Past-Dependency, Pragmatism, And Critique Of History In Adjudication And Legal Scholarship, Richard A. Posner
Past-Dependency, Pragmatism, And Critique Of History In Adjudication And Legal Scholarship, Richard A. Posner
Articles
Using Nietzsche's great essay on the uses and disadvantages of history for life as his jumping-off point, Judge Posner examines the utility of the study of history for adjudication and legal scholarship. He argues, following Nietzsche; that the wrong kind of historical study can be very bad for "life " including law, while the right kind-the kind deployed by a pragmatic judge or a policy-oriented legal scholar-may deviate from literal accuracy in the direction of a rhetorical and imaginative narrative of historical events that can be constructively employed in a forward-looking approach to legal problems.

Creative Writing, Storyboarding And Video Script Writing As Techniques To Stimulate The Development Of Imagination And Imagery To Aid In Reading Comprehension, Ellen Settlemyer Bartelli
All Graduate Projects
The relationship between imagination, pretend play, and reading comprehension was researched through the literature. A curriculum unit was designed featuring two exercises using imagination and imagery in conjunction with the book Night by Elie Wiesel. The first exercise asked students to write a 10 entry journal synthesizing information from a variety of sources into a first person narrative of a Jewish child. The second exercise calls for student groups to write, storyboard, and film a scene from Night on videotape.

[Review Of] Adelaida Reyes. Songs Of The Caged, Songs Of The Free: Music And The Vietnamese Refugee Experience, Deborah Wong
[Review Of] Adelaida Reyes. Songs Of The Caged, Songs Of The Free: Music And The Vietnamese Refugee Experience, Deborah Wong
Ethnic Studies Review
This important book documents two areas, the history of the Vietnamese traumatic emigration to the U.S. from 1975 to the early 1990s and the central role of music in Vietnamese responses to diaspora. Because ethnographic studies of the Vietnamese diaspora are still limited in number, and this is the first focused on Vietnamese expressive practices, Songs of the Caged is a major contribution on both fronts. Unlike many accounts of the Vietnamese American experience, Reyes' book is based on extended field research and addresses big issues with attention to history and to real people in real situations often conveyed through …
Adolescent Autonomy: Clarifying An Ageless Conundrum, Rhonda Gay Hartman
Adolescent Autonomy: Clarifying An Ageless Conundrum, Rhonda Gay Hartman
UC Law Journal
The law governing adolescence is discordant at best, impoverished at worst. Regarded as an appendage to paternalistic policy for children, present legal rules based upon presumptive decisional incapacity produce anomalous results. Most striking, a 16-year-old may confront criminal conviction with punitive and retributive sanction, including the death penalty, but is deemed decisionally incapable to refuse debilitating life-sustaining treatment. Adolescence and its accoutrement of distinct issues has hitherto remained unexamined, until now. In this Article, Professor Hartman proposes a paradigmatic shift in thinking about adolescence that entails a legal framework predicated on decisional ability, rather than presumptive decisional incapacity. By comprehensively …

Thoughts On Some Potential Appellate And Trial Court Applications Of Therapeutic Jurisprudence, Steve Leben
Thoughts On Some Potential Appellate And Trial Court Applications Of Therapeutic Jurisprudence, Steve Leben
Seattle University Law Review
To date, the application of therapeutic jurisprudence principles has been concentrated mainly on specialized trial courts: drug treatment courts, domestic violence courts, criminal courts, and juvenile and family courts. Its application to trial courts generally, as well as its application to the appellate courts, remains largely unexplored. This Article considers three areas in which trial and appellate courts may want to consider applying therapeutic jurisprudence.
