"Trapped" In Sing Sing: Transgendered Prisoners Caught In The Gender Binarism, Darren Rosenblum Jan 2000

"Trapped" In Sing Sing: Transgendered Prisoners Caught In The Gender Binarism, Darren Rosenblum

Elisabeth Haub School of Law Faculty Publications

This Article first summarizes gender, transgendered identity, and legal issues facing transgendered people to contextualize the lives of transgendered prisoners. Parts II and III explore respectively the placement and treatment issues that complicate the incarceration of the transgendered. Corrections authorities, through indifference or incompetence, foster a shockingly inhumane daily existence for transgendered prisoners. In Part V, I examine the plight of transgendered prisoners through the metaphor of the miners' canary. Transgendered prisoners signal the grave dangers facing all of us in a wide array of social structures, elucidating the apparently intractable problems of gender. This Article simultaneously explores a human …

Minors As Medical Decision Makers: The Pretextual Reasoning Of The Court In The Abortion Cases, J. Shoshanna Ehrlich Jan 2000

Minors As Medical Decision Makers: The Pretextual Reasoning Of The Court In The Abortion Cases, J. Shoshanna Ehrlich

Michigan Journal of Gender & Law

By examining the Court's failure to consider the allocation of authority between parents and children in the critical realm of medical decision making, this article exposes the irrationality of the Court's acceptance of limitations on the abortion rights of minors and reveals the pronatalist thrust of the parental involvement decisions. The article begins by looking at how the Roe Court characterized abortion as a medical decision, followed by a discussion about the medical decision-making rights of minors. Rooted in this medical paradigm, the article then turns to the parental involvement cases to examine the Court's failure to consider the medical …

Meaningful Work: Rethinking Professional Ethics, Mike W. Martin Jan 2000

Meaningful Work: Rethinking Professional Ethics, Mike W. Martin

Philosophy Faculty Books and Book Chapters

As commonly understood, professional ethics consists of shared duties and episodic dilemmas--the responsibilities incumbent on all members of specific professions joined together with the dilemmas that arise when these responsibilities conflict. Martin challenges this "consensus paradigm" as he rethinks professional ethics to include personal commitments and ideals, of which many are not mandatory. Using specific examples from a wide range of professions, including medicine, law, high school teaching, journalism, engineering, and ministry, he explores how personal commitments motivate, guide, and give meaning to work.

Subjective Quality Of Life In Total Knee Replacement Secondary To Osteoarthritis, James J. Cenova Jan 2000

Subjective Quality Of Life In Total Knee Replacement Secondary To Osteoarthritis, James J. Cenova

Physical Therapy Scholarly Projects

Osteoarthritis is the most common referring diagnosis for total knee replacement surgery. It is estimated that one-third of community-living persons between the ages of 63 and 94 have osteoarthritis of the knee. It is further estimated that fully 40% of these people experience pain. Many of these people look for relief in total knee replacement surgery. Total knee replacement surgeries are a costly procedure commonly performed. There were approximately 210,000 primary knee replacements performed in 1994. This resulted in an estimated cost of $5 billion.

The purpose of this paper is to examine quality of life and its association with …

Physical Activity: Essential Component In Primary And Secondary Curricula For Lifelong Health, Maril Mccord Jan 2000

Physical Activity: Essential Component In Primary And Secondary Curricula For Lifelong Health, Maril Mccord

Physical Therapy Scholarly Projects

Chronic disease, preventable illness and injury, and growing trends of sedentary behaviors have currently been associated with the American population. It is estimated that 70% of all deaths in America are attributable to chronic disease of a preventable nature. Childhood disease has declined only to be replaced by new waves of social, environmental, and behavioral factors which manifest as health risks. At least 68 million Americans suffer from some form of heart disease while nearly 60% of adults lead sedentary lifestyles. The challenge in the nation is to counter these trends by implementation of policy and programs for healthier habits …

The Lymphatic System, Lymphedema, And A Discussion Of Methods For Treatment: A Review Of The Literature, Lisa Schneider Jan 2000

The Lymphatic System, Lymphedema, And A Discussion Of Methods For Treatment: A Review Of The Literature, Lisa Schneider

Physical Therapy Scholarly Projects

The condition of lymphedema has a significant impact of the quality of life of the person affected. Few patients are educated about the possibility of developing lymphedema and methods for prevention of lymphedema following surgical removal of lymph nodes or radiation therapy. Also, most physical therapists have received minimal or inadequate training in the area of lymphedema treatment. Hence, physical therapists may actually damage a patient's lymphatic system by using inadequate techniques.

