The Implementation Of Oregon’S Death With Dignity Act: Reassuring, But More Data Are Needed, David Orentlicher Jan 2000

The Implementation Of Oregon’S Death With Dignity Act: Reassuring, But More Data Are Needed, David Orentlicher

Scholarly Works

Undoubtedly, empirical data from Oregon will play a key role for academics, legislators, judges, and the public as debate over the legalization of physician-assisted suicide continues. A central issue in the debate is whether a right to assisted suicide can be limited to only the truly compelling cases, or whether it will in practice be provided to patients who choose it out of depression, coercion, or misunderstanding. Empirical research can provide critical insights into this question.

Employment Discrimination In Higher Education, Oren R. Griffin, Thomas P. Hustoles Jan 2000

Employment Discrimination In Higher Education, Oren R. Griffin, Thomas P. Hustoles

Articles, Chapters in Books and Other Contributions to Scholarly Works

During 1999, the most significant development in employment discrimination law involving colleges and universities, by a large margin, was a series of cases affirming that Eleventh Amendment immunity from private money damage claims brought pursuant to various federal employment discrimination statutes applied to state colleges and universities. This development eventually culminated in the Supreme Court's year 2000 decision in Kimel v. Florida Board of Regents.' Numerous other interesting decisions were rendered that, although not creating any bold new law, either affirmed trends in past cases, or illustrated important practical implications for generally predicting judicial outcomes given certain fact patterns. After …

Chinese Numeratives And The Mass/Count Distinction, David Goodman Jan 2000

Chinese Numeratives And The Mass/Count Distinction, David Goodman

Dissertations and Theses

This study investigates the mass/count distinction for lexical nouns, and how this is formalized morphosyntactically in language. English is one language in which a grammaticized mass/count distinction can be seen--though there are varying explanations regarding what this distinction actually signifies. Chinese, on the other hand, is a language which might appear to be missing a formalized mass/count distinction. However, I postulate that Mandarin Chinese does in fact have a syntactic-distributional diagnostic available for teasing apart mass nouns from count nouns.

The diagnostic that I propose for finding a mass/count distinction among lexical nouns in Mandarin lies in the distribution of …

The Freedom Of Access To Clinic Entrances Act And The Nuremberg Files Web Site: Is The Site Properly Prohibited Or Protected By Speech, Melanie C. Hagan Jan 2000

The Freedom Of Access To Clinic Entrances Act And The Nuremberg Files Web Site: Is The Site Properly Prohibited Or Protected By Speech, Melanie C. Hagan

UC Law Journal

In 1999, a federal jury, in the case of Planned Parenthood v. American Coalition of Life Activists, returned a verdict in plaintiff's favor to the tune of $100 million. At issue was whether the Web site known as The Nuremberg Files, as well as printed "wanted style" posters dubbed The Deadly Dozen, both listing personal information regarding abortion physicians, were "threats" under The Freedom of Access to Clinic Entrances Act of 1994 (FACE).

FACE imposes liability on any person who intimidates or attempts to intimidate by force or threat of force any person because that person provides reproductive health services. …

Faculty Diversity As A Clinical Legal Education Imperative, Jon C. Dubin Jan 2000

Faculty Diversity As A Clinical Legal Education Imperative, Jon C. Dubin

UC Law Journal

Clinical legal education has rapidly evolved from a novelty or boutique offering in law school curricula to a relatively settled and accepted component of the academy. Much has been written about the composition of law and university faculties, the value of faculty diversity in university and traditional law school educational settings, and proposals for reform. However, scant attention has been paid to the composition of the increasingly significant cadre of law professors engaging in clinical teaching and scholarship and the educational and social consequences of the demographic distribution of clinical faculty positions. In this article, Professor Dubin examines and analyzes …

Influence Of Public Image Of Nurses On Nursing Practice, Miyuki Takase Jan 2000

Influence Of Public Image Of Nurses On Nursing Practice, Miyuki Takase

Theses: Doctorates and Masters

Many researchers believe that nurses live in a dual structure, encompassing both the social and nursing worlds. They contend that these two worlds have contrasting views toward nurses. This is, while nurses are guided to establish professional status, society still expects them to remain in a dependent role. This conflict is assumed to have a negative impact on nurses’ psychological and functional states (Kalisch & Kalisch, 1983 & 1987). However, this assumption has not yet been explored sufficiently. The aim of this descriptive correlational study was therefore to investigate the relationships among the public image of nurses, nurses’ self concept, …

