Elementary And Persistent Errors In The Economic Analysis Of Intellectual Property, Edmund W. Kitch Nov 2000

Elementary And Persistent Errors In The Economic Analysis Of Intellectual Property, Edmund W. Kitch

Vanderbilt Law Review

The literature on the economic analysis of intellectual property rights evidences a broad scholarly consensus on a number of central and important issues. First, intellectual property rights en- able economic actors to capture some of the benefits of the investment they make in establishing a good reputation, creating expressive works, and inventing new and improved technology. Absent intellectual property rights, copiers are free to take for themselves a significant part of the economic benefit generated by these types of investment and to undermine the incentive to make these in- vestments in the first place. Second, the investment activities induced by …

A Graphical Analysis Of Some Basic Results In Social Choice, Estelle Cantillon, Antonio Rangel Nov 2000

A Graphical Analysis Of Some Basic Results In Social Choice, Estelle Cantillon, Antonio Rangel

Cowles Foundation Discussion Papers

We use a simple graphical approach to represent Social Welfare Functions that satisfy Independence of Irrelevant Alternatives and Anonymity. This approach allows us to provide simple and illustrative proofs of May’s Theorem, of variants of classic impossibility results, and of a recent result on the robustness of Majority Rule due to Maskin (1995). In each case, geometry provides new insights on the working and interplay of the axioms, and suggests new results including a new characterization of the entire class of Majority Rule SWFs, a strengthening of May’s Theorem, and a new version of Maskin’s Theorem.

Securitizing Russia: Discursive Practices Of The Baltic States, Øyvind Jæger Nov 2000

Securitizing Russia: Discursive Practices Of The Baltic States, Øyvind Jæger

Peace and Conflict Studies

The author argues that the security situation of the Baltic countries cannot be separated from the way the Balts themselves speak of security. This is a discourse of danger producing insecurity in pursuit of security. Moreover, this article is a study of identity by demonstrating how Baltic security issues are constituted by discourses of danger revolving around Russian Otherness and European Sameness. In conclusion, the following aspects are addressed: the prospects for the coming together of East and West in the Baltic Sea Region – and NATO’s role in this process – and whether this process will come to ease …

From Liminars To Others: Securitization Through Myths, Karsten Friis Nov 2000

From Liminars To Others: Securitization Through Myths, Karsten Friis

Peace and Conflict Studies

The article discusses the rise of societal and ethnic conflicts. It focuses on some of the analytical tools designed to illuminate these processes. More specifically it builds on the framework of the so-called "Copenhagen School of Security Studies" but seeks to develop a more flexible approach on the concept of identity. To understand how an identity gains strength, Roland Barthes’ theory of myths is examined and combined with Michel Foucault's concept of power. Finally a concept of agency is added, namely what has been labeled a “conflict entrepreneur”. It is argued that by combining these theoretical insights the process of …

Mortality Of Escherichia Coli O157:H7 In Two Soils With Different Physical And Chemical Properties, D. N. Mubiru, Mark S. Coyne, John H. Grove Nov 2000

Mortality Of Escherichia Coli O157:H7 In Two Soils With Different Physical And Chemical Properties, D. N. Mubiru, Mark S. Coyne, John H. Grove

Plant and Soil Sciences Faculty Publications

Wild and domesticated animals can harbor a pathogenic Escherichia coli strain designated as O157:H7. Potential health problems could occur if strain O157:H7 is a more robust survivor in defecated waste than commonly used indicator bacteria. A laboratory study was conducted to assess E. coli O157:H7 survival relative to a nonpathogenie E. coli strain in two soils with different physical and chemical characteristics. Bacteria in the inoculated soils were enumerated on a weekly basis for 8 wk using a most probable number (MPN) technique. First-order decay models were used to describe bacteria mortality in the soils. Decay series were described slightly …

Intellectual Property Rights And The New Institutional Economics, Robert P. Merges

Vanderbilt Law Review

When someone speaks of "the law and economics of intellectual property rights" (IPRs), an image along the lines of the following diagram is apt to come to mind: Wilson Sonsini Goodrich & Rosati Professor of Intellectual Property Law, U.C. Berkeley (Boalt Hall) School of Law. For helpful comments, the author wishes to thank members of the Vanderbilt Law School Conference, "Taking Stock: The Law and Economics of Intellectual Property Rights," April, 2000. The usual disclaimer applies.

This is the basic illustration of monopoly price and output, familiar from introductory microeconomic texts. It is often used to explain the effects of …

Moral And Legal Rhetoric In International Relations: A Rational Choice Perspective, Eric A. Posner, Jack L. Goldsmith Nov 2000

Moral And Legal Rhetoric In International Relations: A Rational Choice Perspective, Eric A. Posner, Jack L. Goldsmith

Coase-Sandor Institute for Law & Economics Research Paper Series

Critics of realist and rational choice approaches to international law argue that if nations were motivated entirely by power or self-interest, their leaders would not make moral and legal arguments because no one would believe them. Thus, the prevalence of moral and legal rhetoric on the international stage refutes the behavioral assumptions of realism and rational choice. This paper argues that even if nations are not motivated by a desire to comply with morality or law, the use of moral and legal arguments could occur in equilibrium. Signaling and cheap talk models show that nations may engage in talk in …