The purpose of this literature review is to examine the lymphatic system, discuss the condition of lymphedema, and review various methods for prevention and treatment of lymphedema in …

The Dcs Visual-Memory Learning Test With Ld And Non-Ld Children Ages 9 To 16 Years Old, David A. Snider Jan 2000

The Dcs Visual-Memory Learning Test With Ld And Non-Ld Children Ages 9 To 16 Years Old, David A. Snider

Theses, Dissertations and Capstones

The primary purpose of this study is to determine whether the DCS Visual Memory Learning Test (DCS) can discriminate between subjects with learning disabilities (LD students) and subjects without learning disabilities (non-LD students). Although the DCS has established itself as a valuable neuro-psychological instrument in Europe ( Lamberti & Weidlich, 1999) over the past twenty years, very little research currently is available on the DCS in the United States, and nearly all of the published research on the DCS is written in German. The current study examined the capability of the DCS to discriminate between a population of 52 LD …

The Perceptions Of Male And Female Western Australian Adolescents In Relation To Body Image And Smoking, Mary Edwards Jan 2000

The Perceptions Of Male And Female Western Australian Adolescents In Relation To Body Image And Smoking, Mary Edwards

Theses : Honours

Although the numbers of adult smokers has declined, numbers of adolescent smokers have not, with females outnumbering males. Research has indicated that adolescent females have higher levels of body image dissatisfaction than males. This dissatisfaction is mostly with regard to weight, which suggests a possible association between female adolescents smoking and weight control. A study of American adolescents (Camp, Klesges & Relyea, 1993) found that adolescent females were more likely to perceive that smoking is a method of weight control and to use smoking to control their weight than adolescent males. This present study investigated the perceptions of625 Western Australian …

Men's Health: How Men Understand The Concept Of Health And How This Understanding Shapes Actions, Craig T. Thompson Jan 2000

Men's Health: How Men Understand The Concept Of Health And How This Understanding Shapes Actions, Craig T. Thompson

Theses : Honours

The purpose of this research was to explore how men understand the concept of health, and how this understanding shapes actions. This dissertation developed as a result of both working at a Community Health Centre, and having an awareness that in Australia, statistics indicate that men's health is steadily deteriorating. A theoretical framework implementing the concepts of health, socialisation (masculinity) and cognition was utilised to guide the research. The research involved interviewing six male participants, who were university students ranging in age from 20 to 40 years. Participants were questioned regarding their perceptions of health and health management. Interview transcripts …

Wreath-Laying In Poet's Corner, Westminster Abbey, Chris Smith Jan 2000

Wreath-Laying In Poet's Corner, Westminster Abbey, Chris Smith

The George Eliot Review Online, ISSN: 2831-5375

The Guest of Honour was The Rt Hon. Chris Smith, MP, Secretary of State for Culture, Media and Sport. The Address he gave is summarized below:

Mr. Smith is a great admirer of George Eliot and it is said that he takes with him on holiday each year one of George Eliot's novels! He began by noting that he was standing next to the memorial stone to Henry James and he reminded us of James's admiration for George Eliot. Henry James wrote on 5 March 1873 'a marvellous mind throbs in every page of Middlemarch. It raises the standard of …

The Twenty-Eight George Eliot Memorial Lecture, 1999, Josie Billington Jan 2000

The Twenty-Eight George Eliot Memorial Lecture, 1999, Josie Billington

The George Eliot Review Online, ISSN: 2831-5375

Middlemarch is widely recognized as being one of the most strenuously narrated novels in English literature. Many of the most moving, and most quoted, lines of the novel are the product of direct narrational intervention and the reader is aware of the surrounding, solicitous presence of the author-narrator throughout the novel. Throughout this paper, I am going to be looking closely at a number of short passages from the novel in order to try to establish the 'tasks' - as I call them - which George Eliot undertakes and fulfils through her narrator in Middlemarch. But I should like to …

Towards A Critical Reputation: Henry James On Felix Holt, The Radical, Christine Richards Jan 2000

