Reading Ability As A Predictor Of Student Success In Business School, Robert E. Pritchard, George C. Romeo Jan 2000

Reading Ability As A Predictor Of Student Success In Business School, Robert E. Pritchard, George C. Romeo

Mid-Western Educational Researcher

For several years accounting faculty at a regional university observed that some of their students exhibited difficulty reading. This study of 235 sophomore, junior, and senior business majors enrolled in accounting classes examines the relationship between their reading abilities as measured by the Nelson-Denny Reading Test and their cumulative grade point averages (GPAs). The results indicate that students who have higher levels of reading comprehension and reading vocabulary have higher cumulative GPAs. Furthermore, the results indicate that about 16 percent of the students tested could not read at the first-year college level. This paper describes the testing and recommends that …

Culture And Strategy In Business Schools: Links To Organizational Effectiveness, Christopher Clott, Nancy Fjortoft Jan 2000

Culture And Strategy In Business Schools: Links To Organizational Effectiveness, Christopher Clott, Nancy Fjortoft

Mid-Western Educational Researcher

The purpose of this study is to examine the independent and conditional effects of organizational culture type and managerial strategy on the organizational effectiveness of higher education schools of business. While significant differences are found for both culture type and managerial strategy on the effectiveness measures, there were no significant interactive effects between the two independent variables. The implications of these findings for efforts to enhance the effectiveness of professional and pre- professional collegiate programs are discussed.

Examination Of Student-Active Learning Practices In A College/Middle School Educational Collaboration, S. Prattis, I. Czerwiec Jan 2000

Examination Of Student-Active Learning Practices In A College/Middle School Educational Collaboration, S. Prattis, I. Czerwiec

Journal of Mathematics and Science: Collaborative Explorations

A college and middle school student teaching collaboration was developed to interest more college students in teaching K-12 science, to enhance diversity among K-16 teaching faculties, and to inspire the K-12 students to expand their knowledge beyond their classroom curriculum. To assess our results, we used a modified Likert survey instrument and self-reflective analysis in middle school and college students, respectively. Overall, middle school students expressed satisfaction in the science learning in which they participated. In addition, college students reported that they learned specific content when made responsible for teaching material to younger students. Collaborative projects such as this one …

U.S. Dietary Supplement Regulation: Belief Systems And Legal Rules, Michael H. Cohen Jan 2000

U.S. Dietary Supplement Regulation: Belief Systems And Legal Rules, Michael H. Cohen

UC Law SF Journal on Gender and Justice

This article explores dietary supplement regulation and the belief systems and legal rules that shape it. Part I discusses the key provisions of the federal Dietary Supplement Health and Education Act (DSHEA). Part II examines how DSHEA, philosophically, represents a compromise between extreme medical paternalism (the orthodox view that the FDA should dictate consumer access to dietary supplements) and radical patient autonomy (the liberal view that patients should have unlimited consumer access to dietary supplements). Part II frames the debate in terms of regulatory proposal, policy, values, and belief system. Strong controls in regulation (FDA's paternalistic viewpoint) and weak controls …

When Service With A Smile Invites More Than Satisfied Customers: Third-Party Sexual Harassment And The Implications Of Charges Against Safeway, Sarah L. Ream Jan 2000

When Service With A Smile Invites More Than Satisfied Customers: Third-Party Sexual Harassment And The Implications Of Charges Against Safeway, Sarah L. Ream

UC Law SF Journal on Gender and Justice

Sexual harassment in the workplace, a form of sex discrimination, has received substantial legislative and judicial attention in the past several decades. Courts have recognized that harassment may arise from supervisor or co-worker conduct. Increasingly, courts are also acknowledging harassment by third-parties, such as independent contractors or customers. This note examines the law of such "third-party sexual harassment" with regard to harassment perpetrated by customers. Particular attention is given to the implications of charges filed against a major super market chain alleging harassment by customers due to the implementation of a customer service policy.