Strategic Disclosure In The Patent System, Douglas Gary Lichtman, Scott Baker, Kate Kraus Nov 2000

Strategic Disclosure In The Patent System, Douglas Gary Lichtman, Scott Baker, Kate Kraus

Coase-Sandor Institute for Law & Economics Research Paper Series

Patent applications are evaluated in light of the prior art. What this means is that patent examiners evaluate a claimed invention by comparing it with what in a rough sense corresponds to the set of ideas and inventions already known to the public. This is done for three reasons. First, the comparison helps to ensure that patents issue only in cases where an inventor has made a non-trivial contribution to the public’s store of knowledge. Second, it protects a possible reliance interest on the part of the public since, once an invention is widely known, members of the public might …

The Zen Of Corporate Capital Structure Neutrality, Herwig J. Schlunk Nov 2000

The Zen Of Corporate Capital Structure Neutrality, Herwig J. Schlunk

Michigan Law Review

It is well understood that corporate capital structure affects tax collections. Most basically, corporate interest expense is deductible. With each interest accrual, the corporate tax base shrinks. Thus, there is a broad range of circumstances in which corporate managers are encouraged by the Internal Revenue Code (the "Code") to load their corporate capital structures with debt. But there is little support for the proposition that Conpress desires corporations to adopt such debt-laden capital structures. Indeed, much tax legislation suggests congressional displeasure with the achievable degree of corporate self- integration. On the other hand, corporate equity has its charms: shareholders are …

Of Green Tulips And Legal Kudzu: Repackaging Rights In Subpatentable Innovation, J. H. Reichman Nov 2000

Of Green Tulips And Legal Kudzu: Repackaging Rights In Subpatentable Innovation, J. H. Reichman

Vanderbilt Law Review

How to enable entrepreneurs to appropriate the fruits of their investments in cumulative and sequential innovation' without impeding follow-on innovation and without creating barriers to en- try has become one of the great unsolved puzzles that the law and economics of intellectual property rights needs to address as the new millennium gets underway. This Article draws briefly from my earlier works to identify some of the key historical difficulties en- countered in protecting small grain-sized innovations that do not rise to the level of "novel and nonobvious inventions" or "original and creative works of authorship." It then re-examines these difficulties …

Taking The Protection-Access Tradeoff Seriously, Harvey S. Perlman Nov 2000

Taking The Protection-Access Tradeoff Seriously, Harvey S. Perlman

Vanderbilt Law Review

Law and economics scholarship has contributed much to our understanding of both the nature of intellectual property rights generally and the features of individual intellectual property regimes. Indeed it is hard to imagine a field other than antitrust law that is so explicitly governed by economic thinking. In authorizing the copyright and patent systems, Article I, Section 8 of the United States Constitution expressly incorporates a social welfare imperative as the basis for its grant of power.' Certainly economists and economically oriented legal academics have given the field the attention it is due.

I am far from being a sophisticated …

Market Hierarchy And Copyright In Our System Of Free Expression, Neil W. Netanel Nov 2000

Market Hierarchy And Copyright In Our System Of Free Expression, Neil W. Netanel

Vanderbilt Law Review

If trends of the past two decades persist, a vast inequality of wealth may well become a fundamental, defining characteristic of political and social life in many Western democracies, particularly the United States.' Among its potentially pernicious effects, massive wealth disparity threatens the integrity of the democratic process. Liberal democracy aspires to political equality, which demands that opportunities to acquire and assert political power be widespread and broadly distributed. Political equality does not require economic equality. But political equality may be undermined by severe disparities of wealth. Absent preventive regulation, private wealth buys political power. It enables those with greater …

Patent Policy Innovations: A Clinical Examination, Josh Lerner Nov 2000

Patent Policy Innovations: A Clinical Examination, Josh Lerner

Vanderbilt Law Review

On the domestic front, the dispute has centered on the question of whether the United States should honor commitments made in bi- lateral agreements with Japan to remove idiosyncratic features of its patent system. In particular, legislation to require the publication of pending patent applications and to grant awards to the party that is first to file for an award (as are the practices in most nations) have been fiercely debated in the past few congressional sessions. In the developing nations, the requirements for minimal levels of patent protection in the Uruguay Round of the General Agreement on Tariff and …

Shaping Competition On The Internet: Who Owns Product And Pricing Information?, Maureen A. O'Rourke Nov 2000

Shaping Competition On The Internet: Who Owns Product And Pricing Information?, Maureen A. O'Rourke

Vanderbilt Law Review

Historically, markets have almost always fallen short of satisfying the conditions for and providing consumers with the benefits of perfect competition. Certain characteristics of electronic markets, however, enhance the possibility that e-commerce will be conducted in an environment that comes closer to attaining the perfectly competitive ideal than that of most conventional markets. Essentially, technology analogous to that which users already employ to search the Internet can also enable this retailing revolution by allowing consumers easily to obtain comparative product and pricing information. However, for a number of reasons, on-line merchants (e-tailers), are asserting a variety of legal claims that, …
