incorporating verbal explanations and categorizations of techniques used to insure classroom assessment validity and reliability. Similar to previous research, it was determined that teachers do not spend much time conducting statistical analyses of their assessment data. Teachers seemed to have a better understanding of assessment reliability than validity; …

Hepatitis C Virus: Genome Organization, Viralproteins And Implications In Disease Pathogenesis, Çağla Eroğlu, Ergün Pinarbaşi Jan 2000

Hepatitis C Virus: Genome Organization, Viralproteins And Implications In Disease Pathogenesis, Çağla Eroğlu, Ergün Pinarbaşi

Turkish Journal of Biology

The hepatitis C virus (HCV) infection is a significant cause of morbidity and mortality worldwide. Infection with HCV becomes chronic in more than 80% of cases and it accounts for 20% of all cases of acute hepatitis. The hepatitis C virus was first identified by the molecular cloning of the virus genome in 1989. It is an enveloped, positive strand RNA virus with a genome size of around 9.5 kilobases. The single-stranded RNA genome of the virus contains a large open reading frame that encodes a large polyprotein of 3,010 to 3,033 amino acids shown to be processed by a …

Rethinking The Penalty Phase, Kyron Huigens Jan 2000

Rethinking The Penalty Phase, Kyron Huigens

Articles

This article argues that the chaos of the US Supreme Court’s death penalty jurisprudence can be sorted with the use of a single point of clarification. That jurisprudence uses the term “culpability” – and similar terms, such as desert, responsibility, and blameworthiness – without regard to a critical ambiguity. We use “culpability” to refer to fault in wrongdoing, as reflected in “culpability elements” such as purpose or recklessness. We also use culpability to refer to eligibility for punishment, which is at issue in the defenses of insanity or minority. Death sentencing is structured around aggravating and mitigating factors, but aggravation …

Is Hiv Disability Under The Americans With Disabilities Act: Unanswered Questions After Bragdon V. Abbott, Connie Mayer Jan 2000

Is Hiv Disability Under The Americans With Disabilities Act: Unanswered Questions After Bragdon V. Abbott, Connie Mayer

Journal of Law and Health

Prior to the passage of the ADA in 1990, the term "individual with a handicap" had been clearly established under federal disability laws to include all people with HIV. Every reported decision under the Rehabilitation Act and the Fair Housing Amendment Act had determined that asymptomatic HIV was protected as a per se disability. Prior to 1997, only a few Courts had faced the issue of whether a plaintiff with asymptomatic HIV was disabled under the ADA. In 1997, the Fourth and First Circuit Courts of Appeal decided cases in direct conflict with one another, opening the door for the …

Consent To Sperm Retrieval And Insemination After Death Or Persistent Vegatative State, Carson Strong Jan 2000

Consent To Sperm Retrieval And Insemination After Death Or Persistent Vegatative State, Carson Strong

Journal of Law and Health

Although a number of additional legal questions can be raised, including issues of paternity and inheritance, this paper focuses on the legal issues pertaining to consent, as well as the ethical questions raised above, which need to be discussed in order to address adequately the legal consent issues. The paper is organized as follows: first, the current law of consent to sperm retrieval and insemination after death or PVS is discussed in order to identify gaps in the law - areas that the law does not address or concerning which it is unclear; second, ethical issues are discussed that are …

Defining Willful Remuneration: How Bryan V. United States Affects The Scienter Requirement Of The Medicare/Medicaid Anti-Kickback Statute, Robb Degraw Jan 2000

Defining Willful Remuneration: How Bryan V. United States Affects The Scienter Requirement Of The Medicare/Medicaid Anti-Kickback Statute, Robb Degraw

Journal of Law and Health

At the forefront of the debate over the anti-kickback statute, and the topic of this Note, is the mens rea, or mental state, that is required for a violation of the law. According to the statute, an individual must "knowingly and willfully" solicit or receive, or offer to pay, remuneration in order to induce business reimbursed under any federal health care program. The interpretation of these terms by the federal courts has varied wildly, as have the underlying Supreme Court cases cited as precedent for such interpretations. However, in June of 1998, the Supreme Court defined the meaning of "willfully" …

The Tobacco Industry And The First Amendment - An Analysis Of The 1998 Master Settlement Agreement, Lori Ann Luka Jan 2000

The Tobacco Industry And The First Amendment - An Analysis Of The 1998 Master Settlement Agreement, Lori Ann Luka

Journal of Law and Health

This Note discusses and assesses the Government's likelihood of passing constitutional scrutiny with the Master Settlement Agreement's restrictions in light of the First Amendment case law. A majority of the restrictions will likely pass constitutional scrutiny because they meet the demanding requirements of Central Hudson and its progeny. The author believes that a few of the restrictions need to be more narrowly tailored in order to pass constitutional scrutiny. Suggestions on how to narrowly tailor the restrictions to comport with Central Hudson are proffered by the author. Section II provides an overview of the history of First Amendment commercial speech …

Punishment Of Health Care Fraud , Yvette M. Mastin Jan 2000

Punishment Of Health Care Fraud , Yvette M. Mastin

Journal of Law and Health

Although the definition of "health care fraud" is only one of the numerous issues of concern to health law practitioners and health care providers, the language that defines the conduct in question is the foundation of all other concerns related to "health care fraud." This Article will demonstrate the need for a narrowly construed definition of "health care fraud." The Article begins by providing a scenario to explain how a situation involving potential "health care fraud" can arise in the delivery of health care services. The Article then addresses how "health care fraud" is defined through a discussion of the …

Wrongful Birth And Wrongful Conception: A Parent's Need For A Cause Of Action, Mary B. Sullivan Jan 2000

Wrongful Birth And Wrongful Conception: A Parent's Need For A Cause Of Action, Mary B. Sullivan

Journal of Law and Health

The purpose of this note is to demonstrate the need for wrongful birth and wrongful conception claims. Arguments have been made that these claims should be combined into one cause of action. The rationale for this argument is that by combining the two claims, chaos in the courts will be reduced. This note will show the need to maintain these claims as separate from one another. This note also demonstrates the proper stance of the courts in rejecting the wrongful life cause of action. Part II of this note gives an overview of medical malpractice and the claims of wrongful …