Revisiting Poor Joshua: State-Created Danger Theory In The Foster Care Context, Michele Miller Jan 2000

Revisiting Poor Joshua: State-Created Danger Theory In The Foster Care Context, Michele Miller

UC Law SF Journal on Gender and Justice

The Supreme Court's decision in DeShaney v. Winnebago County Department of Social Services declared that abused children in the legal custody of the state (but residing with their natural parent) have no private cause of action against the state for substantive due process violations. Since the decision, many courts have attempted to circumvent DeShaney by using a "state-created danger theory," by which a state may be liable, under negligence principles, for removing a child from foster care and returning him/her to a parent, despite clear indications that future abuse will occur. This note examines the application of the state-created danger …

Privacy And Celebrity: An Essay On The Nationalization Of Intimacy, Robert F. Nagel Jan 2000

Privacy And Celebrity: An Essay On The Nationalization Of Intimacy, Robert F. Nagel

University of Richmond Law Review

I start from the rather obvious proposition that in recent years the American public has placed a high value on the right of privacy. This general commitment to privacy was what kept Robert Bork, despite his qualifications, off the Supreme Court, and more recently it was what kept William Clinton, despite his behavior, in the White House. Bork's nomination was a threat to the constitutional right to use contraceptives and to choose abortion, while the impeachment charges against Clinton were a threat to the moral distinction between public political life and private sexual behavior. The power that the idea of …

Qualified Intimacy, Celebrity, And The Case For A Newsgathering Privilege, Rodney A. Smolla Jan 2000

Qualified Intimacy, Celebrity, And The Case For A Newsgathering Privilege, Rodney A. Smolla

University of Richmond Law Review

In this symposium issue Robert Nagel, Diane Zimmerman, Robert O'Neil, and Erwin Chemerinsky explore the intersection of privacy and freedom of the press. In his fascinating inquiry into privacy and celebrity in modern American life, Robert Nagel demonstrates the connection between the American public's strong commitment to privacy and its simultaneous passion for robust protection of freedom of speech. Among his most important insights is the exposure of "pseudo-intimacy" as a principal currency of contemporary celebrity status. Diane Zimmerman, Robert O'Neil, and Erwin Chemerinsky all investigate the legal principles that ought to surround aggressive and surreptitious newsgathering techniques, each in …

The Tools For Enforcing International Criminal Justice In The New Millennium: Lessons From The Yugoslavia Tribunal, Michael P. Scharf Jan 2000

The Tools For Enforcing International Criminal Justice In The New Millennium: Lessons From The Yugoslavia Tribunal, Michael P. Scharf

Faculty Publications

It is one thing to create an international institution devoted to enforcing international justice; it is quite another to make international justice work. Unlike the Nuremberg Tribunal, whose orders were implemented by the Allied occupation forces, the ICC will have no constabulary. In the absence of a direct enforcement mechanism, the ICC will have to rely on state cooperation and indirect means of inducing compliance with its arrest orders and requests for judicial cooperation.

The range of enforcement measures potentially available to the ICC include: (1) condemnation of non-cooperation by the Assembly of State Parties or the U.N. Security Council; …

Racial Profiling: "Driving While Mexican" And Affirmative Action, Victor C. Romero Jan 2000

Racial Profiling: "Driving While Mexican" And Affirmative Action, Victor C. Romero

Michigan Journal of Race and Law

This Essay will focus on "racial profiling" not just in the way many people think about the term-that is, with respect to stopping motorists for traffic violations based solely on their race, so-called "Driving While Mexican" or "Driving While Black"-but also in the context of "affirmative action"-namely, using race as a factor in employment and educational decisions. More broadly, then, the author wants us to think of "racial profiling" as simply "the use of race to develop an understanding of an individual," which moves us slightly away from more pejorative notions of the phrase that have seeped into the national …

The New Cultural Diversity And Title Vii, Steven A. Ramirez Jan 2000

The New Cultural Diversity And Title Vii, Steven A. Ramirez

Michigan Journal of Race and Law

This Article will show that the most progressive diversity initiatives taking hold in the business community are facially neutral in their approach, merit-driven, and fundamentally culture-conscious (as opposed to race-conscious). These initiatives do not allow for any racial preference or gender preference and draw any such bias not from the inherent values of diversity but from the largely segregated pre-existing corporate tradition: hiring culturally aware minorities unleashes value because they bring insights previously unavailable to segregated businesses. In other words, White males can be and are hired in the name of cultural diversity when they bring cultural insights to the …

American Holocaust Films: A Case Study In Jewish American Identity (1937-1993), Jeff Daniels Jan 2000

American Holocaust Films: A Case Study In Jewish American Identity (1937-1993), Jeff Daniels

Honors Theses

When examining the image of the Jew in American Holocaust films, one is truly determining how American Jews view themselves. These films' presentation of Jews exposes not only how Jewish Americans wished to see themselves but also how much Gentile Americans wanted to see of Jewish culture. An exploration of America's Holocaust films from the late 1930s to the early 1990s reveals an increasing concentration of Jews as the main victims of the event. The degree to which this specificity is emphasized exhibits how much the American public accepted Jews and their plight. At the same time, the prevalence of …