Towards A Critical Reputation: Henry James On Felix Holt, The Radical, Christine Richards

The George Eliot Review Online, ISSN: 2831-5375

A productive starting point for a critical evaluation of Henry James's criticism of George Eliot's fiction is his unsigned review of Felix Halt, the Radical, 1 which, as his first piece of criticism on her, is perhaps itself most usefully read against the background of the novel's extremely favourable contemporary reception,' for in his review lames addresses the issues of the novel's acclaim, arguing not only that the volume of praise it had already acquired was sufficient but also that Eliot's increasing reputation would only attract more (E&W 911). This determination to call a halt to the praise showered on …

Silas Marner And Felix Holt: Antitheses And Affinities, Ruth Harris Jan 2000

Silas Marner And Felix Holt: Antitheses And Affinities, Ruth Harris

The George Eliot Review Online, ISSN: 2831-5375

At first sight there seems little to link Silas Mamer with Felix Halt. There are certainly contrasts, but it is harder to find similarities between a short pastoral idyll and a complex political work that looks forward to Middlemarch rather than backward to Silas Mamer. Surely there can be few links between a fairy-tale and social analysis, between a novel rich with 'Rainbow' humour and transformed 'gold' and a much darker novel laced with irony but short on both magic and jokes. Only five years separate Silas Mamer (published in April 1861) from Felix Halt (published in June 1866) but …

Review Of George Eliot: The Last Victorian & The Journals Of George Eliot, Margaret Harris, Judith Johnston Jan 2000

Review Of George Eliot: The Last Victorian & The Journals Of George Eliot, Margaret Harris, Judith Johnston

The George Eliot Review Online, ISSN: 2831-5375

Kathryn Hughes has written a most readable biography, breezy, relaxed, clear narrative, just right for the reader of literary biography who isn't deeply interested in literature. The story of Mary Ann and Marian Evans, Marian Evans Lewes, George Eliot and Mrs. Cross is as fascinating as the plot of the novels, and bears re-telling, but I'm doubtful about the appeal of this new book to scholars and students, whose needs for information about George Eliot's life are served by the existing biographies, and who may be misled by the sketchy criticism. It is not as if Kathryn Hughes fills the …

Marriage Law And Family Law: Autonomy, Interdependence, And Couples Of The Same Gender, Jennifer Wriggins Jan 2000

Marriage Law And Family Law: Autonomy, Interdependence, And Couples Of The Same Gender, Jennifer Wriggins

Faculty Publications

The Article argues for the recognition of same-sex marriage from a normative and family law perspective, rather than a rights perspective. Contemporary family law and marriage law in the United States have been criticized by communitarian scholars and others as being too focused on individuals and individual fulfillment. These critiques make some valid points. It is also important, however, to emphasize that contemporary marriage law, for the first time, presents a model of equality and of reciprocal obligations.

The Article articulates a broad framework of the functions of family and marriage law, drawing on work by Carl Schneider and Mary …

Obituary Of Jerome Beaty, 1924-2000 Jan 2000

Obituary Of Jerome Beaty, 1924-2000

The George Eliot Review Online, ISSN: 2831-5375

Jerome Beaty died on 30 January 2000, at the age of 75, after a year of illness during which he was working actively on Dickens and George Eliot. He was a fine Victorian scholar and critic, an editor, and a pioneer in the field of George Eliot textual studies. His book Middlemarch from Notebook to Novel (Urbana, 1960) analysed the genesis and composition of one of the most complex English novels, revealing that what seemed a seamless whole, more praised than studied, had its origin in two separate narrative beginnings and plans. He showed the painstaking scissors-and-paste which put together …

Fragmentation Versus Integration Of Faculty Work, Carolin Kreber, Patricia Cranton Jan 2000

Fragmentation Versus Integration Of Faculty Work, Carolin Kreber, Patricia Cranton

To Improve the Academy: A Journal of Educational Development

Present faculty development practice encourages new faculty to integrate teaching, research, and other aspects of academic work early in their careers. By drawing on both the cognitive and the developmental psychology literature, we propose integration as an advanced stage of adult development that comes about as a result of extensive experience and expertise. We argue that faculty should be advised to focus on either research or teaching at different times during their early years and that integration of professorial roles should only be expected at a later stage. We discuss the implications of such an approach for faculty development.