Living With A Transvestite : A Phenomenological Study Of Wives And Committed Partners Of Transvestites, Heather Christine Freegard Jan 2000

Living With A Transvestite : A Phenomenological Study Of Wives And Committed Partners Of Transvestites, Heather Christine Freegard

Theses: Doctorates and Masters

Being a man or woman is at the core of human social lives and personal identity, and guides appropriate behaviours such as dress, mannerisms and relationships. Transvestism, or the practice of wearing the clothes of the other gender, challenges societal values and guidelines for behaviour. The attitude of society to this practice has varied from veneration to vilification depending on the period of history and the culture of the people. In western countries, although there is little social or legal repression, transvestism is largely a hidden phenomena. The tradition of comic drag has dominated public recognition of cross-dressing. Hence transvestites …

Target Language Avoidance By Thai Teachers Of English: Thai Teachers' Beliefs, Sasithorn Vacharaskunee Jan 2000

Target Language Avoidance By Thai Teachers Of English: Thai Teachers' Beliefs, Sasithorn Vacharaskunee

Theses: Doctorates and Masters

Interactionist theories of second language acquisition (SLA) claim that both comprehensible input and modified interaction in the target language are necessary for language learning. In the foreign language context, little opportunity exists for such input simply through exposure to the target language outside the classroom. Therefore, the quantity as well as quality of input within classrooms is especially important. However in spite of this fact many non-native teachers of second language, including English as a foreign language (EFL) teachers, tend to avoid using the target language in their classrooms. This has serious pedagogic implications. Thai teachers are typical of many …

Lower Secondary Student Attitudes Towards Social Studies In A Catholic School, Ekaterina Thiveos Jan 2000

Lower Secondary Student Attitudes Towards Social Studies In A Catholic School, Ekaterina Thiveos

Theses : Honours

This case study examined lower secondary student attitudes towards social studies and identified the factors that influenced attitudes in one Catholic secondary school located in the Perth metropolitan area. A total of 4 75 students were enrolled in Years 8 to 10 at the school in 1999. A modified version of Student Attitudes Towards Social Studies (Moroz 1996) questionnaire with 94 items, was utilised to gauge secondary student attitudes towards the learning area. A total of 421 lower secondary students participated in the survey. The data was analysed using the statistical software package SPSS 9. 0 for Windows, where descriptive …

Dead Mothers, Lonely Daughters : Negotiating Intersubjective Space In Young Adult Fiction, Anna-Claire Walsh Jan 2000

Dead Mothers, Lonely Daughters : Negotiating Intersubjective Space In Young Adult Fiction, Anna-Claire Walsh

Theses : Honours

This thesis examines the effect of maternal absence on the ability of three central female characters to develop intersubjective relationships in three novels for young adults. The theoretical framework is Jessica Benjamin's psychoanalytic theory of 'intersubjectivity' which seeks to transcend split complementarities such as active-passive creating a model that synthesises traditionally opposed terms. Benjamin situates maternal subjectivity as the foundation from which a baby's identity is constructed and attributes women with both active and passive qualities. The relationship between mother and infant consequently acts as a paradigm for understanding the interaction between adult subjects in later life. Chapter One introduces …

The Destruction Of The Outsider In The Plays Of Tennesee Williams, Warren Herbu Jan 2000

The Destruction Of The Outsider In The Plays Of Tennesee Williams, Warren Herbu

Theses : Honours

This thesis explores the theme of the Outsider in the plays of American dramatist, Tennessee Williams. My central line of argument is that these Outsiders are defeated and destroyed by a number of complex personal and societal forces. After defining what it means to be an Outsider in a Williams play, I will proceed to investigate why and how the figure of the Outsider is destroyed in the following: - 27 Wagons Full of Cotton - Portrait of a Madonna - A Streetcar Named Desire - Orpheus Descending - Suddenly Last Summer - Sweet Bird of Youth. The first two …

Representations Of Class, Social Realism And Region In "Eleven Months In Bunbury" By James Ricks, Joshua J. K. Ledger Jan 2000

Representations Of Class, Social Realism And Region In "Eleven Months In Bunbury" By James Ricks, Joshua J. K. Ledger

Theses : Honours

The aim of this thesis is to explore representations of class, social realism and region in Eleven months in Bunbury by James Ricks. This novel stands outside dominant literary theory in its representations of class, realism and regionalism. It also presents opportunities to consider ideology and class through the eyes of a working class person, in the language of the class that it depicts. Thus it speaks to a class which rarely has its point of view and lives represented in conventional literature. It is therefore a useful literary and social document.

