Whereas organized crime severely damages the peace and health of society, and increasingly it is extremely difficult to clarify the truth in criminal investigations without intercepting the telephone communications or other telecommunications of criminals in serious crimes committed by conspiracy, such as organized murder and unlawful trade of drugs or firearms, the purpose of this law is to set forth the requirements, procedures, and other matters that are relevant to the invasive action of intercepting telecommunications, as provided in the Code of Criminal Procedure (Law No. 131, 1948), and are essential for dealing appropriately with such crimes, in such a …

Everyone Benefits, Everyone Pays: Does The Fifth Amendment Mandate Compensation When Property Is Damaged During The Course Of Police Activities?, C. Wayne Owen Jr.

William & Mary Bill of Rights Journal

The Fifth Amendment of the United States Constitution, along with similar provisions in state constitutions, forbids the taking of private property by the government for a public use without just compensation. Despite this protection, many courts have denied takings claims made by innocent third party landowners when police officers caused damage to their property during the course of executing their official duties. These courts held that the damage was not for a "public use" in the narrow sense, and have refused to analyze the claims under takings jurisprudence. Bad Medicine: The Anticompetitive Side-Effects Of Physician Unionization, Thomas Hamilton Segars

Chicago-Kent Law Review

In response to the predominance of managed health care, ever-increasing numbers of physicians are turning to unionization as a means of negotiating contracts with larger insurers. While physician unionization has a history of both political and legal controversy, recent federal legislation aims to make the practice legitimate. This Note discusses the trend toward physician unionization, the resulting anticompetitive effects, as well as possible alternatives for physicians seeking to bargain with the powerful health care insurance industry.

Part I of the Article engages the revisionists squarely on the turf they have staked out: the intent of those who framed and ratified the Second Amendment. Here I credit the revisionists with some important insights. Their research reminds us how greatly the world in which the Second Amendment was adopted differed from our own. This perspective helps us understand how the Founders could have placed the right to bear arms on par with the right to free speech--a decision that baffles many modern Americans. The Japanese Law On Communications Interception During Criminal Investigatons: Translator's Introduction, Yohei Suda

Washington International Law Journal

Japan enacted the Law on Communications Interception During Criminal Investigations last year to help control organized crime. The legislation is, in part, a reaction to domestic and international pressure that grew from recent, well-publicized crimes such as the Aur Shinrikyo attack on a Tokyo subway. The Interception Law is a powerful tool for Japanese law enforcement, however the question of whether the Interception Law violates Japan's constitutional rights to privacy and secrecy of communication has not yet been resolved.

The Douglas County Drug Court: A Comparison Of Recidivism Rates Between Drug Court Participants And Traditionally Adjudicated Drug Offenders, Erika Davis Frenzel

Over the years there have been large increases in the number of drug offenders arrested, prosecuted, and sentenced to prison. These increases have lead to an overload of the criminal justice system. This overload prompted states to develop new responses to substance use and drug-related crime. One such innovation is the drug treatment court, which combines accountability and treatment. The goal of these courts is to reduce recidivism and substance use among drug-involved criminal offenders. This study uses data from Douglas County (Nebraska) to compare recidivism rates for participants in the Douglas County Drug Court and traditionally adjudicated drug offenders. …

Trying to evaluate complex activities involves one in a series of difficult problems that have not yet been solved. It is particularly difficult to deal with public policymaking, which not only is complex, but also involves many values. Nevertheless, we can develop a rigorous approach to analyzing, evaluating, and improving public policymaking if we start by developing explicit criteria and standards that will replace the implicit assumptions, one-sided views, and halo effects we all use for lack of anything better.

The Journal of Sociology & Social Welfare

Postsecondary education is the key to exiting from poverty permanently. Yet, the PRWORA allows women only up to 12 months of vocational training while on welfare. This paper focuses on bringing back the importance of investing in the education of poor women, particularly the postsecondary education of poor women with children, to the forefront of the welfare debate. In this paper we review federal and state level welfare policies toward postsecondary education of poor women with children. Some states are interpreting federal welfare policy strictly and allowing only up to 12 months of vocational training while on welfare. Other states …

A fierce debate about the Second Amendment has been percolating in academia for two decades, and has now bubbled through to the courts. The question at the heart of this debate is whether the Amendment restricts the government's ability to regulate the private possession of firearms. Since at least 1939 - when the Supreme Court decided United States v. Miller, its only decision squarely addressing the scope of the right to "keep and bear Arms" - the answer to that question has been an unqualified "no." Small groups have formed to resolve social issues since the beginning of time. It is the village concept where activists meet in the center of town to discuss a concern and together work toward a solution to a problem. This is represented in the town of Plato’s Republic and how they handled its dilemma with Socrates disrespect and disruptions to their way of ruling/ their culture. People met at a central location, discussed the issue, agreed on a solution and, together, enforced the resolution.