A Queer Love : The Gay Male In Young Adult Literature, Skot John Arbery Jan 2000

A Queer Love : The Gay Male In Young Adult Literature, Skot John Arbery

Theses : Honours

The purpose of my thesis· A Queer Love: The Gay Male in Young Adult Literature -is to offer an analysis of seven young adult novels that incorporate the construction and representation of while male homosexuality. I intend to explore what it is that can be learnt from these texts about 'being gay'. It is my assertion that I will be able to show that, although taboos have been shifted in young adult literature to allow the exploration of issues relating to gay adolescence, that which is condoned as acceptable 'gay behavior' remains restricted. I propose that in order for gay …

The Effects Of Conceptual Change On The Transfer Of Established Skills, John Forbes Jan 2000

The Effects Of Conceptual Change On The Transfer Of Established Skills, John Forbes

Theses : Honours

When people practice a task, their performance in terms of speed and accuracy normally improves in a smooth manner that follows a power function. The consistency with which the performance of a wide range of skills conforms to this power function relationship is known as the Power Law of Learning, and has been an important assumption of many of the dominant theories of skill acquisition and transfer. As such, the form of the power function that is derived from the training process has been used to predict performance when task conditions remain constant. However, Speelman and Kirsner (under review) have …

The Factors That Influence Psychological Sense Of Community For Students Living On Campus At Edith Cowan University, Colleen Dalton Jan 2000

The Factors That Influence Psychological Sense Of Community For Students Living On Campus At Edith Cowan University, Colleen Dalton

Theses : Honours

A psychological sense of community (PSOC) has been found to facilitate adjustment and well-being. However, little research has been conducted in Australian universities. In order to gain a deeper understanding of the phenomena, a qualitative approach was adopted. This research explored PSOC from the participants' perspective using McMillan and Chavis's (1986) theoretical framework as a guide and investigated the following research questions. (1) What is the residential students' perception of PSOC, at Edith Cowan University (ECU)? (2) What factors, within the student village, facilitate and inhibit PSOC? (3) What factors within the university setting and beyond, in the wider community, …

Virtual Reality And The Modern Ideology Of Order And Control, Craig I. Murrihy Jan 2000

Virtual Reality And The Modern Ideology Of Order And Control, Craig I. Murrihy

Theses : Honours

In this thesis I will examine the construction of the concept of Virtual Reality. I argue that rather than a technology of liberation as it is often perceived, virtual realities' conception has been influenced significantly by a discourse of control and order. I examine books, articles and films concerning Virtual Reality to support this claim. Furthermore this discourse of control and order is born out of a larger ideology of Western culture that values order and control. Throughout modernity this ideology has manifested itself through techniques and technologies of social and environmental control. I provide a brief historical outline highlighting …

The Animus : A Jungian Perspective On The Films Of Jane Campion, Taryn Louise Ricketts Jan 2000

The Animus : A Jungian Perspective On The Films Of Jane Campion, Taryn Louise Ricketts

Theses : Honours

Carl Jung's notion of contrasexuality allows women to embrace the masculine as well as feminine aspects of their personality. This creates a sense of complementarity or balance that is often lacking in the established psychoanalytic interpretation of female representations within mm texts. The 'animus,' or masculine complex, is an empowering theory in understanding representations of women within the filmic text as embarking on a process of self-realisation, self-acceptance, and the discovery of their own authority in the context of their relationships with men. Furthermore, the animus has been credited as Jung's greatest contribution to the study of the female psyche. …

An Investigation Of The Multiple Response To Oppression And Implications For Identity Among Aboriginal Adolescents, Victoria E. Hovane Jan 2000

An Investigation Of The Multiple Response To Oppression And Implications For Identity Among Aboriginal Adolescents, Victoria E. Hovane

Theses : Honours

In a history characterized by dispossession and oppression since colonisation, the responses of Aboriginal people to oppression have typically been presented from an ethnocentric perspective of internalization and assimilation. Another body of literature however, suggests alternative responses to non-dominant status such as resistance and adaptation to oppression. This study sought to investigate the ways in which Aboriginal adolescents respond to the negative messages they receive about being Aboriginal and the implications for their developing sense of identity, within a sociopolitical framework. A group of nine participants (five females and four males), aged 14 - 17 years (M = 15.4yrs), were …
